Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Counter Negligence: A Treatise on the Law of Contributory Negligence or Negligence as a Defense About two years ago Messrs. Baker, Voorhis 00. Asked me to prepare a new edition of Beach on Contributory Negligence, of Which they owned the copyrights. I have been able to do the work only at irregular intervals, and hence it has been greatly delayed; but that has been 1n great measure compensated for by the opportunity it has afforded for examining the latest cases. Some of these easel: have introduced modifications of old principles, and/ ethers have applied old principles to new conditions. These changes and additions have been indicated in the text and notes. I think it Will be found that all im 'portant decisions upon the subject of contributory negligence Which have been reported since the last edition have been cited. Scarcely any modern textbook is more frequently referred to by the courts than Beach on Contributory Negligence; and Mr. Beach's statements of the law have been generally regarded as correct, and his discussion of disputed points acute and discrimi nating. I have, therefore, been careful to make only such changes as the growth of the law has rendered necesary.
