The Commissioner's underlying objective in imposing a monetary penalty notice is to promote compliance with the Act. It is clear from the wording of the sections 55A & 55B of the Act that a monetary penalty notice will only be appropriate in the most serious situations. Therefore in such cases the monetary penalty must be sufficiently meaningful to act both as a sanction and a deterrent. This doesn't change the Commissioner's commitment to provide guidance simplifying the Act where possible and making it easier for organisations to comply with their obligations under the Act. This is the statutory guidance issued under the Act and as such has been approved the Secretary of State and laid before Parliament
