Each article of the CRPD contains a methodical analysis of the preparatory works, followed by an exhaustive examination of the contents of each article based on case law and concluding observations from the CRPD Committee, judgments from national and international courts and tribunals, pertinent UN and other reports, the key literature on the article under review. The volume features commentary from a broad range of scholars across a variety of disciplines in order to provide a comprehensive study of the legal, psychological, education, sociological, and other aspects of the CPRD. This encyclopaedic commentary on the CRPD effectively covers all the issues arising from international disability law and practice, and will be an ideal resource for all working in the field.

Book excerpt: This book explores the journey of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) as it is interpreted and translated from International Human Rights Law into domestic law and policy in different cultural contexts. Beginning with reflections on ‘culture’, ‘disability’ and ‘human rights’ from different disciplinary perspectives, the work is then organised as ‘snapshots’ of the journey of the CRPD from the international level to the domestic; the process of ratification, the process of implementation, and then the process of monitoring the CRPD’s implementation in States Parties cultural contexts. Leading global contributors provide cutting-edge accounts of the interactions between the CRPD and diverse cultures, revealing variations in the way that the concept of ‘culture’ is defined. This collection will appeal to academics and students in Law and Socio-Legal Studies, Disability Studies, Policy Studies and Social Work, Sociology, Anthropology; and those training to be service providers with persons with disabilities.

Available in PDF, EPUB and Kindle. Book excerpt: This book assesses the foreign policy legacy of the Obama administration through the lens of national security and leadership. Timely, accessible chapters authored by leading scholars of presidential and international politics cover White House-Cabinet relations; Congress and War Powers; challenges including the Iran nuclear deal, ISIS, and the closing of Guantanamo Bay; drone strikes; the New Cold War with Russia; and the ways in which the Obama foreign policy legacy shaped the 2016 presidential election. In particular, the book explores the philosophical basis of counter-terrorism strategy in the Obama administration and traces how precepts differed from the administration of George W. Bush. More generally, the book contributes to an understanding of the distinctive interplay between the formal, constitutional powers of the president and the use of informal, executive powers in the quest for peace and security. Finally, the book surveys the challenges that Donald J. Trump faces in the transition to the new presidential administration.

Book excerpt: This indispensable, one-stop resource examines where Democrats and Republicans stand on current civil rights and civil liberties issues related to voting, free speech, abortion and reproductive rights, guns, and other hot button topics. Both the Democratic and Republican parties claim that they have the best interests of the nation and its people at heart, and they are equally adamant that they have the best policy solutions to address the nation's problems and challenges. Each volume in the Across the Aisle reference series examines the stated policy positions and actual voting/legislative records of the two parties (they are not always the same) on important areas of public policy, both historically and in the present day. This volume sorts through the rhetorical clutter and partisan distortions that typify so many disputes between Republicans and Democrats and provides an accurate, balanced, and even-handed overview of the parties' attitudes and records on vital civil rights and liberties questions.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first detailed history of the Constitution's treaty supremacy rule. It describes a process of invisible constitutional change. The traditional supremacy rule provided that all treaties supersede conflicting state laws; it precluded state governments from violating U.S. treaty obligations. Before 1945, treaty supremacy and self-execution were independent doctrines. Supremacy governed the relationship between treaties and state law. Self-execution governed the division of power over treaty implementation between Congress and the President. In 1945, the U.S. ratified the UN Charter, which obligates nations to promote human rights "for all without distinction as to race." In 1950, a California court applied the Charter's human rights provisions and the traditional treaty supremacy rule to invalidate a state law that discriminated against Japanese nationals. The implications were shocking: the decision implied that the United States had effectively abrogated Jim Crow laws throughout the South by ratifying the UN Charter. In response, conservatives mobilized support for a constitutional amendment, known as the Bricker Amendment, to abolish the treaty supremacy rule. The amendment never passed, but Bricker's supporters achieved their goals through de facto constitutional change. The de facto Bricker Amendment created a novel exception to the treaty supremacy rule for non-self-executing (NSE) treaties. The exception permits state governments to violate NSE treaties without authorization from the federal political branches. The death of treaty supremacy has significant implications for U.S. foreign policy and for U.S. compliance with its treaty obligations.

Available in PDF, EPUB and Kindle. Book excerpt: Chronicling the highly partisan and polarized environment during the historic first term of President Barack Obama, Congress and the Nation 2009-2012 Volume XIII is the most authoritative reference on congressional law-making and trends during the 111th and 112th Congresses. The newest edition in this award-winning series documents the most fiercely debated issues during this period, including: Stimulus spending in the wake of financial crisis The controversial reform of the U.S. healthcare system Showdowns over raising the national debt ceiling Extensions of tax cuts and unemployment compensation Confirmation of two new female members of the U.S. Supreme Court Overhaul of financial industry regulations Repeal of the “don’t ask, don’t tell” law banning openly gay armed forces personnel from military service This acclaimed resource also covers the shift in partisan control of the U.S. House after the 2010 midterm election and the subsequent gridlock for lawmaking in the 112th Congress. Organized by policy area, each chapter summarizes the legislative activity, including a chronology and legislative history of the bills passed and the major provisions of the final laws. No other source guides readers seamlessly through the policy output of the national legislature with the breadth, depth, and authority of Congress and the Nation. This must-have reference for all academic libraries meets the needs of the full spectrum of users, from lower-level undergraduates through researchers and faculty.

Available in PDF, EPUB and Kindle. Book excerpt: If you ever wondered who becomes an American ambassador and why, this is the book for you. It describes how Foreign Service officers become ambassadors by rising up through the ranks, and why they typically make up about 70 percent of the total number of ambassadors. It also covers where the other 30 percent come from—the political appointees who get the job because they helped elect the president by supporting him as a campaign contributor, a political ally, or a personal friend. It explains why, despite being illegal and a threat to national security, selling the title of ambassador remains a common practice that is also unique to the United States. It considers why some suggestions for reform are misguided, what might be done, and why who the president is matters so much in determining how well the United States will be represented abroad. This updated and revised edition of Jett's classic book not only provides a timely overview of American ambassadorship for Foreign Service Officers, aspiring diplomats, and interested citizens, but also calls for much-needed reform, describing the dire implications of failing to change our ambassadorial appointments process for the future of American diplomatic practice and foreign policy.
