Available in PDF, EPUB and Kindle. Book excerpt: The question these articles seek to respond to, in this fifth collection by Jean Gaudemet to be published by Variorum, is how the intellectual elite of the medieval Church perceived the institutions among which they lived - how they portrayed them, and how they sought to influence them. Whether dealing with the papacy and its place in the Church and the world, with the role of the people in government, or with the position of the individual in society, he would argue that this is the essential question. In their response, this elite drew on the Bible and custom, on Roman law and papal letters, in order that the law could encompass all human experience. To achieve this, these jurists needed to create categories and work out principles, hence the recourse to theology and the necessity for a logical structure, a ’systematization’.

Available in PDF, EPUB and Kindle. Book excerpt: A groundbreaking account of Napoleon Bonaparte, Pope Pius VII, and the kidnapping that would forever divide church and state In the wake of the French Revolution, Napoleon Bonaparte, First Consul of France, and Pope Pius VII shared a common goal: to reconcile the church with the state. But while they were able to work together initially, formalizing an agreement in 1801, relations between them rapidly deteriorated. In 1809, Napoleon ordered the Pope’s arrest. Ambrogio Caiani provides a pioneering account of the tempestuous relationship between the emperor and his most unyielding opponent. Drawing on original findings in the Vatican and other European archives, Caiani uncovers the nature of Catholic resistance against Napoleon’s empire; charts Napoleon’s approach to Papal power; and reveals how the Emperor attempted to subjugate the church to his vision of modernity. Gripping and vivid, this book shows the struggle for supremacy between two great individuals—and sheds new light on the conflict that would shape relations between the Catholic church and the modern state for centuries to come.

Available in PDF, EPUB and Kindle. Book excerpt: Rich in detail and broad in scope, this majestic book is the first to reveal the interaction of politics and religion in France during the crucial years of the long seventeenth century. Joseph Bergin begins with the Wars of Religion, which proved to be longer and more violent in France than elsewhere in Europe and left a legacy of unresolved tensions between church and state with serious repercussions for each. He then draws together a series of unresolved problems--both practical and ideological--that challenged French leaders thereafter, arriving at an original and comprehensive view of the close interrelations between the political and spiritual spheres of the time. The author considers the powerful religious dimension of French royal power even in the seventeenth century, the shift from reluctant toleration of a Protestant minority to increasing aversion, conflicts over the independence of the Catholic church and the power of the pope over secular rulers, and a wealth of other interconnected topics.

Available in PDF, EPUB and Kindle. Book excerpt: This book’s essays seek to cleanse comparative law of some of the epistemic detritus it has been collecting and that has been cluttering its theory and practice to the point where this flotsam has effectively stultified ‘good’ comparison. While a critique would pursue adjustments to the prevailing model, this text’s negative critique seeks a much more radical refurbishment as it utters an emphatic ‘no’ to the governing epistemology: it pursues, in effect, a deposition and a disposition of the leading epistemic configuration and the various assumptions regarding the acquisition of knowledge about foreign law that inform it. Negative comparative law thus operates at a primordial level inasmuch as it concerns the matter of justice: it aims to do justice to foreign law as foreignness finds itself appropriated and travestied by comparatists for ideological purposes. In the process, negative critique purports significantly to enhance comparative law’s institutional, intellectual, and ethical respectability. This book will benefit all law teachers and postgraduate law students interested in the workings of law on the international scene, whether specialists in comparative law, public international law, private international law, transnational law, or foreign relations law – in particular, individuals bringing to bear a critical inclination to their subject-matter.

Book excerpt: Étienne Pasquier (1529–1615) was a lawyer, royal official, man of letters, and historian. He represented the University of Paris in its 1565 suit to dislodge a Jesuit school from Paris. Despite royal support, the Jesuits remained in conflict with many institutions, which in 1595 led to their expulsion from much of the realm. With ever-increasing polemics, Pasquier continued to oppose the Jesuits. To further his aims, he published a dialog between a Jesuit (almost certainly Louis Richeome) and a lawyer (Pasquier himself). He called it the Jesuits’ Catechism (1602). Pasquier’s work did not stop the French king from welcoming the Jesuits back. However, Pasquier’s Catechism remained central to Jansenist and other anti-Jesuit agitation up to the Society’s 1773 suppression and beyond.
