Con il termine prestazioni previdenziali si intendono non solo quel tipo di prestazioni strettamente di natura pensionistica, bensì anche quelle dirette a rilevare la posizione contributiva sia da parte dei lavoratori che delle aziende. Rientrano in tale categoria anche quelle di natura assistenziale, aventi ad oggetto l’accertamento delle condizioni di invalidità civile e quelle dirette alla liquidazione di prestazioni temporanee, quali la maternità e la disoccupazione. I riferimenti normativi sono gli articoli da 442 a 447 del c.p.c.; in particolar modo è stato affrontato l’argomento dell’accertamento tecnico preventivo, ovvero dell’articolo 445 bis c.p.c., dalla procedura al regime delle spese. Hanno, infatti, natura giuridica previdenziale o assistenziale le controversie concernenti i rapporti sostanziali menzionati nei primi due commi del citato art. 442 c.p.c. L’opera è aggiornata con le sentenze: - Cass. civ. n. 1652/2020 - Cass. civ. n. 1824/2020 - Cass. civ. n. 31288/2020

A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.
