Book excerpt: Esta monografía gira en torno a las consecuencias jurídicas de los delitos sobre la ordenación del territorio y el urbanismo regulado en el artículo 319.3 CP, después de la última reforma operada mediante Ley Orgánica 1/2015, de 30 de marzo, por la que se modifica la Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal, como es la condena de demolición de la obra ilegalmente construida, la reposición a su estado originario de la realidad física alterada, y el decomiso de las ganancias provenientes del delito urbanístico cualesquiera que sean las transformaciones. En este trabajo se hace un estudio en profundidad del bien jurídico protegido, del principio de intervención mínima o última ratio y la responsabilidad civil ante la demolición. Asimismo, también se aborda de manera minuciosa la ejecución de las sentencias por la comisión de los delitos urbanísticos contenidos en los apartados primero y segundo del artículo 319 CP, la inactividad de la administración, y los plazos para la ejecución de la demolición dictada por sentencia firme en la jurisdicción penal o en el procedimiento de restauración de la legalidad urbanística. Como novedad se hace un análisis jurídico sobre la institución de la figura de la declaración de Asimilado a Fuera de Ordenación (AFO), después de la aprobación por el gobierno andaluz del Decreto Ley 3/2019, de 24 de septiembre, de medidas urgentes para la adecuación ambiental y territorial de las edificaciones irregulares en la Comunidad Autónoma de Andalucía, donde esta normativa viene a regular el tratamiento de las edificaciones irregulares sobre las que ya no cabe adoptar legalmente medidas de restablecimiento del orden jurídico perturbado y de ejercicio de la potestad de protección de la legalidad urbanística por haber trascurrido los plazos establecidos. Y finalmente se realiza un estudio minucioso de todo el iter cronológico judicial en lo referente al periplo que rodea la construcción del colosal hotel “El Algarrobico”. Por ello, en base al contenido científico, a la jurisprudencia estudiada y plasmada en este trabajo, así como a la prolija bibliografía referenciada, este estudio es un instrumento idóneo para aquellas personas que operan cada día en la aplicación e interpretación de los tipos delictivos cometidos sobre la ordenación del territorio y el urbanismo.

Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. Credit Nation presents a new vision of American economic history, one where credit markets and liquidity were prioritized from the outset, where property rights and slaves became commodities for creditors' claims, and where legal institutions played a critical role in the Stamp Act crisis and other political episodes of the founding period.
