Book Synopsis Common European Legal Thinking by : Hermann-Josef Blanke
Download or read book Common European Legal Thinking written by Hermann-Josef Blanke and published by Springer. This book was released on 2015-09-24 with total page 620 pages. Available in PDF, EPUB and Kindle. Book excerpt: Common European Legal Thinking emanates from the existence of a shared European legal culture as especially reflected in the existence of a common European constitutional law. It denotes a body of individual constitutional principles – written and unwritten – that represent the common heritage of the constitutions of the Member States. Taking into account the two major European organisations, the Council of Europe and especially the European Union, the essays of this Festschrift discuss a range of constitutional principles, including the rule of law, democracy, and the exercise of political power in a multilevel system which recognises fundamental rights as directly applicable and supreme law. Other essays examine the value of pluralism, the commitment of private organisations to uphold public values, principles or rules, and the objectives and methods of a transnational science of administrative law. These articles highlight the fact that the Ius Publicum Europaeum Commune is “politically” in the making, which can often be seen in the shape of general legal principles. The publication recognises the role of Albrecht Weber as a forerunner of Common European Legal Thinking.

Book Synopsis Constructing Europe's Identity by : Lars-Erik Cederman
Download or read book Constructing Europe's Identity written by Lars-Erik Cederman and published by Lynne Rienner Publishers. This book was released on 2001 with total page 288 pages. Available in PDF, EPUB and Kindle. Book excerpt: The authors assess not only the benefits, but also the costs of attempts to assert a European identity. Referring to debates about the respective merits of deepening and widening, they address the equally important associated tradeoffs between exclusion and dilution: they point to the risks on the one hand of a Europe that excludes foreign goods, immigrants and entire countries, and on the other of an unfocused definition of Europe that may dilute the very values that a "European identity" is intended to protect.

Book Synopsis The Question of Competence in the European Union by : Loïc Azoulai
Download or read book The Question of Competence in the European Union written by Loïc Azoulai and published by OUP Oxford. This book was released on 2014-02-20 with total page 1417 pages. Available in PDF, EPUB and Kindle. Book excerpt: The classic debate surrounding the prolific role of the European Union in defining spheres of competence and power relationships has long divided scholarly opinion. However, in recent years, the long-standing acquiescence to the broad powers of the Union has given way to the emerging perception of a competence problem in Europe. For a long period it was taken for granted that the European Community could act whenever its action was justified on the basis of the widely interpreted objectives of the Treaties. However this context has since changed. There is a widespread perception of a competence problem in Europe and the overabundance of provisions limiting the Union's competences is one of the most obvious marks left by the Lisbon Treaty. This book discusses the extent to which the parameters of power throughout the Union and its Member States have been recast by the recent implementation of the Lisbon Treaty and doctrines developed by the European Court of Justice. Comprised of contributions from a vast array of leading practitioners and academics in the field of EU Law, this volume assesses the debate surrounding the political identity of the European Union, and further illustrates the relevance of the Federal theory of sharing competences for the development of EU Law. Finally, the question of new potential limits to Union's competence is addressed. If anything, this broad reflection on the notion of competence in the EU law context is a way of opening up the question of the nature and contours of the political identity of the European Union.

Book Synopsis Culture and Paradiplomatic Identity by : Ioan Horga
Download or read book Culture and Paradiplomatic Identity written by Ioan Horga and published by Cambridge Scholars Publishing. This book was released on 2016-02-22 with total page 335 pages. Available in PDF, EPUB and Kindle. Book excerpt: The beginning of the millennium has been influenced by a visible acceleration of the globalisation process. A complex and dynamic phenomenon, it has generated a series of consequences at the political, strategic and military levels, as well as the cultural level. The increase of interdependence between actors on the international stage, modern technologies, means of communication, cross-border relations, and the constant flux of goods, capital, services and people entail major changes for the tools used by states in international relations. In this context, states are obligated to identify solutions to overcome risks and threats posed to peace and security, as current regional conflicts can easily become international. In order to streamline communication and interstate cooperation, beyond the classic appeal to tolerance, there has been, in recent years, an exponential increase of the use of culture and, by extension, cultural diplomacy. Thus, cultural cooperation represents a vital part of the current process of transformation and transition. Adopting an interdisciplinary character, this volume investigates some of the aspects that emphasise the essential role of culture, as a promoter and supporter of peace and security, as an agent of regional and national development, as well as its contributions to attracting and retaining human and financial capital, regional branding, and improving quality of life, among others. The volume will particularly appeal to professors and students of political science, international relations, history, economy, law, and sociology, as well as intellectuals interested in the catalysing role of culture in all areas of activity.
Download or read book Europe in Crisis written by Mark Hewitson and published by Berghahn Books. This book was released on 2012 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: The period between 1917 and 1957, starting with the birth of the USSR and the American intervention in the First World War and ending with the Treaty of Rome, is of the utmost importance for contextualizing and understanding the intellectual origins of the European Community. During this time of 'crisis,' many contemporaries, especially intellectuals, felt they faced a momentous decision which could bring about a radically different future. The understanding of what Europe was and what it should be was questioned in a profound way, forcing Europeans to react. The idea of a specifically European unity finally became, at least for some, a feasible project, not only to avoid another war but to avoid the destruction of the idea of European unity. This volume reassesses the relationship between ideas of Europe and the European project and reconsiders the impact of long and short-term political transformations on assumptions about the continent's scope, nature, role and significance.

Book Synopsis Constitutional Review in Europe by : Maartje De Visser
Download or read book Constitutional Review in Europe written by Maartje De Visser and published by Bloomsbury Publishing. This book was released on 2013-11-22 with total page 528 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutions serve to delineate state powers and enshrine basic rights. Such matters are hardly uncontroversial, but perhaps even more controversial are the questions of who (should) uphold(s) the Constitution and how constitutional review is organised. These two questions are the subject of this book by Maartje de Visser, which offers a comprehensive, comparative analysis of how 11 representative European countries answer these questions, as well as a critical appraisal of the EU legal order in light of these national experiences. Where possible, the book endeavours to identify Europe's common and diverse constitutional traditions of constitutional review. The raison d'être, jurisdiction and composition of constitutional courts are explored and so too are core features of the constitutional adjudicatory process. Yet, this book also deliberately draws attention to the role of non-judicial actors in upholding the Constitution, as well as the complex interplay amongst constitutional courts and other actors at the national and European level. The Member States featured are: Belgium, the Czech Republic, Finland, France, Germany, Italy, Hungary, the Netherlands, Spain, Poland, and the United Kingdom. This book is intended for practitioners, academics and students with an interest in (European) constitutional law.
Book Synopsis Hague "Congress of Europe" (1948-2008) by : Jean-Michel Guieu
Download or read book Hague "Congress of Europe" (1948-2008) written by Jean-Michel Guieu and published by Peter Lang. This book was released on 2009 with total page 434 pages. Available in PDF, EPUB and Kindle.
