It explores the attitudes of parents, teachers, and educational leaders about corporal punishment, in the context of existing government policies, laws, and regulations, using interviews, questionnaires and observation. Corporal punishment is widely and frequently used by both parents and teachers as a way of maintaining discipline, with most regarding it favourably as a means of behavioural modification. Furthermore, the book shows that the use of corporal punishment in Tanzania is influenced by cultural norms and religious beliefs, teacher qualifications and parents’ levels of education, past experiences of corporal punishment, and related beliefs about the practice. Crucially, there has not yet been a societal-level legal framework established to protect children from the harms involved.

The Committee and other international instruments have at different times and in different reports, recommended to Tanzania Mainland to take legal measures to prohibit all forms of corporal punishment id est, at family level, in school, judicial system and in alternative care settings. However Tanzania Mainland has passed the Law of the Child Act, 2009 which indirectly legalizes the administration of corporal punishment to children. As a result, administration of corporal punishment to children in families, schools, juvenile courts and alternative care settings remains lawful. Hence in this study, we have from a historical perspective attempted to show why Tanzania Mainland despite the call from various international instruments has retained the law on corporal punishment.

Book excerpt: Corporal punishment of children is widely accepted and often legally practised in many countries, reflecting a seeming contrast between the rights and status of adults and of children. More countries are now banning corporal punishment in schools, as advocated by the United Nations Committee on the Rights of the Child in its regular reviews of countries' compliance with the UN Convention on the Rights of the Child (1989), the most widely ratified human rights Convention. With difficulty, Tanzania is gradually moving towards the banning of corporal punishment of children in schools. This thesis explores the experiences of discipline and punishment in two urban primary schools in Oar es Salaam, Tanzania. Research methods include ethnographic observations, group sessions and interviews with children, teachers and parents. A critical review of social research methodologies reveals gaps in existing approaches and shows how dialectical critical realism can offer deeper understanding. The analysis aims to understand the ontology of pain, the morality of the corporal punishment of children in relation to human rights. The thesis analyses accounts of childhood and punishment, and the nature of changes and differences in reality that reside in the bodies in pain, in conjunction with reason-emotion and power. Particular concerns are: how critical realist ontology and epistemology can inform understanding of the body in pain; how children's and adults' experiences of pain are given different meanings; and how critical realism helps to justify the possibility of universal human rights intended to protect children from corporal punishment.

Each chapter starts with a short introduction, followed by an examination of a definition of corporal punishment, and shows the role of expert bodies who are monitoring the implementation and processes of standard-setting.
