Con esta finalidad, el estudio se ocupa de los poco afortunados intentos de crear una personalidad electrónica para robots, poniendo de relieve lo que de mero recurso de utilidad tiene esta solución, y proponiendo un examen de la subjetividad de la Inteligencia artificial desligado de la conciencia, la libertad y la voluntad, como cualidades exclusivamente humanas. Esta subjetividad pasa por entender al ente robótico como dotado de inteligencia y de la consiguiente capacidad de acción, pero sin que ésta pueda producir sus efectos a favor de dicho ente, sino sólo en favor del utilizador del sistema robótico: el modelo del esclavo en Roma es paradigmático. Esta misma base sirve asimismo para perfilar la gestión de la responsabilidad por daños causados por el sistema robótico, especialmente los derivados de decisiones autónomas tomadas por el propio sistema. Aquí el modelo de la responsabilidad por el producto defectuoso no basta, y hay que buscar soluciones en ámbitos, como el de la responsabilidad en la circulación de vehículos. Por último, el estudio se ocupa de una novedad que preocupa sobremanera a los científicos en la materia, como es la ética de la IA. En este ámbito se llega a unas conclusiones peculiares, centradas en que la actuación robótica nunca puede ser «moral» en el sentido humano del término, por la anterior carencia de conciencia del sistema de IA. La consecuencia, inesperada, es que la ética robótica no es sino un sistema de control y unas directrices heurísticas para la solución de problemas. El autor, Miguel L. Lacruz Mantecón (Zaragoza, 1960), es Profesor titular de Derecho civil en la Facultad de Derecho de la Universidad de Zaragoza. Especializado en Propiedad intelectual, donde lleva a cabo sus primeras publicaciones (Las obligaciones del editor en el contrato de edición literaria, Reus, 2000), es miembro de la Asociacion de autoralistas ASEDA, y secretario de redacción de la Revista General de Legislación y Jurisprudencia. Asimismo ha publicado obras en materia de Derechos reales, así en tema de posesión (La normativa posesoria de liquidación y su generalización, Dykinson, 2005) y en bienes abandonados (La ocupación imposible, Dykinson, 2011, y Los bienes mostrencos en Aragón, El Justicia de Aragón, 2012). Otra de sus líneas de investigación es el arbitraje, participando en los Comentarios breves a la Ley de arbitraje (Coord. Díaz-Bastien, Reus, 2007), y publicando La impugnación del arbitraje también en Reus, 2011. Extiende su estudio al contrato de seguro en Formación del contrato de seguro, Reus, 2014, y participa en las obras Contratos: civiles, mercantiles, públicos, laborales e internacionales, de Yzquierdo, Aranzadi, 2014, y Tratado de Derecho Civil, de Rams, Iustel, 2014. Incide asimismo en Derecho de familia con la obra Convivencia de padres e hijos mayores de edad, Reus, 2016. Recientemente ha dedicado su tiempo al estudio de la Inteligencia Artificial, publicando algunos trabajos en revistas jurídicas.
