Available in PDF, EPUB and Kindle. Book excerpt: In a contemporary labour market that includes growing levels of precarious employment, the regulation of minimum employment standards is intricately connected to conditions of economic security. With a focus on the role of neoliberal labour market policies in promoting "flexible" employment standards legislation - particularly in the areas of minimum wages and working time - Mark Thomas argues that shifts toward "flexible" legislation have played a central role in producing patterns of labour market inequality. Using an analytic framework that situates employment standards within the context of the broader social relations that shape processes of labour market regulation, Thomas constructs a case study of employment standards legislation in Ontario from 1884 to 2004. Drawing from political economy scholarship, and using a qualitative research methodology, he analyses class, race, and gender dimensions of legislative developments, highlighting the ways in which shifts towards "flexible" employment standards have exacerbated longstanding racialized and gendered inequities. Regulating Flexibility argues that in order to counter current trends towards increased insecurity, employment standards should not be treated as a secondary form of labour protection but as a cornerstone in a progressive project of labour market re-regulation.

Available in PDF, EPUB and Kindle. Book excerpt: Barbara Paleczny, herself a daughter of garment workers, tugs at the threads of homeworking in the garment industry to reveal a low-wage strategy that rends the fabric of social integrity and exposes global trends. The resurgence of sweatshops affects the working poor in both first- and third-world countries. Paleczny assesses the responsibility of transnational retailers for unacceptable wages and working conditions and describes historic shifts in the global context of garment production. After exploring systemic causes of poverty, relevant policy setting, and ethical foundations, Paleczny introduces both short- and long-range possibilities for transformation, emphasizing the collaborative nature of work. Clothed in Integrity draws on feminist studies, alternative economics, and the ethical foundations proposed by Bernard Lonergan to fashion a constructive work in which Paleczny connects issues of societal meanings and values, moral imperatives, and economic feasibility. With candour, she shares personal stories of engagement in coalition work. Those who dwell on this text will find information, challenges, and inspiration to nurture their reflection, research, dialogue, and action.

Book excerpt: This book critically examines the proper role of the law in protecting job security in the contemporary workplace. It provides a historical, theoretical, practical and comparative perspective on this under-researched, but fundamentally important, legal mechanism at a time when the pressure to deregulate and dilute worker-protective laws has taken on increased importance. The volume critically analyses both statute and case law from three advanced industrialised liberal democracies with a common law foundation, the UK, Australia and the USA, to understand the extent to which job security is realised. By applying a common approach and a conceptual framework that emphasises the complex relationships between law, the economy and society to analyse a series of national studies, the book is also designed to draw upon the insights of comparative analysis to deepen our understanding of the limits and possibilities of legal regulation of job security. The national case studies are supplemented by research that focuses on how supra-national organisations have sought both to develop and disseminate new legal norms around the practices and processes of dismissal. This study critically analyses and assesses the adequacy of the international regulatory framework for protecting the rights of employees in the dismissal process.
