Book excerpt: In this book, legal and mental health experts analyze controversial new legal strategies adopted over the past decade to prevent sexual violence. The contributors examine innovative measures, including sexual predator laws used to commit dangerous sex offenders to mental hospitals after they have served their sentences, sex offender registration and notification laws, chemical castration of convicted sex offenders, intensive supervision programs for sex offenders living in the community, and programs for treating sexually abused children. Contributors also explore the serious constitutional questions these new legal strategies raise regarding the rights of sex offenders who have been fully punished. They also consider how much these laws cost and whether they actually prevent sexual violence. Experts discuss what we know and do not know about sex offenders: are they dangerous, who are their victims, and can they be treated. Psychologists and other mental health experts working with sexually dangerous offenders as well as lawyers, policymakers, and students in these fields may find this a useful book. Civil commitment, as it relates to sex offenders, is when a state retains custody of an individual, found by a judge or jury to be a "sexually dangerous person" by involuntarily committing the person to a secure mental health facility after the offender's prison sentence is done. In 1990, the state of Washington passed the first civil commitment law for sexually dangerous persons. Currently, 18 other states and the federal government have similar laws. Moreover, the Supreme Court, in Kansas v. Hendricks and Kansas v. Crane, ruled that current civil commitment laws are constitutional. The civil commitment of sex offenders centres on the belief that sex offenders are more likely than other offenders to re-offend. However, data on sex offender recidivism is varied. Data show that the recidivism risk for sex offenders may be lower than it is typically thought to be; in fact, some studies show that sex offenders recidivate at a lower rate than many other criminals. Other studies show that, given time, almost all sex offenders will commit a new sex crime. Most discussions about recidivism examine ways to decrease it; for example, by providing sex offenders with treatment. Research on the efficacy of sex offender treatment is promising, but it cannot prove that treatment reduces recidivism.

Book excerpt: This highly controversial new book considers how the dangerous offender has become such a figure of collective anxiety for the citizens of rationalised Western societies. The authors consider: * ideas of danger and social threat in historical perspective * legal responses to violent criminals * attempts to predict dangerous behaviour * why particular groups, such as women, remain at risk from violent crime. This inspired collection invites us to rethink the received wisdom on dangerous offenders, and will be of interest to students and scholars in the fields of criminology and the sociology of Risk.

Available in PDF, EPUB and Kindle. Book excerpt: Most crimes of sexual violence are committed by people known to the victim—acquaintances and family members. Yet politicians and the media overemphasize predatory strangers when legislating against and reporting on sexual violence. In this book, Eric S. Janus goes far beyond sensational headlines to expose the reality of the laws designed to prevent sexual crimes. He shows that "sexual predator" laws, which have intense public and political support, are counterproductive.Janus contends that aggressive measures such as civil commitment and Megan's law, which are designed to restrain sex offenders before they can commit another crime, are bad policy and do little to actually reduce sexual violence. Further, these new laws make use of approaches such as preventive detention and actuarial profiling that violate important principles of liberty.Janus argues that to prevent sexual violence, policymakers must address the deep-seated societal problems that allow it to flourish. In addition to criminal sanctions, he endorses the specific efforts of some advocates, organizations, and social scientists to stop sexual violence by, for example, taking steps to change the attitudes and behaviors of school-age children and adolescents, improving public education, and promoting community treatment and supervision of previous offenders.Janus also warns that the principles underlying the predator laws may be the early harbingers of a "preventive state" in which the government casts wide nets of surveillance and intervenes to curtail liberty before crimes of any type occur. More than a critique of the status quo, this book discusses serious alternatives and how best to overcome the political obstacles to achieving rational policy.

Book excerpt: The anthology The Hidden World of the Sex Offender: Readings on Sex Crimes and the Criminal Justice System gives readers insight into the hidden world of the sex offender. This carefully curated selection of readings examines deviant sexual behaviors from historical and geographical perspectives, and discusses how some of them were not only permitted, but encouraged in certain societies and eras. Students learn about types of sex offenders and differences between nuisance sex offenders and dangerous sex criminals. Specific chapters are devoted to the characteristics of offenders, aberrant forms of sexual behavior, paraphilias, pedophilia, child pornography, and cyber-predators, and sex trafficking. Most notable is the text's attention to the often overlooked topics of female sex offenders and the forms, extent, victimology, and future of male prostitution. The Hidden World of the Sex Offender asks students to thoughtfully consider issues such as the role of fantasy in aberrant forms of behavior, and how both ritualism and symbolism play integral parts in sexual practice. The anthology can be used in courses in sex crimes and sexual deviancy, and those devoted to how the criminal justice system deal with them. Stephen Holmes, who earned his Ph.D. in criminal justice at the University of Cincinnati, is an associate professor at the University of Central Florida. He has numerous book chapters, books, and articles to his name. Dr. Holmes's most recent book is Violence in the United States. Ronald Holmes is an emeritus professor in the Department of Justice Administration at the University of Louisville, and a world-renowned author and expert on serial murder, sex crimes, and criminal profiling. He received his doctorate from Indiana University and has completed more than five hundred psychological profiles for police departments across the United States.

Available in PDF, EPUB and Kindle. Book excerpt: The 1990s witnessed a flurry of legislative initiatives—most notably, “Megan’s Law”—designed to control a population of sex offenders (child abusers) widely reviled as sick, evil, and incurable. In Sex Offenders, Stigma, and Social Control, Diana Rickard provides the reader with an in-depth view of six such men, exploring how they manage to cope with their highly stigmatized role as social outcasts. The six men discussed in the book are typical convicted sex offenders—neither serial pedophiles nor individuals convicted of the type of brutal act that looms large in public perceptions about sex crimes. Sex Offenders, Stigma, and Social Control explores how these individuals, who have been cast as social pariahs, construct their sense of self. How does being labeled in this way and controlled by measures such as Megan’s Law affect one’s identity and sense of social being? Unlike traditional criminological and psychological studies of this population, this book frames their experiences in concepts of both deviance and identity, asking how men so highly stigmatized cope with the most extreme form of social marginality. Placing their stories within the context of the current culture of mass incarceration and zero-tolerance, Rickard provides a deeper understanding of the complex relationship between public policy and lived experience, as well as an understanding of the social challenges faced by this population, whose re-integration into society is far from simple or assured. Sex Offenders, Stigma, and Social Control makes a significant contribution to our understanding of sex offenders, offering a unique window into how individuals make meaning out of their experiences and present a viable—not monstrous—social self to themselves and others.

Available in PDF, EPUB and Kindle. Book excerpt: It has been over ten years since the release of the first edition. Over this time span, the dilemmas for the sexual offender - including their visceral and virtual manifestations - have captured the imagination of the public, have rewritten the subdiscipline of behavioral sciences and the law, and have led to new technologies in the assessment, diagnostic, and treatment decision sciences. These dilemmas circulate in the marketplace of conspicuous digital consumerism that stylizes and commercializes the sex offender industry through society’s ubiquitous infotainment-driven and carnival-like outlets. This second edition will act as the antidote to the voyeurism that addictively feeds on the dramatizations that caricature the victims, assailants, and predicaments that constitute the dilemmas for the sexual offender. The authors systematically probe and dissect the boundaries of their topic with erudition and insight. This acumen consists of psychiatric, legal, moral, and bio-social realms of inquiry and analysis. Old questions about the nature of evil, women in society, violence and mental illness, and treatment and recovery receive fresh attention based on the latest empirical evidence. New chapters address emergent forms of deviant sexuality (e.g., cyber-offending, erotic and sadistic psychopathy, and child-molesting clergy). New sections illuminate existing forms of aberrant sexuality (e.g., moral development and necrophilia, moral reasoning and sex offenders, and the psychodynamics of serialized lust murder). This state-of-the-art text, replete with cutting-edge case illustrations, demonstrates how medicine, law, and culture are inextricably (and sometimes inexplicably) bound together. It will serve as an outstanding resource for psychiatrists, lawyers, criminologists, policy analysts, and forensic mental health professionals as the authors expertly reveal the world of sexual offenders.
