Available in PDF, EPUB and Kindle. Book excerpt: Volume 2 of this two-volume companion study into the administration, experience, impact and representation of summary justice in Scotland explores the role of police courts in moulding cultural ideas, social behaviours and urban environments in the nineteenth century. Whereas Volume 1, subtitled Magistrates, Media and the Masses, analysed the establishment, development and practice of police courts, Volume 2, subtitled Boundaries, Behaviours and Bodies, examines, through themed case studies, how these civic and judicial institutions shaped conceptual, spatial, temporal and commercial boundaries by regulating every-day activities, pastimes and cultures. As with Volume 1, Boundaries, Behaviours and Bodies is attentive to the relationship between magistrates, the police, the media and the wider community, but here the main focus of analysis is on the role and impact of the police courts, through their practice, on cultural ideas, social behaviours and environments in the nineteenth-century city. By intertwining social, cultural, institutional and criminological analyses, this volume examines police courts’ external impact through the matters they treated, considering how concepts such as childhood and juvenile behaviour, violence and its victims, poverty, migration, health and disease, and the regulation of leisure and trade, were assessed and ultimately affected by judicial practice.

Book excerpt: Disputes, discord and reconciliation were fundamental parts of the fabric of communal living in early modern Europe. This edited volume presents essays on the cultural codes of conflict and its resolution in this period under three broad themes: peacemaking as practice; the nature of mediation and arbitration; and the role of criminal law in conflicts. Through an exploration of conflict and peacemaking, this volume provides innovative accounts of state formation, community and religion in the early modern period.

Available in PDF, EPUB and Kindle. Book excerpt: Taking the form of two companion volumes, Police Courts in Nineteenth-Century Scotland represents the first major investigation into the administration, experience, impact and representation of summary justice in Scottish towns, c.1800 to 1892. Each volume explores diverse, but complementary, themes relating to judicial practices, relationships, experiences and discourses through the lens of the same subject matter: the police court. Volume 1, with the subtitle Magistrates, Media and the Masses, provides an institutional, social and cultural history of the establishment, development and practice of police courts. It explores their rise, purpose and internal workings, and how justice was administered and experienced by those who attended them in a variety of roles. Special attention is given to examining how courtroom discourse was represented in print culture, the role of the media in providing a discursive commentary on summary justice, and the ways in which magistrates and the police engaged in a law and order dialogue with the press. Throughout, consideration is given to uncovering the relationship between magistrates, the courts, the police and the wider community, and to charting the implications of the rise of summary justice and the ’police-man’ state for the urban masses (as evidenced through prosecution, conviction and punishment patterns). Volume 2, with the subtitle Boundaries, Behaviours and Bodies, explores, through themed case studies, how police courts shaped conceptual, spatial, temporal and commercial boundaries by regulating every-day activities, pastimes and cultures.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the potential for imagining a politics without violence and evidence that this need not be a utopian project. The book demonstrates that in theory and in practice, we now have the intellectual and scientific knowledge to make this possible. In addition, new sensibilities towards violence have generated social action on violence, turning this knowledge into practical impact. Scientifically, the first step is to recognize that only through interdisciplinary conversations can we fully realize this knowledge. Conversations between natural sciences, social sciences and the humanities, impossible in the twentieth century, are today possible and essential for understanding the phenomenon of violence, its multiple expressions and the factors that reproduce it. We can distinguish aggression from violence, the biological from the social body. In an echo of the rational Enlightenment of the eighteenth century, this book calls for an emotional Enlightenment in the twenty first and a post Weberian understanding of politics and the State.

Available in PDF, EPUB and Kindle. Book excerpt: This work explores the quantitative and qualitative development of homicide in eastern Finland in the second half of the eighteenth century and the early years of the nineteenth. The area studied comprised northern Savo and northern Karelia in eastern Finland. At that time, these were completely agricultural regions on the periphery of the kingdom of Sweden. Indeed the majority of the population still got their living from burn-beating agriculture. The analysis of homicide there reveals characteristics that were exceptional by Western European standards: the large proportion of premeditated homicides (murders) and those within the family is more reminiscent of modern cities in the West than of a pre-modern rural society. However, there also existed some archaic forms of Western crime there. Most of the homicides within the family were killings of brothers or brothers-in law, connected with the family structure (the extended family) that prevailed in the region. This study uses case analysis to explore the causes for the increase in both familial homicide and murder in the area. One of the explanatory factors that is dealt with is the interaction between the faltering penal practice that then existed and the increase in certain types of homicide. Despite the fact that it focuses on a particular region, the study and the questions it poses have both international and current relevance. This work builds a bridge between research into legal history and the sociologically oriented study of the history of criminality.
