Available in PDF, EPUB and Kindle. Book excerpt: In the summer of 2012, the Supreme Court of Canada issued rulings on five copyright cases in a single day. The cases represent a seismic shift in Canadian copyright law, with the Court providing an unequivocal affirmation that copyright exceptions such as fair dealing should be treated as users’ rights, while emphasizing the need for a technology neutral approach to copyright law. The Court’s decisions, which were quickly dubbed the “copyright pentalogy,” included no fees for song previews on services such as iTunes, no additional payment for music included in downloaded video games, and that copying materials for instructional purposes may qualify as fair dealing. The Canadian copyright community soon looked beyond the cases and their litigants and began to debate the larger implications of the decisions. Several issues quickly emerged. This book represents an effort by some of Canada’s leading copyright scholars to begin the process of examining the long-term implications of the copyright pentalogy. The diversity of contributors ensures an equally diverse view on these five cases, contributions are grouped into five parts. Part 1 features three chapters on the standard of review in the courts. Part 2 examines the fair dealing implications of the copyright pentalogy, with five chapters on the evolution of fair dealing and its likely interpretation in the years ahead. Part 3 contains two chapters on technological neutrality, which the Court established as a foundational principle of copyright law. The scope of copyright is assessed in Part 4 with two chapters that canvas the exclusive rights under the copyright and the establishment of new “right” associated with user-generated content. Part 5 features two chapters on copyright collective management and its future in the aftermath of the Court’s decisions. This volume represents the first comprehensive scholarly analysis of the five rulings. Edited by Professor Michael Geist, the Canada Research Chair in Internet and E-commerce Law at the University of Ottawa, the volume includes contributions from experts across Canada. This indispensable volume identifies the key aspects of the Court's decisions and considers the implications for the future of copyright law in Canada.

Set against the backdrop of Canada's development from a British colony into a middle power, this book reveals the deep roots of conflict in the international copyright system and argues that Canada's signing of the convention can be viewed in the context of a former British colony's efforts to find a place on the world stage. In this groundbreaking book, Sara Bannerman examines Canada's struggle for copyright sovereignty and explores some of the problems rooted in imperial and international copyright that affect Canadians to this day.

Book excerpt: Canada in the Frame explores a photographic collection held at the British Library that offers a unique view of late nineteenth-century and early twentieth-century Canada. The collection, which contains in excess of 4,500 images, taken between 1895 and 1923, covers a dynamic period in Canada’s national history and provides a variety of views of its landscapes, developing urban areas and peoples. Colonial Copyright Law was the driver by which these photographs were acquired; unmediated by curators, but rather by the eye of the photographer who created the image, they showcase a grass-roots view of Canada during its early history as a Confederation. Canada in the Frame describes this little-known collection and includes over 100 images from it. The author asks key questions about what it shows contemporary viewers of Canada and its photographic history, and about the peculiar view these photographs offer of a former part of the British Empire in a post-colonial age, viewed from the old ‘Heart of Empire’. Case studies are included on subjects such as urban centres, railroads and migration, which analyse the complex ways in which photographers approached their subjects, in the context of the relationship between Canada, the British Empire and photography.

Book excerpt: From Grokster to Google, copyright has emerged as one of the Internet's most challenging legal issues. Once limited to a select group of scholars, copyright now captures front page headlines as millions of Canadians consider its impact on education, technology, communication, and culture. As Canada embarks on a new round of digital copyright reform, this collection of 19 essays from Canada's leading copyright experts provides context and analysis of the latest reform proposals. Edited by Professor Michael Geist, an internationally regarded authority on Internet and technology law, the collection reviews international copyright norms, assesses dozens of specific Bill C-60 provisions, and identifies potential future copyright reform initiatives. Completed immediately after the introduction of Bill C-60, this timely volume provides policy makers, lawyers, judges, educators, and interested Canadians with the tools and knowledge they need to participate in a copyright debate that will shape the future of the Internet, culture, and education in Canada.

It contains contributions on consumer protection, contract law, liability, data protection, procedural law, insurance, health, intellectual property, arbitration, lethal autonomous weapons, tax law, employment law, ethics,?While specific topics of Belgian private and public law are thoroughly addressed, the book also provides a general overview of a number of regulatory and ethical AI evolutions and tendencies in the European Union. Therefore, it is a must-read for legal scholars, practitioners and government officials as well as for anyone with an interest in law and AI.

Available in PDF, EPUB and Kindle. Book excerpt: How should copyright exceptions be drafted? This is a question of ongoing concern in scholarly and law reform debates. In Drafting Copyright Exceptions, Emily Hudson assesses drafting options using insights from the standards and rules literature, and case studies from cultural institutions in Australia, Canada, the UK and the US. Drawing on thousands of hours of fieldwork conducted over fourteen years, the book describes how staff engage with and interpret the law. Whilst some practices are guided strongly by copyright doctrine, others are influenced by the factors such as ethical views, risk assessment, and prosaic matters related to collection management. This work should be read by anyone interested in a detailed account of interpretative practices related to the drafting of copyright exceptions, but it also speaks to broader debates about the relationship between the 'law in books' and the 'law in action'.
