Book excerpt: Since the end of the 1960s, Japan’s power in the world has largely been linked to its economic successes, while it has pursued a decidedly pacifist post-war foreign policy. Recently, however, there has been talk of Constitutional reform, especially since the new security legislation of 2016. Coupled with the conservative tilt of the two Houses, there is evidence to suggest that Japan’s approach to exercising its power could be changing. Japan’s World Power therefore seeks to examine the nature of Japan’s power today, showing how the country’s influence on the global stage appears to be shifting from economic and financial, to more political and military. Featuring a team of Japanese international relations experts, each chapter analyses the different facets of Japanese power, evaluating both its current status and the challenges which lie ahead. Ultimately, however, this book demonstrates that despite recent developments and changes, the way in which Japan exercises its power remains decidedly different from other major powers as it continues to be guided by its pacifist identity. Providing a multi-faceted assessment of Japan’s power, as well as its weaknesses, this book will be useful to students and scholars of Japanese Politics, Asian Foreign Policy and Asian Politics in general.

Available in PDF, EPUB and Kindle. Book excerpt: Life imprisonment is a complex and drastic penal sanction. It gives the State the power to curtail the liberty of offenders for the rest of their lives. In many jurisdictions life imprisonment is the ultimate sanction for the most serious crimes. It is frequently touted as an alternative to the death penalty. At the same time, life imprisonment is often imposed as a preventive measure, where the offence alone does not justify using the ultimate sanction in the penal arsenal. The complexity of life imprisonment is frequently overlooked. Often it is assumed that it is not as drastic as it sounds, as it will not be enforced for the whole life of the offender. There may also be a reluctance to subject life imprisonment to close scrutiny, lest its perceived suitability as an alternative to the death penalty be undermined. This book tackles the complexity of life imprisonment head on by describing how various forms of it are imposed and implemented in the United States of America, in England and Wales and in Germany, as well as in the emerging international system of criminal justice. From this basis it examines the justifications advanced for life imprisonment and the modifications that have resulted in individual jurisdictions in response to criticisms of its imposition and implementation. At the same time, the book develops a more general critique of life imprisonment. It evaluates it against constitutional human rights standards that have been developed in many jurisdictions to judge the acceptability of punishment generally. It concludes that some current practices in both the imposition and implementation of life imprisonment clearly are fundamentally unacceptable, but that questions remain, even about carefully implemented life sentences imposed for the most serious crimes. The jurisprudential analysis provides the basis for a major re-evaluation of life imprisonment and raises doubts about the unquestioning acceptance of this ultimate penalty.

Available in PDF, EPUB and Kindle. Book excerpt: This book aims at deconstructing and problematizing linguistic ideologies related to Portuguese in late modernity and questioning the theoretical presuppositions which have led us to call Portuguese ‘a language.’ Such an endeavor is crucial when we know that Portuguese is a language which is increasingly internationalized, used as the official language in four continents (in ten countries) and which has come to play a relevant role in the so-called linguistic market on the basis of the geopolitical transformations in a multipolar world. The book covers a wide range of social, political and historical contexts in which ‘Portuguese’ is used (in Brazil, Canada, East-Timor, England, Portugal, Mozambique and Uruguay), and considers diverse linguistic practices. Through this critique, contributors chart new directions for research on language ideologies and language practices (including research related to Portuguese and to other ‘languages’) and consider ways of developing new conceptual compasses that are better attuned to the sociolinguistic realities of the late modern era, in which people, texts and languages are increasingly in movement through national borders and those of digital networks of communication.

Book excerpt: A just and sustainable peace for Syria can only be attained through the equal participation of women’s rights defenders at the negotiation table and throughout the transitional process. Understanding the legal framework within which such participation takes place – and the challenges of promoting women’s rights through a gender-responsive constitution – is crucial. This publication, resulting from a collaboration between Euromed Feminist Initiative and the University of Padova, builds on the knowledge of academics and advocates, shedding new insights on those challenges. It aims at supporting institutional efforts being made to guarantee women’s participation in the Syrian reconstruction, as well as advocacy initiatives carried out to ensure women’s participation in political and economic decision-making in the country’s future.

Book excerpt: With international attention focused on Hong Kong, many forget that Macau also exists in a delicate "one country, two systems" (OCTS) balance with mainland China. This book provides insights into the circumstances surrounding the less-understood half of China’s OCTS policy, including the stagnation of representational government, and the location of any Macau characteristics in the Macau Basic Law. Despite being Hong Kong’s sister "Special Administrative Region" (SAR) within the People’s Republic of China, Macau’s unique constitutional development under Portuguese and Chinese administration remains under-appreciated despite its potential contributions to local, national, and international constitutional discourse. Utilizing a multidisciplinary approach, including doctrinal, historical, and comparative methodologies, this work fills that gap. The research blends Portuguese, Chinese, and foreign-language sources in order to reconstruct a balanced constitutional narrative. The book focuses on a consequential effect of globalization – that is, the assimilation of a long-standing and unique constitutional order by a new hegemonic sovereign – including processes for internationalization as China opened up, legal harmonization of two distinct legal and socioeconomic orders, juridification of local affairs with the establishment of a new local court system in preparation for handover to the Chinese regime, and democratization (or the lack thereof) among the various communities comprising the Macanese polity before and since. Focusing on Macau’s unique development at the crux of European and Chinese empires, and the role it plays as a mirror for Chinese intentions vis-a-vis Hong Kong today, the book will be of interest to those working in constitutional law, politics, and history.
