Oude Elferink's detailed analysis of the negotiations between Denmark, Germany and The Netherlands concerning the delimitation of their continental shelf in the North Sea makes use of the full range of government archives in these three States. He looks at the role of international law in policy formulation and negotiations, and explores the legal context, political considerations and, in particular, oil interests which fed into these processes. He also explains why the parties decided to submit their disputes to the International Court of Justice and looks at the preparation of their pleadings and litigation strategy before the Court. The analysis shows how Denmark and The Netherlands were able to avoid the full impact of the implications of the Court's judgment by sidestepping legal arguments and insisting instead on political considerations.

Book excerpt: Recent developments have produced fundamental and far-reaching changes in the sovereignties bordering the semi-enclosed area of the Baltic Sea. This book presents a comprehensive and balanced codification of issues and views, focusing on new developments in the Baltic Sea Area with specific reference to the UNCLOS 1982 Convention, the particular marine uses of the Baltic Sea, and national views and interests of the bordering states and third parties. It deals with matters such as the Kiel Canal, delimitation, dispute settlement and navigation, shipping, the ecosystem, fisheries, and scientific research. The Baltic Sea is the outcome of a European Workshop on the Law of the Sea co-sponsored by the Law of the Sea Institute (University of Hawaii), the William S. Richardson School of Law (University of Hawaii) and the Stiftung Wissenschaft und Politik (Research Institute for International Affairs) in Ebenhausen (Germany). This workshop is the first in a series designed to illuminate major issues in ocean law and policy which require attention on the national, regional, and global levels. This book provides a useful basis for the consideration and further discussion of those interested in the sea and the environment, helping academics and policy-makers alike not only ascertain but also understand objectives and concerns underlying the states of the region and the reaction of other states and the international community as a whole.

Available in PDF, EPUB and Kindle. Book excerpt: The maritime land and river boundary disputes between the adjacent South American countries of Suriname and Guyana existed long before the two nations gained independence from colonialism. Both countries claim sovereignty over three regions: the Courantyne River which separates them; the New River Triangle, which lies at the southern edge of the adjacent countries; and part of the Caribbean Sea, which extends north from their coastlines. The issue was of little importance until the discovery of important natural resources in the contested regions: gold deposits were found in the New River Triangle and offshore petroleum opportunities arose on the continental shelf. When both nations realized that timely resolution was economically crucial, they renewed efforts to achieve a comprehensive bilateral demarcation. However, a mutually agreeable settlement has proved far more elusive than anticipated. In Intervention Border and Maritime Issues in CARICOM, the contributors address this ongoing boundary dispute as well other maritime disputes between Barbados and Trinidad and Tobago and Guatemala and Belize. The background of the disputes are discussed in the context of international law as well as CARICOM s intervention and non-intervention. The major conflicts have tested the goodwill and ability of member states and CARICOM to find common ground at the leadership level. At a time when the Community is grappling with the erosion of preferential agreements as well as competition for aid from countries in the east of an expanded Europe, striking a harmonious balance with the self-interests of individual states in order to resolve conflict is of supreme importance.Recommendations for the resolution of conflict are offered, including a strengthening of Community mechanisms so as to avoid inciting external interference and intervention in any form. The assertion of individual interests however, will continue to test the flexibility and resourcefulness of CARICOM in absorbing and accommodating these interests. CARICOM must find a way between an inter-governmental approach and a supranational approach that best represents the interests of all of its members.

Available in PDF, EPUB and Kindle. Book excerpt: Since 1815, Denmark and Britain have lived in peace with each other. From the last half of the 19th century, massive British imports of Danish agricultural products gave Britain a central role in the Danish economy, likewise in the 20th century, British efforts in the two world wars became of crucial importance to Denmark's position in relation to Germany and, later, the Soviet Union. In the same period, the emergence of English as the first foreign language in Denmark facilitated the increasingly closer human and cultural contacts between the two countries. Britain and Denmark, written by Danish and British historians, constitutes the first attempt to provide a comprehensive picture of the roles that these two neighbouring countries have played in the lives of each other during the last two centuries. They are different in size and have had very different global and regional orientations. So, naturally, Britain has always loomed larger in Danish life and politics than the other way round. In many areas, however, relations have been close. The book covers contacts relating to trade, security policies and social and political theory, but also touch on mutual influences within the areas of literature, music, design etc. Most treatments of Danish political and cultural relations with the outside world in this period concentrate on Germany for the period up to 1945, and on the Soviet Union and the USA in the post-war world. In the same way, works on British contemporary history rarely devote much space to relations with the Nordic countries. The aim, therefore, of this book is to provide a supplement, and perhaps corrective, to the existing literature on the international positions of Britain and Denmark in the modern world.

Book excerpt: The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.
