Während die digitale Demokratie Möglichkeiten direktdemokratischer Partizipation eröffnet, macht diese zugleich den repräsentativen Charakter des heutigen Politikers überflüssig, da eine analoge Repräsentation in einer rein digitalen Gesellschaft nicht mehr von Nöten wäre. Dieses Dilemma war schon Helmut Krauch in den 1970er Jahren vertraut, Pionier in der Computerdemokratie und Mitbegründer des Organisierten Konflikts (ORAKEL). Im 21. Jahrhundert ist das Thema der Digitalisierung und Wettbewerbsfähigkeit aktueller denn je, und so ist es das Ziel dieses Werkes ein positives Momentum aufzuzeigen, wie man computerdemokratische Modelle als sinnvolle partizipatorische Mittel nutzen kann und der Politik Mut zu machen, sich verstärkt in die digitale Welt vorzutrauen. Es liegen enorme Chancen für die Politik darin, wie ich zeigen möchte, und die Politik sollte diese Nutzen, denn bereits heute nutzen verschiedene Interessenträger das Internet, um den Bürger zu beeinflussen, mitunter zu desinformieren. Diesem negativen Effekt kann man nicht durch Zensur entgegentreten; schon gar nicht durch die Fortführung einer analogen Politik. Auch die Politik muss sich digitalisieren, um den Bürger wieder ernsthaft ansprechen zu können.

Trotzdem ist Öffentlichkeit ein konstitutives Element der Demokratie: Sie ist Raum des Diskurses, der Wahrheitssuche, der Kommunikation und der Orientierung. Doch genau wie Öffentlichkeit, ist auch Demokratie, als Herrschaftsform, ein Begriff der unterschiedlichen Verständnisse und Definitionen unterliegt. Das jeweilige Verständnis von Demokratie bestimmt stark die jeweilige Funktion und Anforderung an Öffentlichkeit.

This book addresses the complex issue of questionable content removals and account suspensions on social media platforms in the European Union, solving the existing legal ambiguity with a powerful roadmap designed to guide decision-makers in navigating online access rights and moderation issues. The roadmap’s elements are deduced from a technology-neutral comparative case law study of four Member States (Denmark, Germany, Italy, and the Netherlands) based on rigorous selection criteria that highlight the most salient distinctions that characterise legal approaches to social media access and moderation. The ‘layers’ of the roadmap focus on such central issues as the following: the legal basis for social media platforms to impose restrictions; platform operators’ right to shape access, including limitations to the platform’s right to exclude users; the validity and enforceability of terms of service; and users’ and platforms’ remedies for breaches of the terms of service, including the procedural obligations in the Digital Services Act. Unlike previous work on the topic, this book does not focus on one field of law but touches upon and combines European law, constitutional and fundamental rights law, competition law, equality law, property law, and contract law, all reflected on and assessed through both a European and a national lens. By addressing these multifaceted legal aspects, it offers a holistic approach to resolving content moderation challenges and demonstrates which problems are most effectively addressed by which fields of law. The book’s roadmap can be used within the European Union to address and/or resolve any access and moderation problems on social media platforms. It will serve as a valuable resource for judges, social media platforms, and dispute resolution bodies, providing practical insights and guidance in navigating this complex landscape and streamlining decision-making processes. Despite conditions traditionally considered inhospitable to economic growth—including acute interpersonal distrust, pervasive personal insecurity, and rampant violence—business in La Salada is booming under an established order completely detached from the state. Matías Dewey dives deep into the world of La Salada to examine how market exchanges function outside the law and how agreements and norms develop in the economy for counterfeit clothing. At the same time, this approach shows new ways, as perspectives of philosophy, political science, law, economics, sociology, cultural studies and others are here no longer regarded separately. Instead, integrated perspectives on the key issues are carved out: Perspectives on conditions of transformation to sustainability, on key instruments and the normative questions. This allows for a concise answer to urgent and controversial questions such as the following: Is the EU an environmental pioneer? Is it possible to achieve sustainability by purely technical means? If not: will that mean to end of the growth society? How to deal with the follow-up problems? How will societal change be successful?
