Book excerpt: Framework Decision 2009/948/JHA on the prevention and settlement of conflicts of exercise of jurisdiction in criminal proceedings established an ad hoc procedure for settling conflicts of criminal jurisdiction based on the mutual exchange of information and the establishment of direct consultations between the competent authorities with a view to reaching consensus on an effective solution. However, neither common legally binding criteria for deciding the best jurisdiction nor specific rules for the transfer of proceedings (which can occur after parallel proceedings have been identified) were established in this instrument, or in any other instrument adopted by the EU to date. This book analyses the current EU legal framework on conflicts of jurisdiction and transfer of criminal proceedings, paying special attention to its numerous shortcomings and loopholes from a fundamental rights and due process of law perspective. The book begins with an assessment of the various principles and grounds used by Member States for claiming criminal jurisdiction. Secondly, de lege lata EU procedure on the settlement of conflicts of criminal jurisdiction, as well as its implementation in Spain and Italy, are thoroughly examined. After discussing the main principles and fundamental rights at stake, the author proposes two alternative and original de lege ferenda models for the prevention and settlement of conflicts of criminal jurisdiction and transfer of criminal proceedings, exploring the different possibilities offered by the EU’s primary law.

Available in PDF, EPUB and Kindle. Book excerpt: "PTCJ shines on empirical detail and an illuminating account of how policy transfer works in criminal justice. ...highly recommended for readers interested in understanding the current state of criminal justice policy." Political Studies Review "A very interesting book and excellent at setting the context of criminal justice policies in the UK. Thoroughly researched and written in an engaging style." Tina Eadie, Senior Lecturer, De Montfort University Since the late 1980s, it seems that policy-makers and politicians in the UK have increasingly looked West across the Atlantic for inspiration in the field of crime control. More broadly, recent years have seen a growing focus upon the extent to which, and ways in which, policy ideas and practices travel within and across national boundaries. Scholars from a number of disciplines have become increasingly interested in the concepts of ‘policy transfer’ and related ideas. This book contains the first major empirical study of policy transfer in the field of criminal justice and crime control. It focuses upon policy transfer from the USA to the UK, and undertakes a detailed examination of the processes of policy change in three key areas that have been widely perceived as imports from the USA: the privatization of corrections, ‘two’ and ‘three strikes’ sentencing, and ‘zero tolerance’ policing. Drawing upon a wealth of documentary evidence and interviews with leading politicians, policy makers and other key players in policy developments, the authors explore the complex processes involved in policy transfer and analyse the nature and degree of US influence in these areas.

Available in PDF, EPUB and Kindle. Book excerpt: Since the 1960s, recurring cycles of political activism over youth crime have motivated efforts to remove adolescents from the juvenile court. Periodic surges of crime—youth violence in the 1970s, the spread of gangs in the 1980s, and more recently, epidemic gun violence and drug-related crime—have spurred laws and policies aimed at narrowing the reach of the juvenile court. Despite declining juvenile crime rates, every state in the country has increased the number of youths tried and punished as adults. Research in this area has not kept pace with these legislative developments. There has never been a detailed, sociolegal analytic book devoted to this topic. In this important collection, researchers discuss policy, substantive procedural and empirical dimensions of waivers, and where the boundaries of the courts lie. Part 1 provides an overview of the origins and development of law and contemporary policy on the jurisdiction of adolescents. Part 2 examines the effects of jurisdictional shifts. Part 3 offers valuable insight into the developmental and psychological aspects of current and future reforms. Contributors: Donna Bishop, Richard Bonnie, M. A.
