Taking place at the beginning of Spain’s Second Republic, those parliamentary deliberations brought about significant novelties in the political vocabulary. Concepts such as democracy, sovereignty, reform, revolution, and freedom, among others, were re-signified. This study investigates the conceptual contributions made by Spanish MPs in the course of the constitutional debate of 1931 by assuming, as a research approach, an interdisciplinary stance combining conceptual history, political theory, and parliamentary constitutional history. By doing so, it selects five determining issues: the pervasive discussion about two competing meanings of a democratic state; the rhetorical uses of reform and revolution; conceptual controversies about religious freedom; the disputed idea of property rights; and the functions of parliament and the president of the republic in a semi-presidential regime. The constitutional debate was largely inspired by interwar European constitutionalism which constituent representatives used to update the Spanish constitutional tradition. With that goal in mind, this book is aimed at undergraduate and graduate students and scholars working in the fields of conceptual history, political philosophy, parliamentary history, European political history, and European constitutionalism. With the rapid growth of Hispanic Linguistics during the 21st century, the topics included in this volume are representative of the breadth, vitality, and interdisciplinarity of contemporary linguistic scholarship. They also reflect that linguistics, in general, has become more methodologically sophisticated. This book is comprised of twelve chapters divided into three parts. Part I addresses language ideology and language contact issues that are embedded in important sociolinguistic and cultural topics chronologically spanning from the 16th century to the present. Although these issues take place in Spain, the United States, Turkey and Ecuador, they pertain ideologically to all corners of the Hispanic World and beyond. Part II is devoted to pragmatics and language variation with topics that transport us to Colombia, Mexico, Spain and Venezuela. The study of politeness strategies shows how Spanish speakers reduce social distance between interlocutors as they make conversation a pleasant and cooperative meeting place. Concurrently, sociolinguistic innovations reveal interesting parallels among several speech communities. Part III explores linguistic variation as it relates to theoretical, structural, and instructional issues. Although these topics are analyzed based mainly on linguistic usage in Bolivia, Colombia, the Dominican Republic, Ecuador, Panama, and Spain – as with the rest of this volume – their relevance reaches far beyond the confines of the Hispanic World. This book is unique in multiple ways and complements a number of existing publications.

In a time when representative democracies were under threat, 15M came to life as a virtuous and democratic response to the slide into far-right populism and authoritarianism. More than a social movement, 15M became a mode of being with transformative, democratizing potential. In Democracy Here and Now, Pablo Ouziel offers a grounded analysis of 15M. At the time of the movement and during the ensuing encampments, Ouziel travelled extensively, speaking to participants, and keeping an ongoing record of his conversations. Presenting an original participatory mode of research, the book reveals six types of intersubjective, "joining hands" relationships that 15M has brought into being and works to carry on in creative ways. The book shows how the movement’s way of being and temporality persists in Spain following the square occupations, while 15M citizens continue to learn and move forward in less perceptible ways. Democracy Here and Now sheds light on a deeply relational, intersectional, and eco-social mode of democracy, and shows how 15M’s ongoing democratization practices are exemplary of similar grassroots movements around the world, broadening our understandings of what it means to be democratic in the here and now.

It draws on neo-constitutional theories and builds on the assumption that fundamental labour rights, understood as rights aimed at protecting workers during their working life or after retirement, are the normative expression of founding values and can be balanced against equally axiological constitutional principles. The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. It ultimately reveals that the axiological nature of fundamental labour rights is preserved and the economic and financial contingencies confirm their factual character, although they are occasionally recognised a prominent role in the ratio decidendi. The book will be a valuable resource for academics and researchers working in the areas of labour law, social security law, legal theory and constitutional law.

Book excerpt: The term solidarity has acquired a commendable meaning of mutual responsibility, yet remains suspect because it has been invoked in too broad a spectrum of cultural contexts, ranging from fascist ideology to human rights. This essential book shows how solidarity may be – should be – conceived as a normative principle with pressing legal content, instrumental to the realisation of the social ends of today’s democratic polities. The author, for the first time in such depth, documents the interweaving of legal norms with social ideas and values, focusing on the use of the principle of solidarity in the European Union’s bodies and in its Member States. There are detailed examinations of how the principle appears in such realms as the following: national constitutions; welfare systems; regulation of contracts; social effects of legal rules; women’s rights; the social market economy; the social doctrine of the Catholic Church; affirmation of corporate social responsibility; and sustainability and corporate governance.
