Book excerpt: La regulación jurídico-penal del acoso familiar y no familiar se establece con la LO 1/2015, de 30 de marzo, que lo tipifica como delito en el art. 172 ter CP, también conocido como acecho o stalking, dentro de los delitos contra la libertad y con una técnica restrictiva al establecer las formas de acoso de un modo tasado; y aunque es un delito común, se estableció en el marco de la violencia de género para proteger especialmente a la mujer. El nuevo delito que viene a colmar la ausencia de un tipo penal específico para combatir las conductas de acoso persecutorio, ofrece respuesta jurídico-penal a conductas de indudable gravedad que, en muchas ocasiones, no podían ser calificadas como coacciones o amenazas. Conductas reiteradas por medio de las cuales se menoscaba gravemente la libertad, la dignidad y el sentimiento de seguridad de la víctima a la que se somete a persecuciones, seguimientos o vigilancias constantes, u otros actos continuos de hostigamiento alterando sensible y significativamente su devenir vital cotidiano. Resulta de especial relevancia para el enjuiciamiento de los casos de acoso escolar el párrafo 1o del art. 173.1 CP que tipifica el delito de trato degradante, redactado de conformidad con lo dispuesto en la LO 15/2003, de 29 de septiembre, pues los Tribunales han acudido a él en la mayoría de los casos. El acoso escolar, denominado también bullying, actualmente constituye una de las mayores amenazas en los centros escolares, y se concreta a aquellas conductas de maltrato entre escolares llevadas a cabo de forma reiterada y continuada en el tiempo con la intención de causar un mal a la víctima en posición asimétrica respecto del acosador, a través de agresiones físicas, verbales y sociales, que atentan contra la dignidad del menor. El espacio donde se desarrolla el acoso escolar normalmente es el centro educativo (bullying), pero el uso de las nuevas tecnologías de la información y la comunicación por los menores ha llevado a que la víctima pueda sentirse acosada también fuera del centro (ciberbullying). La regulación jurídico-penal del mobbing o acoso laboral se establece con la LO 5/2010, de 22 de junio, que lo tipifica como delito en el párrafo 2o del art. 173.1 CP. La denominación sincrética del mobbing como acoso laboral en el ámbito privado y acoso institucional o funcionarial en el ámbito público, comprende tanto el acoso psicológico laboral como el acoso moral laboral, por no ser excluyentes estos términos y sí complementarios, aunque más amplio el segundo; lo que va a determinar que la delimitación o fijación del concepto jurídico de mobbing o acoso laboral ha de tener en consideración esta postura intermedia o ecléctica en el sentido de que el mismo es acoso psicológico. La fijación de un concepto jurídico de mobbing o acoso laboral se impone por la simple necesidad de determinar la tutela jurídica que se le va a dispensar; y colmando esta imperiosa necesidad conceptualizamos el mismo como, "una conducta activa u omisiva repetida y degradante, realizada durante un tiempo por el acosador o acosadores en el lugar de trabajo donde se desarrolla la relación laboral o de servicio, con la finalidad de que se abandone aquél, que pone en peligro o lesiona la integridad moral y otros derechos fundamentales del acosado o acosados según su gravedad, pudiendo también producir un resultado dañoso personal y material, además de moral".
