In chapter one, the author examines some basic issues in Nigerian constitutional law, and in chapter two the supremacy of the Constitution is examined. Also examined in this book are federalism, local government, fundamental rights, the fundamental rights enforcement procedure, the legislature, the executive, the judiciary, elections, INEC, and political parties. Available in PDF, EPUB and Kindle. Book excerpt: The book explores the broad range of legal, personal, social, political and historical foundations of international law. The book is a collective effort of qualified authors- law school deans and professors, national and international court judges, young and old international law scholars and government lawyers from varying legal cultures across the oceans of the world, representing diverse legal philosophical and corresponding practices bringing their stories to life, telling tales helpful for those well-acquainted with the issues. Although one book of Liber Amicorum cannot address all the important issues in the vast arena of international law, these essays provide a rich and lucid understanding of issues of modern public international and comparative law. The beauty of the book lies in the fact that the issues discussed in the compendium by the diverse authors though familiar to comparatists, are given perspectives different from the usual Euro-American centrist standpoint that dominated the current writings in international law. The collected essays will be found most useful as an informative tool in the discovery of progressive development of international law as well as in the study of comparative legal systems. *** The legal essays contained in this treatise on various important issues of public international and comparative law are interesting, well researched, and written from multi-disciplinary perspectives by very well-qualified legal scholars from different backgrounds and cultures of the world. All the authors are exceptionally knowledgeable and experts in their chosen fields. It is strongly urged that people should read these essays in order to fully appreciate the contributions of international legal scholars to world peace, international development, understanding and progress. Nothing can be more befitting in honoring Professor Dr. Christian Nwachukwu Okeke for his enormous contributions to the positive development of the legal academy nationally and internationally. Professor Dr. Emmanuel Omoh Esiemokhai Ph.D., Academic Chancellor, Bosas International Law Bureau, Abuja, Nigeria Chima Nweze's Contemporary Issues on Public International and Comparative Law: Essays in Honor of Professor Christian Nwachukwu Okeke, is a magisterial work of enormous scope and depth that brings together a diverse group of internationally distinguished authors from academia, government and private practice. The Liber Amicorum is impressive both in range of subject matter and quality of analysis and merits the attention of scholars and global policy makers. Ndiva Kofele Kale, Ph.D., J.D., Professor of Law, Southern Methodist University, Dedman School of Law, Dallas, Texas Professor C.N. Okeke is a very fine scholar in international law. He has taught the subject in Universities in Africa, Europe and the United States. In all these continents, he has made tremendous impact on students of the subject. I regard the essays as a useful epilogue to his successful career as a teacher and researcher of international law. I heartily recommend the essays to all that are interested in the study of international law. I have no doubt in my mind that the essays will provide a useful addition to the growing literature in international law. I commend the contributors for a worthy compendium.

Book excerpt: This study provides history and analysis of constitution making in Nigeria. It demonstrates that the history can be divided into periods of non-participation, and then gradual participation of Nigerians in the making of their constitution. It analyses the procedure for the making of the 1999 Constitution, and the present position. It advocates for the future, more active or total participation of Nigerians in the constitution making process. The study discusses the development of constitutional law vis-a-vis federalism, the legislature, the executive, the judiciary, local governments and citizenship. All in all, it demonstrates how Nigerians have never been satisfied with their constitutional set-up because of perceived inequalities and injustices caused by the accident of history; and calls for a renegotiation of the basis of the continued existence of Nigeria as a federation, which gives precedence to equity and justice, and representation to the various nationalities making up modern Nigeria.

Available in PDF, EPUB and Kindle. Book excerpt: Constitutional law is bedevilled by a crisis of standpoints. Many times, this has led to a lack of congruence between theory and practice. The true nature of the constitution is, for example, a central problem of Constitutional Law. In theory, the constitution is supreme 'law'. But, in practice, most publicists and courts recognize decrees during military rule as different from, yet superior to, the constitution. The student is fed these mutually antagonistic propositions, with a consequent loss of faith in the integrity of the subject matter. To make Constitutional Law more coherent, 'The Constitution as Junction of Force and Law' proposes the unifying doctrine of preponderant force. Because of the ontological nature of the problem, the book goes beyond the traditional sources of legal science. Although it examines constitutions, statutes and cases as well as books on these written by lawyers, it has also sought assistance elsewhere. The research reveals that: *The confusion of standpoints mostly results from an undue reliance upon textual analysis as well as a failure to distinguish Constitutional Law (i.e., the subject of study) from the constitution (i.e., the object studied). *Nomenclature is irrelevant. Whether it is called a 'decree, ' 'charter, ' 'constitution, ' 'basic law, ' etc., if it is the supreme law, then it is the constitution. *The constitution is of two parts: the written, partly written, or wholly unwritten, framework of government; and, the energizing force, which sustains that framework. *Normally, there are competing frameworks. A constitution is that one supported by the polity's current wielder of preponderant force. Since Constitutional law is the study of constitutions, this book concludes that, for coherence, it should always be taught and studied with a sensitive appreciation of the influence of preponderant force.

Book excerpt: "After nearly 30 long and disastrous years of military rule in Nigeria from 1966 to 1999 (less only four wobbly years of civilian interregnum from 1979 to 1983), the culture of constitutionalism in the country has become brutally defaced, degraded and obscured. The return of constitutional government in May 1999 marked a new beginning for virtually everybody - the politicians, the legislators, the students, the academia and all. No wonder that all levels of government - Federal, State and Local Government - the nation has been experiencing a rattling bustle of intergovernmental disputation as to the limits of power and the dos and don'ts of governmental action...The essays are written primarily for university law students and students in other tertiary institutions studying constitutional law...The book thus serves an important need to make academic materials available to such students in these days of harrowing book scarcity in the country. But the essays will also reward reading by politicians and others, including lawyers, who may want or need to read up elements of constitutional law or to brighten their dimming knowledge of rudiments of the subject," - Professor Charles Ilegbune, University of Abuja, Nigeria Definitions and Forms of Constitutional Law Common Constitutional Concepts Historical Development of Nigerian Constitutional Law Fundamental Objectives and Concept of Citizenship Under Nigerian Constitution Reflections on the Nature of Fundamental Rights Legislative Powers Under Nigerian Constitution Scope of Executive Powers Under Nigerian Constitution Judicial Powers and Concept of Judicial Independence under Nigerian Constitution Legal Effect of Change of Government by Extra-Constitutional Means (Coup D'état) Proceedings By and Against the State

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this very useful analysis of constitutional law in Nigeria provides essential information on the countryand’s sources of constitutional law, its form of government, and its administrative structure. Lawyers who handle transnational matters will appreciate the clarifications of particular terminology and its application. Throughout the book, the treatment emphasizes the specific points at which constitutional law affects the interpretation of legal rules and procedure. Thorough coverage by a local expert fully describes the political system, the historical background, the role of treaties, legislation, jurisprudence, and administrative regulations. The discussion of the form and structure of government outlines its legal status, the jurisdiction and workings of the central state organs, the subdivisions of the state, its decentralized authorities, and concepts of citizenship. Special issues include the legal position of aliens, foreign relations, taxing and spending powers, emergency laws, the power of the military, and the constitutional relationship between church and state. Details are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for both practising and academic jurists. Lawyers representing parties with interests in Nigeria will welcome this guide, and academics and researchers will appreciate its value in the study of comparative constitutional law.
