Available in PDF, EPUB and Kindle. Book excerpt: Strategic litigation against public participation (SLAPP) involves lawsuits brought by individuals, corporations, groups, or politicians to curtail political activism and expression. An increasingly large part of the political landscape in Canada, they are often launched against those protesting, boycotting, or participating in some form of political activism. A common feature of SLAPPs is that their intention is rarely to win the case or secure a remedy; rather, the suit is brought to create a chill on political expression. Blocking Public Participation examines the different types of litigation and causes of action that frequently form the basis of SLAPPs, and how these lawsuits transform political disputes into legal cases, thereby blocking political engagement. The resource imbalance between plaintiffs and defendants allows plaintiffs to tie up defendants in complex and costly legal processes. The book also examines the dangers SLAPPs pose to political expression and to the quality and integrity of our democratic political institutions. Finally, the book examines the need to regulate SLAPPs in Canada and assesses various regulatory proposals. In Canada, considerable attention has been paid to the “legalization of politics” and the impact on the Charter in diverting political activism into the judicial arena. SLAPPs, however, are an under-studied element of this process, and in their obstruction of political engagement through recourse to the courts they have profound implications for democratic practice.

Download or read book Entryways to Criminal Justice written by George Pavlich and published by University of Alberta. This book was released on 2019-02-15 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: How do societies decide whom to criminalize? What does it mean to accuse someone of being an offender? Entryways to Criminal Justice analyzes the thresholds that distinguish law-abiding individuals from those who may be criminalized. Contributors to the volume adopt social, historical, cultural, and political perspectives to explore the accusatory process that place persons in contact with the law. Emphasizing the gateways to criminal justice, truth-telling, and overcriminalization, the authors provide important insights into often overlooked practices that admit persons to criminal justice. It is essential reading for scholars, students, and policy makers in the fields of socio-legal studies, sociology, criminology, law and society, and post/colonial studies. Contributors: Dale A. Ballucci, Martin A. French, Aaron Henry, Bryan R. Hogeveen, Dawn Moore, George Pavlich, Marcus A. Sibley, Rashmee Singh, Amy Swiffen, Matthew P. Unger, Elise Wohlbold, Andrew Woolford

Book excerpt: More than 1,200 sawmills produce the bulk of U.S. and Canadian softwood lumber. The maps and tables in this report show the location and size of these mills by State and Province. Analysis of timber inventories in relation to use shows a close correspondence between pricing and use intensity. In some Southern States, the intensity of use is approaching recent growth levels, but the adoption of more intensive management coupled with maturing of large areas of newly established forests should increase supply over the next two decades.

Download or read book Labour Law in an Era of Globalization written by Joanne Conaghan and published by . This book was released on 2004 with total page 580 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout the industrial world, the discipline of labor law has fallen into deep philosophical and policy crisis, at the same time as new theoretical approaches make it a field of considerable intellectual ferment. Modern labor law evolved in a symbiotic relationship with a postwar institutional and policy agenda, the social, economic and political underpinnings of which have gradually eroded in the context of accelerating international economic integration and wage-competition. These essays--which are the product of a transnational comparative dialog among academics and practitioners in labor law and related legal fields, including social security, immigration, trade, and development--identify, analyze, and respond to some of the conceptual and policy challenges posed by globalization.
