Denn: Europa rückt zusammen. Immer öfter bekommt der Bürger den langen Arm Brüssels zu spüren. Bestes Beispiel: Die Einführung der einheitlichen Währung, des Euros. Rund 80 Prozent aller auf den Binnenmarkt bezogenen Entscheidungen sind einigen Schätzungen nach mittlerweile in EU bzw. EG-Recht übergegangen. Ein weiteres Exempel sind die Urteile des Europäischen Gerichtshofes: Sie sind für die Mitgliedsstaaten bindend und müssen national umgesetzt werden. Ein prominentes Beispiel etwa die Entscheidung zur Gleichstellung von Frauen und Männern beim Zugang zum Dienst in den Streitkräften. In einer Pressemitteilung des EUGH vom 7. Januar 2000 heißt es dazu wörtlich: „Die deutschen Rechtsvorschriften, die Frauen vollständig vom Dienst mit der Waffe ausschließen, verstoßen gegen den gemeinschaftsrechtlichen Grundsatz der Gleichheit von Männern und Frauen.“ (EU Homepage 2002) Europäisches Recht bricht nationales Recht, die Bundesrepublik Deutschland musste sich der europäischen Rechtsprechung fügen. In den Mitgliedstaaten steht das Parlament als ein Repräsentationsorgan des Volkes im Mittelpunkt des Legitimationsprozesses von Regierungsgewalt. Es läge also eigentlich nah, dem Europäischen Parlament als einzigem, unmittelbar durch Wahlen vom europäischen Volk direkt legitimierten Organ diese Rolle auf europäischer Ebene zu unterstellen. Anscheinend nicht, denn nicht nur in der politikwissenschaftlichen Fachliteratur wird zumindest mit Fragezeichen versehen über das sogenannte „Demokratiedefizit der Europäischen Union“ diskutiert (vgl. z.B. Pfetsch 1997, Lord 1998 oder Schmidt 2000). Doch auch in den Medien und nicht zuletzt im Hinblick auf die aktuelle Verfassungsdebatte wird dieses Thema immer wieder kontrovers diskutiert. Die Legitimation einer zunehmenden Anhäufung von Rechtsetzungsbefugnissen zu Gunsten der EU, (und damit gleichzeitig zu Lasten der nationalen Parlamenten), ist gemessen an den, in den Mitgliedstaaten üblichen demokratiepolitischen Standards, also zumindest streitbar. In dieser Hausarbeit werde ich mich daher mit folgenden Fragen beschäftigen: Gibt es ein Demokratiedefizit in der Europäischen Union? Und in diesem Zusammenhang: Welches Legitimationspotential bietet das Europäische Parlament?
