Book Synopsis Mergers, Merger Control, and Remedies by : John Kwoka
Download or read book Mergers, Merger Control, and Remedies written by John Kwoka and published by MIT Press. This book was released on 2015 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: A comprehensive analysis of merger outcomes based on all empirical studies, with an assessment of the effectiveness of antitrust policy toward mergers. In recent decades, antitrust investigations and cases targeting mergers—including those involving Google, Ticketmaster, and much of the domestic airline industry—have reshaped industries and changed business practices profoundly. And yet there has been a relative dearth of detailed evaluations of the effects of mergers and the effectiveness of merger policy. In this book, John Kwoka, a noted authority on industrial organization, examines all reliable empirical studies of the effect of specific mergers and develops entirely new information about the policies and remedies of antitrust agencies regarding these mergers. Combined with data on outcomes, this policy information enables analysis of, and creates new insights into, mergers, merger policies, and the effectiveness of remedies in preventing anticompetitive outcomes. After an overview of mergers, merger policy, and a common approach to merger analysis, Kwoka offers a detailed analysis of the studied mergers, relevant policies, and chosen remedies. Kwoka finds, first and foremost, that most of the studied mergers resulted in competitive harm, usually in the form of higher product prices but also with respect to various non-price outcomes. Other important findings include the fact that joint ventures and code sharing arrangements do not result in such harm and that policies intended to remedy mergers—especially conduct remedies—are not generally effective in restraining price increases. The book's uniquely comprehensive analysis advances our understanding of merger decisions and policies, suggests policy improvements for competition agencies and remedies, and points the way to future research.

Book Synopsis European Commission Decisions on Competition by : Francesco Russo
Download or read book European Commission Decisions on Competition written by Francesco Russo and published by Cambridge University Press. This book was released on 2010-07-08 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: European Commission Decisions on Competition provides a comprehensive economic classification and analysis of all European Commission decisions adopted pursuant to Articles 101, 102 and 106 of the FEU Treaty from 1962 to 2009. It also includes a sample of landmark European merger cases. The decisions are organised according to the principal economic theory applied in the case. For each economic category, the seminal Commission decision that became a reference point for that type of anticompetitive behaviour is described. For this, a fixed template format is used throughout the book. All subsequent decisions in which the same economic principle was applied are listed chronologically. It complements the most widely used textbooks in industrial organisation, competition economics and competition law, to which detailed references are offered. The book contains source material for teachers and students, scholars of competition law and economics, as well as practising competition lawyers and officials.
Book Synopsis Merger Decisions and the Rules of Procedure of the European Community Courts by : George Cumming
Download or read book Merger Decisions and the Rules of Procedure of the European Community Courts written by George Cumming and published by Kluwer Law International B.V.. This book was released on 2011-11-22 with total page 464 pages. Available in PDF, EPUB and Kindle. Book excerpt: Article 340 TFEU, which provides a method of compensation for victims of the Commission’s errors, is invoked as the basis for actions against Commission decisions under the Merger Control Regulation. Accordingly, the rules of procedure of the Community Courts come into play. This probing analysis asks the important questions: What limits can be imposed on the discretion of the Community Courts acting within their own rules of procedure? Is the manner in which the Court of Justice interprets those rules sufficient? Focusing on the crucial Court responsibilities of investigating facts and assessing economic damage in relation to the type of non-contractual liability apparent in antitrust cases, the author convincingly demonstrates that the scope for ‘case management’ by the Courts is strictly limited, and may engender information or evidentiary deficits that contravene ECHR Art 6.1 as well as the principles of effective judicial protection and rectitude of decision. A claim for compensation pursuant to Art 340 TFEU may be struck merely because the basic elements of the cause of action cannot be established to a minimal level.
Book Synopsis Uk Energy Experience, The: A Model A Warning? - Proceedings Of The British Institute Of Energy Economics Conference by : G Mackerron
Download or read book Uk Energy Experience, The: A Model A Warning? - Proceedings Of The British Institute Of Energy Economics Conference written by G Mackerron and published by World Scientific. This book was released on 1996-03-30 with total page 531 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UK energy system has experienced radical reform in past decade — privatisation, liberalisation, re-structuring and re-regulation for gas/electricity supply and coal, plus rapid technological change and flexible fiscal policy in offshore oil/gas. Many countries are seeking to travel similar paths, though more slowly (eg USA, EU, Eastern Europe, Latin America, Pacific Rim) and are following UK experience. The conference brings together academics, business economists and consultants to give the first major evaluation from an economics pespective of the extent to which the UK experience has been successful, and how far it might be reproduced elsewhere.
