Book excerpt: German Abstract: Dieser Beitrag untersucht die rechtlichen Grundlagen und die Arbeitsweise des Deutschen Rates für Nachhaltige Entwicklung (RNE). Die zentralen Ergebnisse lauten: Die Einrichtung des RNE beruht lediglich auf einer Verordnung der Bundesregierung. Dem RNE fehlt eine gesetzliche Grundlage. Soweit der RNE als Organ der Bundesregierung fungiert, stellen seine sozial-, umwelt- und wirtschaftspolitischen Forderungen an private Unternehmen einen Verstoß gegen das Gesetzlichkeitsprinzip (GG Art. 20(3)) dar. Die Konsum- und Sparempfehlungen, die der RNE privaten Haushalten gibt, verletzen das Prinzip der Kontroversität und widersprechen teilweise dem wissenschaftlichen Forschungsstand. Es wird deshalb empfohlen den RNE nach dem Vorbild des Deutschen Ethikrates zu reformieren.
