Book excerpt: The backlash against managed care drive-through deliveries and gag rules illustrate a more general problem: the folly of relying exclusively on market choice to protect the interests of health care consumers. Yet government rule making about medical care isn't the only alternative. There's another option: giving consumers a more direct voice in managed care organizations. American health policy has neglected this remedy. This article explains the benefits of fostering consumer voice and shows why it can succeed in promoting accountable health care where market approaches have failed.

Book excerpt: The author examines the potential role for the public and, more specifically, for plan participants, in making managed care organizations (MCOs) respond to their wishes by means other than market exit. Market exit, or simply choosing an alternative means of procuring healthcare, is not an option for most plan participants -- and even when available, sends a message that is muted at best. Moreover, the author reasons that MCOs are imbued with a variety of quasigovernmental qualities; thus, it is appropriate that they should be more responsive to the requirements of their customers than, say, a retailer. Professor Rodwin describes and analyzes various ways that public policy and law could enhance the ability of consumers to help shape the policies of MCOs and discusses the pros and cons of differing means by which Consumer Voice can be represented.

Book excerpt: Representatives of industry, government, caregivers, and consumers join scholars and policy analysts in comparing market forces to regulation as potential means for righting what is wrong with managed care. The contributors that John E. Billi and Gail B. Agrawal have gathered here quickly move the healthcare debate beyond the classroom, think tank, and statehouse to the boardroom and examining room. Some argue strongly that the solution is to be found in the democratic process and government intervention, while others maintain that only market forces in a competitive environment can respond quickly to the needs of consumers and purchasers alike. The contributors' diverse opinions about the oversight of managed care reflect an enduring divide, one that will affect how society ultimately resolves questions about the inevitable tradeoffs among health-care quality, cost, and access in an environment of limited resources. The Challenge of Regulating Managed Care will appeal to policymakers, those in the medical field, and all readers interested in the American experience with managed care. John E. Billi is Associate Professor of Internal Medicine and Medical Education; Associate Dean for Clinical Affairs, University of Michigan Medical School; and Associate Vice President for Medical Affairs, University of Michigan. Gail B. Agrawal is Associate Professor of Law, University of North Carolina, Chapel Hill.

Available in PDF, EPUB and Kindle. Book excerpt: The Ethics of Managed CareA Pragmatic Approach Mary R. Anderlik A breakthrough reappraisal of the managed healthcare debate. Discussions of managed care frequently begin and end with an opposition between the Hippocratic ethic of dedication to patient welfare and a business ethic of self-interest in the service of efficiency. Mary R. Anderlik approaches managed care as a problem of organizations. Rejecting a simple "medicine vs. business" analysis, she directs attention to management as manipulation, the neglect of such personal goods as satisfaction in professional accomplishment, and organizational moral myopia. In this account, "pragmatic" suggests practical idealism, not the jettisoning of principle in the interests of expediency. In The Ethics of Managed Care, Anderlik favors a broad empiricism and a moral vision centered on values of democracy and community. She describes how organizations can nourish or destroy openness, creativity, cooperation, and faithfulness -- and display "virtues" such as justice, integrity, responsiveness, and efficiency, rightly understood. She uses community care clinics, asthma outreach programs, and new contexts for participatory decision-making to show the promise of managed care. She also explains the complexities of financial arrangements, arguing for an end to schemes that reward clinicians for providing less care and profiting from avoiding people who need a lot of it. The book concludes with a look at the future of managed care, proposing a program for reform. Mary R. Anderlik is Research Professor at the Health Law and Policy Institute, University of Houston Law Center. Medical Ethics SeriesDavid H. Smith and Robert M. Book excerpt: Despite the attention to the problem of protecting the health care interests of Americans, there is little consensus on what should be done politically or otherwise to address this problem. In Protecting American Health Care Consumers Eleanor DeArman Kinney, a nationally regarded expert on health policy and law, tackles the serious and ongoing debate among state and federal policymakers, health care providers, third-party payers, and consumers about how to provide procedural justice to patients in the present health care climate. To promote and ensure consumer protection in an increasingly adversarial and complicated health-care culture, Kinney first analyzes the procedures by which consumer concerns are presently discerned and resolved and then explains why these systems are unsatisfactory. She also discusses problematic procedures for making coverage policy and quality standards and proposes reforms in a variety of processes that would enable all consumers, including the uninsured, to influence key policies and standards and also to raise concerns and obtain appropriate remedies. As the first comprehensive treatment of administrative procedures in American health plans and other such institutions, Protecting American Health Care Consumers will be welcomed by state and federal policymakers, managed care executives, and lawyers charged with designing and implementing protections for consumers in public and private health plans.
