International law has potential relevance for many of these themes, yet the question of how the implementation of best-practice policy recommendations might be affected by international law remains under-examined. This book offers a fuller understanding of the role of international law in the practice of post-conflict reconstruction. It explores how international legal issues that arise in the post-conflict period relate to a number of strands of the policy debate, including government creation, constitution-making, gender policy, provision of security, justice for past atrocities, rule of law development, economic recovery, returning displaced persons, and responsibilities of international actors. While a few states have been advancing electoral democracy, environmental protection and peaceful state building, the overall intensity of violence in the region has led to civil wars, invasion, genocide, dictatorships, political instability, and underdevelopment. Efforts to establish sustainable peace, meaningful socio-economic development and participatory democracy have not been quite successful. Using various methodologies and paradigms, this book interrogates the complexity of the causes of these conflicts; and examines their impact and implications for socio-economic development of the region. The non-consensual actions related to these conflicts and imperatives of power struggles supported by the agents of savage capitalism have paralysed efforts toward progress. The book therefore recommends new policy frameworks within regionalist lenses and neo-realist politics to bring about sustainable peace in the region.

Book excerpt: The international community has donated nearly one trillion dollars during the last four decades to reconstruct post-conflict countries and prevent the outbreak of more civil war. Yet reconstruction has eluded many of these countries, and 1.9 million people have been killed in reignited conflict. Where did the money go? This book documents how some leaders do bring about remarkable reconstruction of their countries using foreign aid, but many other post-conflict leaders fail to do so. Offering a global argument that is the first of its kind, Desha Girod explains that post-conflict leaders are more likely to invest aid in reconstruction when they are desperate for income and thus depend on aid that comes with reconstruction strings attached. Leaders are desperate for income when they lack access to rents from natural resources or to aid from donors with strategic interests in the country. Using data on civil wars that ended between 1970 and 2009 and evidence both from countries that succeeded and from countries that failed at post-conflict reconstruction, Girod carefully examines the argument from different perspectives and finds support for it. The findings are important for theory and policy because they explain why only some leaders have the political will to meet donor goals in the wake of civil war. The findings also shed light on state-building processes and on the political economy of postconflict countries. Paradoxically, donors are most likely to achieve reconstruction goals in countries where they have the least at stake.

Book excerpt: Evidence-based planning for post-conflict reconstruction is often constrained by missing data and the shortcomings of conventional analytical methods. To overcome these constraints, we use economy-wide modeling methods to model the impact of war and reconstruction possibilities for the economy of Yemen. We first calibrate the model to pre-conflict data (2014) and validate it by replicating the most recent available dynamic needs assessments for Yemen that were elaborated by the World Bank. We then report model scenario results for unobserved development indicators, such as estimates for sector-level growth, employment, and poverty. For the post-conflict period, we use the assumptions of a recent dynamic needs assessment and assume gradual reconstruction of the war-induced damages by the target year 2024. Then we focus on uncertain institutional factors and investigate their importance for the country’s socio-economic development. Finally, we assess the potential structural characteristics of Yemen’s economy in the year 2024 and analyze potential risks and trade-offs associated with government’s institutional performance and the implications these have for the pace of post-conflict reconstruction.

Book excerpt: Naseem Badiey examines the local dynamics of the emerging capital city of Juba, Southern Sudan, during the historically pivotal transition period following the 2005 Comprehensive Peace Agreement (CPA). Focusing on the intersections of land tenure reform and urban development, she challenges the dominant paradigm of 'post-conflict reconstruction' and re-conceptualizes state-building as a social process underpinned by negotiation. Badiey explores local resistance to reconstruction programmes, debates over the interpretation of peace settlements, and competing claims to land and resources not as problems to be solved through interventions but as negotiations of authority which are fundamental to shaping the character of the 'state'. While donors and aid agency officials anticipated clashes between the Government of Sudan and the Sudan People's Liberation Movement (SPLM) following the CPA, they did not foresee internal divisions that impeded reconstruction in Southern Sudan, raising serious questions about the viability of an independent state. In Juba local elites interpreted the CPA in line with their economic and political interests, using claims to land, authority and political power to challenge the SPLM's agenda for urban reconstruction. In revealing how local actors strategically interpreted the framework of land rights in Southern Sudan, the book offers a basis for understanding the challenges that confront the nascent South Sudan's state-builders and their international partners in the future.
