Available in PDF, EPUB and Kindle. Book excerpt: This book examines the historical antecedents of the concept of general chapter, the supreme authority in an institute of consecrated life. This provides the basis for an examination of the contemporary understanding of the nature of its power and authority, as portrayed in the 1983 Code of Canon Law. The general chapter is analysed in terms of its juridic status, collegial nature, participative character and representative function as well as its dynamic aspects and faith dimension. The author applies the findings to one institute of consecrated life, Institute of the Blessed Virgin Mary Loreto Branch. This application provides an example of the challenges inherent in working participatively and collaboratively within a hierarchical structure. Because consecrated life has an inalienable ecclesial dimension, understanding authority and power and their exercise in institutes of consecrated life has relevance for understanding authority and its exercise in other organs of authority at all levels in the church.

Book excerpt: Chief Justice John Marshall argued that a constitution "requires that only its great outlines should be marked [and] its important objects designated." Ours is "intended to endure for ages to come, and consequently, to be adapted to the various crises of human affairs." In recent years, Marshall's great truths have been challenged by proponents of originalism and strict construction. Such legal thinkers as Supreme Court Justice Antonin Scalia argue that the Constitution must be construed and applied as it was when the Framers wrote it. In Keeping Faith with the Constitution, three legal authorities make the case for Marshall's vision. They describe their approach as "constitutional fidelity"--not to how the Framers would have applied the Constitution, but to the text and principles of the Constitution itself. The original understanding of the text is one source of interpretation, but not the only one; to preserve the meaning and authority of the document, to keep it vital, applications of the Constitution must be shaped by precedent, historical experience, practical consequence, and societal change. The authors range across the history of constitutional interpretation to show how this approach has been the source of our greatest advances, from Brown v. Board of Education to the New Deal, from the Miranda decision to the expansion of women's rights. They delve into the complexities of voting rights, the malapportionment of legislative districts, speech freedoms, civil liberties and the War on Terror, and the evolution of checks and balances. The Constitution's framers could never have imagined DNA, global warming, or even women's equality. Yet these and many more realities shape our lives and outlook. Our Constitution will remain vital into our changing future, the authors write, if judges remain true to this rich tradition of adaptation and fidelity.

Available in PDF, EPUB and Kindle. Book excerpt: The focus of this book is on the situation prevailing in the United States, England and Wales, Ireland, Australia and New Zealand from 1922 to 1965, whereby Catholic schools were used to maximise the possibility of recruiting new members to the religious oders and to minimise the temptation to leave the religious life amongst those who had already joined. Four major practices are examined in this regard. First, Catholic schools deliberately set out to encourage pupils to join the ranks of the religious. Secondly, they replicated within the schools the authoritarianism of the religious life. Thirdly, they worked continuously to marginalize lay teachers from their decision-making. Finally, they were ever vigilant in their opposition to co-education and sex education. The contribution of the religious orders to Catholic education is recognized, but consideration is also given to child abuse, both physical and sexual, in whhich members of various religious teaching orders engaged. The book closes with some consideration of current practices in Catholic education. -- book cover.

Available in PDF, EPUB and Kindle. Book excerpt: English Roman Catholic women’s congregations are an enigma of nineteenth-century social history. Over ten thousand nuns and sisters, establishing and managing significant Catholic educational, health care and social welfare institutions in England and Wales, have virtually disappeared from history. Despite their exclusion from historical texts, these women featured prominently in the public and private sphere. Intertwining the complexities of class with the notion of ethnicity, Contested identities examines the relationship between English and Irish-born sisters. This study is relevant not only to understanding women religious and Catholicism in nineteenth-century England and Wales, but also to our understanding of the role of women in the public and private sphere, dealing with issues still resonant today. Contributing to the larger story of the agency of nineteenth-century women and the broader transformation of English society, this book will appeal to scholars and students of social, cultural, gender and religious history.

Available in PDF, EPUB and Kindle. Book excerpt: This book traces the journey taken by the Canadian Province of Our Lady of the Missions (RNDM) from their establishment in Manitoba in 1898 until 2008, when the congregation as a whole redefined its mission and vision. Using archival research conducted in Winnipeg, Manitoba as well as in England and Italy, and incorporating oral interviews with RNDM sisters, this book explores the historical work of sisters in schools and the part they played in the educational state in formation. The details of the congregation's activity in schools show how the sisters' educational work was related to the social characteristics of the communities (e.g., those of French Canadian settlers, British immigrants, the M?tis population, and continental European immigrants), first in Manitoba and Saskatchewan, and later in Ontario and Quebec. The Sisters of Our Lady of the Missions examines the impact of Vatican II in the 1960s, and into the 2000s, as well as the dismantling of neo-scholasticism and the process of secularization of consciousness in society at large. The emerging issues led the congregation and the province to examine their individual and collective identity at the intersection of feminist theology, eco-spirituality, and a critique of western cosmology.

Book excerpt: The title, Anything of Which a Woman is Capable, comes from Father Jean Pierre Médaille, the Jesuit who brought together the first Sisters of St. Joseph in the mid-seventeenth century. Since 1650, congregations of St. Joseph have grown in Europe, the Americas, India and the Orient, all attracting women who are called to do anything of which they are capable to serve their dear neighbor. This volume tells stories of the foundations of congregations in France and then, beginning in 1836, in the United States. It introduces the reader to intrepid women whose willingness to serve knew no boundaries and whose strong personalities provided an ample match for Church leaders who either encouraged or tried to control their zeal. The copious footnotes make this a valuable addition to the history of Catholic women religious in the United States as well as to the history of Catholicism.

Available in PDF, EPUB and Kindle. Book excerpt: Steadfast Charity covers the history of the Sisters of Charity of Halifax during the years 1972—2002 as the congregation met the challenges of Vatican II and created new models for living vowed religious life. New ways of praying, of being community, of giving service, of understanding the vows—all required trust, openness, risk and a willingness to let go of security. As the congregation responded to the call to renewal, little did the sisters realize how much would change. In this book, Sisters of Charity Mary Sweeney, Martha Westwater, Elaine Nolan and Julia Heslin explore these times by examining the life and practices of the sisters and by contextualizing decisions that were made by the governing bodies during those years. They tell the story of an organization and its evolution as a part of the “Church in the Modern World.” The authors offer an inside view of a congregation which, in navigating its transformation through a time of upheaval in the Church and in the world, remained faithful to its purpose, as stated in its Constitutions: “to give joyful witness to love.”
