Book excerpt: A scrupulously researched investigation of the mysterious massacre of Hopi Indians at Awat'ovi, and the event's echo through American history. The Hopi community of Awat’ovi existed peacefully on Arizona’s Antelope Mesa for generations until one bleak morning in the fall of 1700—raiders from nearby Hopi villages descended on Awat’ovi, slaughtering their neighboring men, women, and children. While little of the pueblo itself remains, five centuries of history lie beneath the low rises of sandstone masonry, and theories about the events of that night are as persistent as the desert winds. The easternmost town on Antelope Mesa, Awat’ovi was renowned for its martial strength, and had been the gateway to the entire Hopi landscape for centuries. Why did kinsmen target it for destruction? Drawing on oral traditions, archival accounts, and extensive archaeological research, James Brooks unravels the story and its significance. Mesa of Sorrows follows the pattern of an archaeological expedition, uncovering layer after layer of evidence and theories. Brooks questions their reliability and shows how interpretations were shaped by academic, religious and tribal politics. Piecing together three centuries of investigation, he offers insight into why some were spared—women, mostly, and taken captive—and others sacrificed. He weighs theories that the attack was in retribution for Awat’ovi having welcomed Franciscan missionaries or for the residents’ practice of sorcery, and argues that a perfect storm of internal and external crises revitalized an ancient cycle of ritual bloodshed and purification. A haunting account of a shocking massacre, Mesa of Sorrows is a probing exploration of how societies confront painful histories, and why communal violence still plagues us today.

Book excerpt: The 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention) has a special standing in international law and international politics. For 60 years, the crime of genocide has been recognised as the most horrendous crime in international law, famously designated the 'crime of crimes'. On the occasion of the 60th anniversary of its adoption the UN High Commissioner for Human Rights stated that 'genocide is the ultimate form of discrimination'. In the same context the chief prosecutor of the International Criminal Court described the Genocide Convention as a 'visionary and founding text for the Court'. The Convention has as such influenced the subsequent development of many different areas of international law. For example, the 1951 Advisory Opinion on the Genocide Convention enabled the International Court of Justice to shape the modern regime of reservations to treaties. More recently, the prohibition against genocide has become a crucial pillar of the regime of international criminal law developing since the 1990s, with genocide being one of the core crimes falling under the jurisdiction of the UN ad hoc tribunals, the Extraordinary Chambers in the Courts of Cambodia and the permanent International Criminal Court. In this work the 19 provisions of the Convention are analysed article-by-article, with abundant references to state practice and case law.

Available in PDF, EPUB and Kindle. Book excerpt: Building on Book Five’s considerations of the person and redemptive deed of Christ, Book Six of Matthias Joseph Scheeben’s Handbook of Catholic Dogmatics offers his account of the subjective realization of salvation through Christ’s bestowal of grace. This stands as Scheeben’s fullest treatment of the much-contested notion of actual grace and the issues related to the sixteenth-century de auxiliis controversy concerning predestination and how God moves the human will. Progressing in three parts, Book Six commences with an analysis of the concept of actual grace, establishing how God can move the will without compelling it and providing a richly developed context for understanding God’s motive influence. The second part examines three principal heresies concerning grace—namely, Pelagianism, Semi-Pelagianism, and the Reformation doctrines—using these as a basis for evaluating the Catholic dogmas about grace that were articulated against them. Finally, in the third part Scheeben explores the necessity of grace in light of man’s fallen condition and his supernatural end.

Available in PDF, EPUB and Kindle. Book excerpt: Illegality in Marine Insurance Law is the first book to deal specifically with illegality in the context of marine insurance law. Previously, this issue has only ever been partially covered within analysis and criticism of Section 41 of the Marine Insurance Act 1906 and warranties. However, Dr Wang Feng goes much further than this by considering its impact on the common law relevant to marine insurance in many jurisdictions worldwide. The book addresses whether the existing law represents an accurate codification of the former authorities and whether Section 41 truly reflects existing legal principles. As well as this, the book examines how correctly to approach illegality within the context of marine insurance, considering the fundamental changes to the rule of breach of warranty introduced by the Insurance Act 2015. Of interest to academic researchers and practitioners in common law and civil law jurisdictions, this book provides rigorous analysis of the illegality issue and a conceptual approach for various approaches to reform marine insurance law. It is a unique and comprehensive guide to illegality in marine insurance law.

It covers all varieties of maritime fraud, from the most serious downwards, describing the methods employed and the risks to traders and carriers. At the serious end of the spectrum, pirates capture an entire ship, often murdering the entire crew, in order to sell the cargo (to which of course they have no title), later to use the “innocent” ship to pose as innocent traders. Less serious (but perhaps of greater interest to lawyers) are misdescriptions of cargo in, or backdating of, bills of lading, and other deceptions, usually practised on purchasers and banks.

Book excerpt: The twenty-first century is characterized by the global circulation of cultures, norms, representations, discourses, and human rights claims; the arising conflicts require innovative understandings of decision making. Deliberative Acts develops a new, cogent theory of performative deliberation. Rather than conceiving deliberation within the familiar frameworks of persuasion, identification, or procedural democracy, it privileges speech acts and bodily enactments that constitute deliberation itself, reorienting deliberative theory toward the initiating moment of recognition, a moment in which interlocutors are positioned in relationship to each other and so may begin to construct a new lifeworld. By approaching human rights not as norms or laws, but as deliberative acts, Lyon conceives rights as relationships among people and as ongoing political and historical projects developing communal norms through global and cross-cultural interactions.
