O Estatuto da Criança e do Adolescente completou 32 anos! Neste último aniversário da Lei infantojuvenil, a principal mudança implementada decorre de um sonoro grito de meninos e meninas contra as violências perpetradas contra eles no seio de seus lares. Essa alteração se deu pela edição da Lei n. 14.344, de 24/5/ 2022 (Lei Henry Borel), que criou mecanismos para prevenir e enfrentar a violência doméstica e familiar contra crianças e adolescentes. A lei é examinada pelos autores a partir da nova redação dos arts. 18-B, 70-A, 70-B, 136, 201 e 226 do Estatuto, que municiou o Conselho Tutelar e o Ministério Público com instrumentos mais eficazes para coibir a prática nefasta da violência intrafamiliar contra os pequenos. Em 2022, o Estatuto experimentou, ainda, as novidades carreadas pela Lei n. 14.340, de 18 de maio de 2022, que, embora tenha sido promulgada com o fito de alterar a Lei da Alienação Parental (Lei n. 12.318/2010), estabeleceu procedimentos adicionais para a medida de suspensão do poder familiar, inserindo os §§ 3o e 4o ao art. 157 do ECA. Além dessas importantes alterações legislativas promovidas na Lei infantojuvenil, há comentários às novas regras de registros públicos trazidas pela Lei n. 14.382, de 27/6/2022, especialmente por ter desjudicializado averbações registrais relevantes, como a alteração dos prenomes e sobrenomes. Também é objeto de exame a Lei n. 14.443, de 2/9/2022, que alterou a Lei do Planejamento Familiar (Lei n. 9.263/96) e determinou prazo para oferecimento de métodos e técnicas contraceptivas, diminuiu a idade mínima para a esterilização voluntária, permitiu que o procedimento seja realizado logo após o parto, passou a não exigir idade mínima de quem já possui ao menos dois filhos vivos e excluiu a necessidade de consentimento expresso de ambos os cônjuges para a esterilização. Na esfera infralegal, destaca-se a Resolução n. 470, de 31 de agosto de 2022, do Conselho Nacional de Justiça (CNJ), que instituiu a Política Judiciária Nacional para a Primeira Infância, para assegurar, com absoluta prioridade, os direitos fundamentais de crianças de 0 a 6 anos no âmbito do Poder Judiciário, em consideração à relevância dos primeiros anos de vida no desenvolvimento infantil e do ser humano. Os autores esperam que a nova edição do Curso de direito da criança e do adolescente qualifique ainda mais os operadores dos direitos infantojuvenis, gerando multiplicadores de defensores de nossas crianças.
