Book Synopsis The Regulatory State by : Dawn Oliver

Book excerpt: This collection of fifteen essays by leading experts in regulation is unique in its focus on the constitutional implications of recent regulatory developments in the UK, the EU, and the US. The chapters reflect current developments and crises which are significant in many areas of public policy, not only regulation. These include the development of governance in place of government in many policy areas, the emergence of networks of public and private actors, the credit crunch, techniques for countering climate change, the implications for fundamental rights of regulatory arrangements and the development of complex accountability mechanisms designed to promote policy objectives. Constitutional issues discussed in The Regulatory State include regulatory governance, models of economic and social regulation, non-parliamentary rule-making, the UK's devolution arrangements and regulation, the credit crisis, the rationing of common resources, regulation and fundamental rights, the European Competition Network, private law making and European integration, innovative regulator sanctions recently introduced in the UK, the auditing of regulatory reform, and parliamentary oversight and judicial review of regulators. The introductory chapter focuses on testing times for regulation, and the concluding chapter draws ten lessons from the substantive chapters, noting the importance of regulatory diversity, the complexity of networks and relations between regulatory actors and the executive, the new challenges to regulatory habits posed by climate change and the credit crisis, the wider economic and legal context in which regulation takes place and the accountability networks - including judicial review, parliamentary oversight and audit - within which regulation operates.
Book Synopsis Outcome-Based Cooperation by : Christopher Hodges
Download or read book Outcome-Based Cooperation written by Christopher Hodges and published by Bloomsbury Publishing. This book was released on 2022-09-22 with total page 595 pages. Available in PDF, EPUB and Kindle. Book excerpt: How do we cooperate – in social, local, business, and state communities? This book proposes an Outcome-Based Cooperative Model, in which all stakeholders work together on the basis of trust and respect to achieve shared aims and outcomes. The Outcome-Based Cooperative Model is built up from an extensive analysis of behavioural and social psychology, genetic anthropology, research into behaviour and culture in societies, organisations, regulation, and enforcement. The starting point is acceptance that humanity is facing ever larger risks, which are now systemic and even existential. To overcome the challenges, humans need to cooperate more, rather than compete, alienate, or draw apart. Answering how we do that requires basing ourselves, our institutions, and systems on relationships that are built on trust. Trust is based on evidence that we can be trusted to behave well (ethically), built up over time. We should aim to agree common goals and outcomes, moderating those that conflict, produce evidence that we can be trusted, and examine our performance in achieving the right outcomes, rather than harmful ones. The implications are that we need to do more in rebasing our relationships in local groupings, business organisations, regulation, and dispute resolution. The book examines recent systems and developments in all these areas, and makes proposals of profound importance for reform. This is a new blueprint for liberty, solidarity, performance, and achievement.
Book Synopsis Sustainable Development Policy Directory by : W. Alan Strong
Download or read book Sustainable Development Policy Directory written by W. Alan Strong and published by John Wiley & Sons. This book was released on 2008-04-15 with total page 672 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Directory means that a whole range of built environment professionals need never be caught out by the perversities of policy – in its formulation or on its journey into the real life of you and me. To have in one place the means of not only burrowing down into any one policy, but also of exploring the interconnections is a precious resource for any professional - ‘sustainability literate’ or not. Today, nobody who delivers our built environment can be excused from taking responsibility for the future. Armed with this Directory their contribution can only be made more effective. Sara Parkin OBE Forum for the Future This desk-top reference on sustainable development provides essential information for all who need to be up-to-date and familiar with the implications of the legal, fiscal and planning frameworks around the global and local sustainability agenda. It is relevant to a range of organisations and individuals - from national and local authorities, professional bodies, built environment professions, academia, environmental consultancies, non-governmental organisations and others. Carefully designed to facilitate access for a diverse range of stakeholders, it covers international, European, British and local policies in key built environment themes, and develops their inter-relationship to sustainable development. The Directory addresses each theme in a series of tables which summarise the policy purpose and also provide web-links to view the specific policy documents. The themes covered are: · Biodiversity · Climate Change · Construction · Energy · Environment · Planning · Pollution · Social Issues · Sustainable Development Policy and Practice · Transport · Urban Development · Waste Management · Water Other books of interest: The Green Guide to Specification Anderson ISBN: 1405119616 Smart & Sustainable Built Environments Yang Hardback ISBN: 1405124229 Sustainable Property Development Keeping Paperback ISBN: 0632058048 Previously Developed Land Syms Paperback 1405106972 Evaluating Sustainable Development Brandon 0632064862 Cover design by Garth Stewart www.thatconstructionsite.com

Book Synopsis Law and Corporate Behaviour by : Christopher Hodges
Download or read book Law and Corporate Behaviour written by Christopher Hodges and published by Bloomsbury Publishing. This book was released on 2015-10-22 with total page 704 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the theories and practice of how to control corporate behaviour through legal techniques. The principal theories examined are deterrence, economic rational acting, responsive regulation, and the findings of behavioural psychology. Leading examples of the various approaches are given in order to illustrate the models: private enforcement of law through litigation in the USA, public enforcement of competition law by the European Commission, and the recent reform of policies on public enforcement of regulatory law in the United Kingdom. Noting that behavioural psychology has as yet had only limited application in legal and regulatory theory, the book then analyses various European regulatory structures where behavioural techniques can be seen or could be applied. Sectors examined include financial services, civil aviation, pharmaceuticals, and workplace health & safety. Key findings are that 'enforcement' has to focus on identifying the causes of non-compliance, so as to be able to support improved performance, rather than be based on fear motivating complete compliance. Systems in which reporting is essential for safety only function with a no-blame culture. The book concludes by proposing an holistic model for maximising compliance within large organisations, combining public regulatory and criminal controls with internal corporate systems and external influences by stakeholders, held together by a unified core of ethical principles. Hence, the book proposes a new theory of ethical regulation.
Book Synopsis Regulation of health care professionals by : Great Britain: Law Commission
Download or read book Regulation of health care professionals written by Great Britain: Law Commission and published by The Stationery Office. This book was released on 2012-03 with total page 274 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this consultation paper, the Law Commissions of England and Wales, Scotland and Northern Ireland are seeking views on the regulation of health care professionals in the UK and social workers in England. In their first joint consultation, the Commissions are asking how a new legal framework would: give the regulators increased flexibility in the use of their powers while ensuring public accountability; enable them to ensure proper standards of professional education, conduct and practice; and have at its heart a duty on the regulators to protect the public. It makes provisional proposals which seek to simplify and modernise the law and establish a streamlined, transparent and responsive system of regulation of health care professionals, and in England only, the regulation of social workers
