Book Synopsis Islamic Law and Civil Code by : Richard A. Debs
Download or read book Islamic Law and Civil Code written by Richard A. Debs and published by Columbia University Press. This book was released on 2010 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Richard A. Debs analyzes the classical Islamic law of property based on the Shari'ah, traces its historic development in Egypt, and describes its integration as a source of law within the modern format of a civil code. He focuses specifically on Egypt, a country in the Islamic world that drew upon its society's own vigorous legal system as it formed its modern laws. He also touches on issues that are common to all such societies that have adopted, either by choice or by necessity, Western legal systems. Egypt's unique synthesis of Western and traditional elements is the outcome of an effort to respond to national goals and requirements. Its traditional law, the Shari'ah, is the fundamental law of all Islamic societies, and Debs's analysis of Egypt's experience demonstrates how Islamic jurisprudence can be sophisticated, coherent, rational, and effective, developed over centuries to serve the needs of societies that flourished under the rule of law.

Book Synopsis Property, Social Structure, and Law in the Modern Middle East by : Ann E. Mayer
Download or read book Property, Social Structure, and Law in the Modern Middle East written by Ann E. Mayer and published by State University of New York Press. This book was released on 1985-09-01 with total page 294 pages. Available in PDF, EPUB and Kindle. Book excerpt: For too long the study of law and society in the modern Middle East has been left to specialists in narrow subcategories of law or the social sciences. Property, Social Structure, and Law in the Modern Middle East lays the groundwork for a new field of scholarship in which analysis of the social dimensions of law and the legal dimensions of social structure are integrated. It offers the stimulus of a variety of new models of scholarship by a distinguished international group of contributors whose work shares a common focus on regimes of property in the societies of the modern Middle East. The case studies examine the regulations of many kinds of property in relation to the social structures of selected Middle Eastern communities form the eighteenth century to the present. Most of the societies studied are subjected to pressures for rapid modernization and adjustment to major economic transformations. The book features comparisons of property rights and relations under regimes of Islamic and customary law as well as modern statutory law. Highlighted are new patterns of intervention by modern Middle Eastern states to alter traditional regimes of property and to transform the accompanying social structures. Their implications for development are also considered. The book's notes and bibliographies constitute a valuable resource for anyone interested in further research.

Book Synopsis Sex, Law, and Sovereignty in French Algeria, 1830–1930 by : Judith Surkis
Download or read book Sex, Law, and Sovereignty in French Algeria, 1830–1930 written by Judith Surkis and published by Cornell University Press. This book was released on 2019-12-15 with total page 354 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a masterful study of the ways in which sex and law were inextricably intertwined in the elaboration of French rule in Algeria. Its great virtue is to demonstrate in careful detail, with an impressive range of material (from court records to novels), exactly how the conquest of Algeria repeatedly challenged the very ideals of the secular universalism in whose name colonization was carried out.― Joan Wallach Scott, author of Sex and Secularism During more than a century of colonial rule over Algeria, the French state shaped and reshaped the meaning and practice of Muslim law by regulating it and circumscribing it to the domain of family law, while applying the French Civil Code to appropriate the property of Algerians. In Sex, Law, and Sovereignty in French Algeria, 1830–1930, Judith Surkis traces how colonial authorities constructed Muslim legal difference and used it to deny Algerian Muslims full citizenship. In disconnecting Muslim law from property rights, French officials increasingly attached it to the bodies, beliefs, and personhood. Surkis argues that powerful affective attachments to the intimate life of the family and fantasies about Algerian women and the sexual prerogatives of Muslim men, supposedly codified in the practices of polygamy and child marriage, shaped French theories and regulatory practices of Muslim law in fundamental and lasting ways. Women's legal status in particular came to represent the dense relationship between sex and sovereignty in the colony. This book also highlights the ways in which Algerians interacted with and responded to colonial law. Ultimately, this sweeping legal genealogy of French Algeria elucidates how "the Muslim question" in France became—and remains—a question of sex.
