Da es sich beim Europäischen Gerichtshof um ein relativ unbekanntes EU-Organ handelt, beginnt die Arbeit mit einer kleinen Einführung. Anschließend wird sowohl die Struktur als auch die Funktion des Gerichtshofes ausführlicher dargestellt. Einen weiteren Untersuchungsgegenstand bilden die verschiedenen Klage- und Verfahrensarten, für die der Europäische Gerichtshof zuständig ist. Nach einem statistischen Überblick rücken dann die Probleme in den Vordergrund, mit denen der Gerichtshof zu kämpfen hat. Die Arbeit endet schließlich mit einer Begutachtung der erst vor kurzem in Kraft getretenen neuen Verfahrensordnung, die entworfen wurde, um die zuvor angesprochenen Probleme zu minimieren. Da viel Wert auf Aktualität gelegt wurde, stammt ein Großteil des Quellenmaterials aus dem Internet. Aufbau und Zuständigkeit des Europäischen Gerichtshofes bzw. des Gerichtshofes erster Instanz lässt sich relativ einfach durch eine grafische Übersicht nachvollziehen, die unter http://europa.eu.int/cj/de/pres/comp.htm zu ersehen ist. Dadurch bestimmt er die Rechtsentwicklung in der Union wie kein anderes Organ der Union und deren Mitgliedstaaten. Dabei stellt sich die Frage, ob dieser machtvolle Gerichtshof überhaupt ein Gericht ist, jedenfalls wie weit er als Gericht gerichtliche Befugnisse ausübt. Dieser Ansatz wirft ein bislang kaum bedachtes demokratierechtliches Problem auf: Ist der demokratische Status als Begriffsmerkmal eines Gerichts einzustufen?Tobias Mähner untersucht auf Basis der von ihm herausgebildeten Begrifflichkeiten, Rechtsprechung und Gericht sowie der untersuchten Einrichtung des Europäischen Gerichtshofes, ob dieser die erforderliche Gerichtsqualität besitzt. Dabei steht der Aspekt der demokratischen Legitimation im Mittelpunkt. Diese hält der Autor für nur unzureichend ausgebildet und postuliert dementsprechend die Beschränkung der Kompetenzen des Gerichtshofes.Mit der vorliegenden Untersuchung leistet Mähner einen Beitrag zum Europäischen Verfassungsrecht, aber auch zu einem Grundproblem des Rechtsstaates, dem demokratischen Status von Gerichten. The European Court of Justice is one of the most important actors in the process of European integration. Political science still struggles to understand its significance, with recent scholarship emphasizing how closely rulings reflect member states' preferences. This book argues that the implications of the supremacy and direct effect of the EU Treaty have still been overlooked. As it constitutionalizes an intergovernmental treaty, the European Union has a detailed set of policies inscribed into its constitution that are extensively shaped by the Court's case law. If rulings have constitutional status, their impact will be considerable, even if the Court only occasionally diverts from member states' preferences. By focusing on the four freedoms of goods, services, persons, and capital, as well as citizenship rights, the book analyses how the Court's development of case law has ascribed a broad meaning to these freedoms. The constitutional status of this case law constrains policymaking at the European and member-state levels. Different case studies show how major pieces of EU legislation partly codify case law. Judicialization is important in the EU. It also directly constrains member-state policies. Court rulings oriented towards individual disputes are difficult to translate into general policies-but if they have constitutional status they have to go through this process. Policy options are thereby withdrawn from majoritarian decision-making. As the Court cannot be overruled, short of a Treaty change, its case law casts a long shadow over policymaking in the European Union, undermining the legitimacy of this political order.
