Available in PDF, EPUB and Kindle. Book excerpt: The implementation of the recommendations of the 3rd Summit of Heads of State and Government of the Council of Europe (Warsaw, May 2005) resulted in the launch in 2006 of a number of European campaigns, in particular "Building a Europe for and with children"; the "Campaign to combat trafficking in human beings"; "All different, All equal"; "Stop domestic violence against women"; and the 'Dosta!" awareness-raising campaign to end prejudice against the Roma. Kosovo was a major political concern for the Council of Europe. Through its Venice Commission, it provided expert input for the preparation of the future status of the region and continued to provide expert advice on the implementation of European standards in such fields as the protection of human rights, minority rights, decentralisation, cultural heritage protection and constitutional law. The Republic of Montenegro applied for membership of the Council of Europe following the 21 May referendum, which paved the way for its independence. Serbia, on the other hand, succeeded the former State Union of Serbia and Montenegro as a member state of the Organisation. The Council of Europe was the first organisation to look into the allegations of secret detentions and unlawful transfers of suspected terrorists in the member states. The Parliamentary Assembly and the Secretary General each carried out investigations which revealed that Council of Europe member states have not set up effective legal safeguards against such practices, which violate the European Convention on Human Rights.

This book was released on 2012-10-02 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book studies the human rights monitoring mechanisms of the Council of Europe. It provides an in-depth examination of six such mechanisms: the Commissioner for Human Rights, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (the CPT), the European Committee of Social Rights (the ECSR), the Advisory Committee on the Framework Convention for the Protection of National Minorities (the ACFC), the European Commission against Racism and Intolerance (ECRI) and the Committee of Experts of the European Charter for Regional or Minority Languages (the CECL). The human rights monitoring mechanisms of the Council of Europe seek to establish a permanent dialogue with governments to encourage them to better implement human rights treaties. They function principally through the use of national reports, on which basis they make recommendations, and may also visit or question states directly. The book looks at each mechanism in turn, discussing their composition, functions and working methods, as well as their relationship with other actors. It includes both a general discussion of the role of European human rights monitoring mechanisms as well as a comparative analysis of these mechanisms. The book aims to provide a clear understanding of the underlying approach of European human rights monitoring mechanisms and the challenges faced by them in terms of effectiveness. It will be useful for practitioners and students alike, especially those following courses in human rights or related fields.

It is addressed to practitioners, diplomats and decision makers at national level to deepen their understanding of the aims and functioning of Council of Europe monitoring mechanisms. Available in PDF, EPUB and Kindle. Book excerpt: In recent years European prison law and policy have emerged as a force to be reckoned with. This book explores its development and analyses the penological and human rights foundations on which it is based. It examines the findings of the European Committee for the Prevention of Torture, the recommendations of the Council of Europe, and the judgments of the European Court of Human Rights. From these sources it makes the general principles that underlie European prison law and policy explicit, emphasising the principle of using imprisonment as a last resort and the recognition of prisoners' rights. The book then moves on to apply these principles to conditions of imprisonment, regimes in prison, contacts between prisoners and the outside world, and the maintenance of good order in prisons. The final chapter of the book considers how European prison law and policy could best be advanced in future. The authors argue that the European Court of Human Rights should adopt a more proactive approach to ensuring that imprisonment is used only as a last resort, and that a more radical interpretation of the existing provisions of the European Convention on Human Rights will allow it to do so. It concludes that the growing cooperation on prison matters within Europe bodes well for the increased recognition of prisoners' rights across Europe. In spite of some countervailing voices, Europe should increasingly be able to give an international lead in a human rights approach to prison law and policy in the same way it has done with the abolition of the death penalty.

Book excerpt: This publication details the activities of the Council of Europe during 2005, including the work of the Committee of Ministers, the Parliamentary Assembly, the Congress of Local and Regional Authorities, the European Court of Human Rights and the Commissioner for Human Rights. The highlight of the year was the third Summit of Heads of State and Government, held in Warsaw in May 2005, and four main themes emerged from the summit: to further promote common fundamental values (human rights, the rule of law and democracy); to make Europe a safer place by eradicating torture and inhuman and degrading treatment; to eliminate all forms of discrimination thus creating a more inclusive Europe; and to foster co-operation with other international and European organisations and institutions.

Available in PDF, EPUB and Kindle. Book excerpt: This volume takes a look at the status quo of whistleblowing in several jurisdictions from around the world. Covering a topic that draws the attention of a broad public and is gaining importance amongst legislators, practitioners and scholars all over the globe, the book examines the various aspects of whistleblowing. It looks at what kind of legal protection of whistleblowers is in force, who is protected, what kind of behaviour is protected, and what kind of behaviour whistleblowers are protected against. This is achieved by a combination of a general comparative report with country-specific reports that give information on whistleblowing in various jurisdictions. These countries include, amongst others, Canada, Germany, France, Italy, the Netherlands and the USA. A synopsis comprises information on whistleblowing in 23 countries in one tabula. The chapters of this book were originally prepared for the XIXth International Congress of Comparative Law (20th and 21st sup="" July 2014) of International Academy of Comparative Law in Vienna.

Book excerpt: In the context of the enlargements of 2004 and 2007 the European Union needed a concept for the future relationship with its new neighbours. The result was the development of the European Neighbourhood Policy (ENP). In return for sharing European values and effectively implementing political, economic and institutional reforms, the EU offers economic incentives and closer ties to its eastern and southern neighbours. The ambitious objective of promoting stability, security and prosperity beyond its own borders raises questions about the Union's intentions, means and likely success. This volume analyses the logic and institutional origins of the ENP and provides a critical assessment of the promises and prospects of the EU's broader neighbourhood policies. It does so both from an issue-oriented perspective (e.g. security, visa policy, trade, aid, human rights, good governance) and a regional standpoint: eastern Europe, the Mediterranean, the Western Balkans and Russia.

It also makes recommendations regarding General Approaches, delays in Ministerial correspondence with the Committee, the contents of Government Explanatory Memoranda, and Commission responses to Committee reports.

Book excerpt: This book deals with convergences of legal doctrine despite jurisdictional, cultural, and political barriers, and of divergences due to such barriers, examining topics that are of vital importance to contemporary legal scholars. Written by leading scholars from more than twenty countries, its thirty-two chapters present a comparative analysis of cutting-edge legal topics of the 21st century. While each of the countries covered stands alone as a sovereign state, in a technologically advanced world their disparate systems nonetheless show comparable strategies in dealing with complex legal issues. The book is a critical addition to the library of any scholar hoping to keep abreast of the major trends in contemporary law. It covers a vast area of topics that are dealt with from a comparative point of view and represents the current state of law in each area.
