Book excerpt: Although Foucault’s work has been employed and embraced enthusiastically by some ‘mobilities’ scholars, discussion across these two traditions to date has mostly been partial and unsystematic. Yet Foucault’s work can make critical contributions, for example, to thinking about governing mobilities in contemporary societies, while conversely mobilities research opens up new perspectives on Foucault. In combination these bodies of work can illuminate issues as diverse as: the greater interdependencies between mobility systems (e.g. transport, tourism, trade, internet use); the proliferation of the undesired mobilities of viruses, of natural phenomena like fire, of (what is taken to be) criminality and other seemingly inevitable by-products of globalisation; the perceived threats to desirable forms of mobility as constituted by climate change, peak oil and energy security, and terrorism and warfare; and the increased popularity of logics of governance premised on choice, responsibilisation and the (re)coding of phenomena in economic terms under neo-liberalism. Against this background, this book brings together the first major collection of contributions from across the social sciences with a shared interest in both mobilities and Foucauldian thinking. To give added lustre to this landmark in its history, the Institute accepted the invitation from the International Society of Criminology to organise the 49th International Course of Criminology. The title of the course was: Changes in Society, Crime and Criminal Justice in Europe. A challenge for criminological education and research'. This course explored two themes, both of which are likely to be the focus of debate in criminal policy in the near future: crime and insecurity in the city, and international organised and corporate crime. The presentation and discussion of both themes followed two main approaches. Lectures and seminars focused on the analysis of the nature, the quantity and the development of the phenomena, and meetings were focused on the policy needed to gain control of these phenomena. Moreover, attention was paid to technical and ethical problems which show up at the moment that empirical research is carried out. This publication brings together the main part of the introductory lectures. Part one relates to the theme of crime and insecurity in the city; the second part contains the lectures on international organised and corporate crime. Together both parts present a good picture of what was explained and commented on during the Course, especially in relation to important European developments concerning crime, criminal justice and criminal policy. This book will become an important source of inspiration for both criminological educationand research.

Book excerpt: This is the first book to offer an extensive cosmopolitan, cross-cultural insight into the perennial controversy over the use of improperly obtained evidence in criminal trials. It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely. Longlisted for the Inner Temple Book Prize 2022.
