Book excerpt: La legge 190/2012, cosiddetta “anticorruzione”, introduce nella pubblica amministrazione nuovi strumenti per combattere i fenomeni corruttivi, oltre a modificare in parte le norme del codice penale relative alla materia. Si tratta di una serie di innovazioni, alcune delle quali significative, come l’onere di redigere una pianificazione di azioni volte a scongiurare i rischi di corruzione, o la previsione della figura obbligatoria del responsabile della prevenzione della corruzione, che negli enti locali coincide col segretario comunale, salvo motivata decisione diversa. Al di là delle singole e specifiche misure di prevenzione, la norma ha un notevole impatto sull’organizzazione degli enti e, in una certa misura, anche sui rapporti di lavoro. Le misure anticorruzione prevedono, ad esempio, l’articolazione di sistemi di rotazione della dirigenza e del personale, nei servizi qualificati come a maggior rischio. Il che impone sistemi di gestione più sofisticati e complessi, oltre al necessario rilancio della formazione e dell’aggiornamento professionale. In più, occorrerà rivedere anche in buona parte gli strumenti operativi: la legge 190/2012 insiste particolarmente sul concetto della total disclosure, dell’amministrazione “aperta”, incidendo in modo significativo anche sulla legge 241/1990, allo scopo di rendere trasparente e conoscibile in ogni sua fase l’azione amministrativa. La norma, dunque, chiama gli enti ad una significativa e rilevante revisione dei propri strumenti di programmazione, gestione e controllo. Da questo punto di vista, la legge 190/2012 si salda col d.l. 174/2012, che come è noto ha inteso proprio rivitalizzare le forme di controllo negli enti locali, quali strumento di presidio non solo della corruzione, ma anche e soprattutto della buona amministrazione, esente il più possibile da vizi di legittimità e anche di merito, oltre che il più possibile orientata verso risultati utili per la collettività amministrata. Book excerpt: Da sempre, nello stato Italiano, il fenomeno della corruzione ha recitato un ruolo di spicco nel panorama sia pubblico che privato, innestandosi nelle farraginosità burocratiche e nelle lacune normative tipiche del nostro Paese. Attualmente, l'Italia è vista come uno stato ad alto grado di corruzione percepita sia da parte dei cittadini che da parte della imprese e degli analisti. A conferma di quanto detto, nella rilevazione del 2013 diTrasparency International, l'Italia ha registrato un indice di corruzione percepita pari a 43 (rispetto al valore di massima trasparenza di 100) che riflette l'impatto che i recenticasi di corruzione possono aver avuto sulla percezione nazionale ed internazionale del fenomeno. Il suddetto dato del 2013, anche se in lieve miglioramento rispetto a quello del 2012, non si discosta troppo dalle rilevazioni fatte nell'ultimo decennio, secondo le quali l'Italia, in tema di corruzione, si colloca su posizioni analoghe a quelle di numerosi paesi Asiatici o dell'America Latina. E' inoltre ampio il gap che ci separa da molti dei paesi membri dell'Unione Europea nelle classifiche internazionali, qualunque sia l'indicatore utilizzato. L'Italia si trova nelle posizioni più basse di queste classifiche, insieme a paesi come la Grecia, la Spagna ed il Portogallo; le posizioni medio-alte sono invece occupate dagli stati dell'Europa centrale come Germania, Austria, Francia, Paesi Bassi e Regno Unito; il vertice delle classifiche è infine occupato dagli stati del nord come Danimarca, Svezia e Finlandia. Nella Prima Parte della trattazione si analizzano gli aspetti rilevanti della recente normativa sulla prevenzione della corruzione nelle Pubbliche Amministrazioni. L'analisi è incentrata sulla Legge 190/2012 e sul D. Lgs. 33/2013 nonchè sulle disposizioni del Piano Nazionale Anticorruzione, sulla base delle quali si identificano gli impatti della normativa sulla strutturazione dei sistemi di Risk Management delle P.P.A.A.. Si procede, infine, ad un'analisi Piani triennali di prevenzione della corruzione.Nella seconda parte si procede ad un'attenta analisi della disciplina del diritto di accesso analizzando il suo ruolo in materia di trasparenza della Pubblica Amministrazione, i vari soggetti che ne hanno diritto e le modalità e le procedure. Infine si analizza il ruolo sempre più importante che ha assunto la disciplina in materia di pubblico impiego attraverso anche una disamina delle principale riforme legislative.
