Book excerpt: In this important report, the authors present a detailed analysis of 12 major issues that need to be addressed in all cloud contracts. In addition to traditional issues such as pricing, cloud computing contracts require that a variety of data assurance issues be addressed, including data ownership, access to data, disposition of data, data breaches, and data storage location. This report is based on a detailed analysis of five public sector contracts in North Carolina for cloud services. The five case studies included a local government, a state agency, a higher education institution, a local public health organization, and a K-12 public school system. Based on these case studies, the authors developed a series of recommendations for government organizations to guide them in the writing and negotiating of contracts for cloud services. --

Book excerpt: In Government Cloud Procurement, Kevin McGillivray explores the question of whether governments can adopt cloud computing services and still meet their legal requirements and other obligations to citizens. The book focuses on the interplay between the technical properties of cloud computing services and the complex legal requirements applicable to cloud adoption and use. The legal issues evaluated include data privacy law (GDPR and the US regime), jurisdictional issues, contracts, and transnational private law approaches to addressing legal requirements. McGillivray also addresses the unique position of governments when they outsource core aspects of their information and communications technology to cloud service providers. His analysis is supported by extensive research examining actual cloud contracts obtained through Freedom of Information Act requests. With the demand for cloud computing on the rise, this study fills a gap in legal literature and offers guidance to organizations considering cloud computing.

Available in PDF, EPUB and Kindle. Book excerpt: Cloud-computing, since 2008, has been one of the fastest growing IT trends that tends to revolutionize the way IT is consumed and managed, while improving cost efficiencies, accelerating innovation, and having the ability to scale applications on demand [1]. Due to the evolution of this concept and the legal, economical, security and privacy issues it may pose, the scope of this article is to shed a light on cloud-computing - specifically: the types of services enterprises offer based on cloud-computing, the specificity of negotiating such contracts, and on certain essential clauses these types of contracts should meet, including propositioning a standardized approach to procuring cloud services, including a standard set of requirements for cloud service providers to adhere to when a state proposes contracts for cloud services. The scientific approach will be based on recommendations, best practice guides, legal framework, and examples of contracts at EU and USA level, also discussing the recent progress made by the small country of Moldova in this matter that has decided to implement a joint government technology platform (mCloud26) by contracting a cloud-computing service provider. Some key aspects of these types of contracts that will be presented are as follows: types of contracts, applicable law, jurisdiction, proper use, confidentiality, data location and transfer, access by the provider, rights over service and contents, liability, warranty, auditing requirements, cloud-computing institution overseers, performance management, ending the arrangement, dispute resolution, imposed clauses. Finally, the article will conclude with a manifest regarding cloud-computing as being a still immature technology, albeit in full expansion, but in order for it to be considered a solution to certain needs rights and obligations completely.

Book excerpt: Federal and private sector guidance highlights the importance of federal agencies using a service level agreement (SLA) in a contract when acquiring IT services through a cloud computing provider. Cloud computing is a means for delivering computing services via IT networks. When executed effectively, cloud-based services can allow agencies to pay for only the IT services used, thus paying less for more services. An important element of acquiring cloud services is a service level agreement that specifies, among other things, what services a cloud provider is to perform and at what level. The objectives of this report were to (1) identify key practices in cloud computing SLAs; and (2) determine the extent to which federal agencies have incorporated such practices into their SLAs. Includes recommendations. Tables and figures. This is a print on demand report.

Book excerpt: This open access book brings together perspectives from multiple disciplines including psychology, law, IS, and computer science on data privacy and trust in the cloud. Cloud technology has fueled rapid, dramatic technological change, enabling a level of connectivity that has never been seen before in human history. However, this brave new world comes with problems. Several high-profile cases over the last few years have demonstrated cloud computing's uneasy relationship with data security and trust. This volume explores the numerous technological, process and regulatory solutions presented in academic literature as mechanisms for building trust in the cloud, including GDPR in Europe. The massive acceleration of digital adoption resulting from the COVID-19 pandemic is introducing new and significant security and privacy threats and concerns. Against this backdrop, this book provides a timely reference and organising framework for considering how we will assure privacy and build trust in such a hyper-connected digitally dependent world. This book presents a framework for assurance and accountability in the cloud and reviews the literature on trust, data privacy and protection, and ethics in cloud computing.

Book excerpt: agencies using a service level agreement (SLA) in a contract when acquiring information technology (IT) services through a cloud computing services provider. An SLA defines the level of service and performance expected from a provider, how that performance will be measured, and what enforcement mechanisms will be used to ensure the specified performance levels are achieved. GAO identified ten key practices to be included in an SLA, such as identifying the roles and responsibilities of major stakeholders, defining performance objectives, and specifying security metrics. The key practices, if properly implemented, can help agencies ensure services are performed effectively, efficiently, and securely. Under the direction of the Office of Management and Budget (OMB), guidance issued to agencies in February 2012 included seven of the ten key practices described in this report that could help agencies ensure the effectiveness of their cloud services contracts. GAO determined that the five agencies and the 21 cloud service contracts it reviewed had included a majority of the ten key practices. Specifically, of the 21 cloud service contracts reviewed from the Departments of Defense, Health and Human Services, Homeland Security, Treasury, and Veterans Affairs, 7 had fulfilled all 10 of the key practices, as illustrated in the figure. The remaining 13 contracts had incorporated 5 or more of the 10 key practices and 1 had not included any practices.
