Book excerpt: This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power).In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this 'new order of the ages' suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically 'higher' form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments - from the French Revolution to Napoleon's downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory.Also included in this volume are the French originals and English translations of two vital documents. The first - Emmanuel Joseph Sieyès' Du Jury Constitutionnaire (1795) - highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second - the 1812 draft of the Constitution of the Kingdom of Poland - presents the 'constitutional propaganda' of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe's constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. Book excerpt: According to current understanding, Malthus was hostile to an excess of population because it caused social sufferings, while Marx was favourable to demographic growth in so far as a large proletariat was a factor aggravating the contradictions of capitalism. This is unfortunately an oversimplification. Both raised the same crucial question: when considered as an economic variable, how does population fit into the analysis of economic growth? Even though they started from the same analytical standpoint, Marx established a very different diagnosis from that of Malthus and built a social doctrine no less divergent. The book also discusses the theoretical and doctrinal contribution of the liberal economists, writing at the onset of the industrial revolution in France (1840-1870), and those of their contemporary, Pierre-Joseph Proudhon, who shared with Marx the denunciation of the capitalist system. By paying careful attention to the social, economic, and political context, this book goes beyond the shortcomings of the classification between pro- and anti-populationism. It sheds new light over nineteenth century controversies over population in France, a case study for Europe.

Book excerpt: In The Path Not Taken, Jeff Horn argues that—contrary to standard, Anglocentric accounts—French industrialization was not a failed imitation of the laissez-faire British model but the product of a distinctive industrial policy that led, over the long term, to prosperity comparable to Britain's. Despite the upheavals of the Revolution and the Napoleonic Wars, France developed and maintained its own industrial strengths. France was then able to take full advantage of the new technologies and industries that emerged in the "second industrial revolution," and by the end of the nineteenth century some of France's industries were outperforming Britain's handily. The Path Not Taken shows that the foundations of this success were laid during the first industrial revolution. Horn posits that the French state's early attempt to emulate Britain's style of industrial development foundered because of revolutionary politics. The "threat from below" made it impossible for the state or entrepreneurs to control and exploit laborers in the British manner. The French used different means to manage labor unruliness and encourage innovation and entrepreneurialism. Technology is at the heart of Horn's analysis, and he shows that France, unlike England, often preferred still-profitable older methods of production in order to maintain employment and forestall revolution. Horn examines the institutional framework established by Napoleon's most important Minister of the Interior, Jean-Antoine Chaptal. He focuses on textiles, chemicals, and steel, looks at how these new institutions created a new industrial environment. Horn's illuminating comparison of French and British industrialization should stir debate among historians, economists, and political scientists.

The symposium was arranged to honor Josef Loschmidt one hundred years after his death (8 July 1895), to evaluate the sig nificance of his contributions to chemistry and physics from a modem point of view and to trace the development of scientific fields in which he had done pioneering work. Loschmidt is widely known for the first calculation of the size of molecules (1865/66), which also led to values for the number of molecules in unit gas volume and for the mass of molecules. With critical analyses of problems in statistical physics he made important contributions to the development of that field, "Loschmidt's paradoxon" continuing to be a point of departure for present day studies and discussions. For decades there was little awareness that Loschmidt was a pioneer in organic struc tural chemistry. Only in recent years has Loschmidt's first scientific publication "Chemis che Studien I", published in 1861, become more widely known and it is now recognized that with his ideas on the structure of organic molecules he was greatly ahead of the chemists of that time. Based on brain plasticity, art therapy has the potential to increase our repertoire for treating neurological diseases. Neural substrates are the basis of complex emotions relative to art experiences, and involve a widespread activation of cognitive and motor systems. Accordingly, art therapy has the capacity to modulate behavior, cognition, attention and movement. In this context, art therapy can offer effective tools for improving general well-being, quality of life and motivation in connection with neurological diseases.
