Book Synopsis Developing an Appropriate Contaminated Land Regime in China by : Xiaobo Zhao
Download or read book Developing an Appropriate Contaminated Land Regime in China written by Xiaobo Zhao and published by Springer Science & Business Media. This book was released on 2012-12-13 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: Like all industrialized countries, China has encountered increasing problems with land contamination in recent years. Abandoned mining and manufacturing sites and obsolete industrial complexes, while also creating new polluting industrial enterprises, represent impending environmental threats. More importantly, a number of social and economic problems have developed and must be dealt with, in some cases urgently. Contaminated land laws and regulations have been established and have evolved in the US and UK and many other jurisdictions over the past few decades. These regimes have substantially influenced the relevant legislation in the context of numerous Asian and European countries and will inevitably benefit similar legislative efforts in China. This book is the first monograph that focuses on how China can learn from the US and UK with respect to contaminated land legislation and comprehensively illustrates how contaminated land law could be created in China. It will be of interest to academics and practitioners in environmental law in China, as well as the US and UK.

This book was released on 2017-12-01 with total page 113 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Superfund program of the US Environmental Protection Agency (EPA) was created in the 1980s to address human-health and environmental risks posed by abandoned or uncontrolled hazardous-waste sites. Identification of Superfund sites and their remediation is an expensive multistep process. As part of this process, EPA attempts to identify parties that are responsible for the contamination and thus financially responsible for remediation. Identification of potentially responsible parties is complicated because Superfund sites can have a long history of use and involve contaminants that can have many sources. Such is often the case for mining sites that involve metal contamination; metals occur naturally in the environment, they can be contaminants in the wastes generated at or released from the sites, and they can be used in consumer products, which can degrade and release the metals back to the environment. This report examines the extent to which various sources contribute to environmental lead contamination at Superfund sites that are near lead-mining areas and focuses on sources that contribute to lead contamination at sites near the Southeast Missouri Lead Mining District. It recommends potential improvements in approaches used for assessing sources of lead contamination at or near Superfund sites.

Book Synopsis The Rio Declaration on Environment and Development by : Jorge E. Viñuales
Download or read book The Rio Declaration on Environment and Development written by Jorge E. Viñuales and published by OUP Oxford. This book was released on 2015-02-05 with total page 721 pages. Available in PDF, EPUB and Kindle. Book excerpt: The international community has long grappled with the issue of safeguarding the environment and encouraging sustainable development, often with little result. The 1992 Rio Declaration on Environment and Development was an emphatic attempt to address this issue, setting down 27 key principles for the international community to follow. These principles define the rights of people to sustainable development, and the responsibilities of states to safeguard the common environment. The Rio Declaration established that long term economic progress required a connection to environmental protection. It was designed as an authoritative and comprehensive statement of the principles of sustainable development law, an instrument to take stock of the past international and domestic practice, a guide for the design of new multilateral environmental regimes, and as a reference for litigation. This commentary provides an authoritative and comprehensive overview of the principles of the Declaration, written by over thirty inter-disciplinary contributors, including both leading practitioners and academics. Each principle is analysed in light of its origins and rationale. The book investigates each principle's travaux préparatoires setting out the main points of controversy and the position of different countries or groups. It analyses the scope and dimensions of each principle, providing an in-depth understanding of its legal effects, including whether it can be relied before a domestic or international court. It also assesses the impact of the principles on subsequent soft law and treaty development, as well as domestic and international jurisprudence. The authors demonstrate the ways in which the principles interact with each other, and finally provide a detailed analysis of the shortcomings and future potential of each principle. This book will be of vital importance to practitioners, scholars, and students of international environomental law and sustainable development.
Download or read book Responsive States written by Andrew Karch and published by Cambridge University Press. This book was released on 2019-11-28 with total page 255 pages. Available in PDF, EPUB and Kindle. Book excerpt: The US Constitution did not establish a clear division of responsibilities between the national government and state governments, so the distribution of policymaking authority is subject to constant renegotiation and debate. When national lawmakers introduce policy initiatives that implicate the states in important ways, why do state leaders sometimes respond with strong support and other times with indifference or outright hostility? Moving beyond the conventional story that state officials simply want money and autonomy from their national counterparts, this book explains how the states' responses over the short, medium, and long term are shaped by policy design, timing, and the interaction between the two. Reaching across different historical eras with in-depth case studies of policies such as Superfund, the No Child Left Behind Act, and the Patient Protection and Affordable Care Act, the book shows how federalism has influenced, and continues to influence, the evolution of American public policy.
Book Synopsis Stratospheric Ozone Damage and Legal Liability by : Lisa Elges
Download or read book Stratospheric Ozone Damage and Legal Liability written by Lisa Elges and published by Routledge. This book was released on 2016-12-19 with total page 194 pages. Available in PDF, EPUB and Kindle. Book excerpt: While government enforcement of laws and regulations to control the production of chloroflurocarbons in 1987 has been hailed as exemplifying the precautionary principle, for almost two decades US companies failed to take precautionary measures to prevent chemical emissions, despite the probable risk of stratospheric ozone loss. As a result, human harms in the form of skin cancer have reached epidemic proportions globally and in the United States where, today, one person dies every hour from skin cancer. This book reviews U.S. laws, regulations, and policies, as well as case law regarding similar toxic tort cases to consider whether companies can and should be held legally liable under tort common law theories and related tort justice theories for having contributed to increased risks of skin cancer.
Download or read book Toxic City written by Lindsey Dillon and published by Univ of California Press. This book was released on 2024-04-09 with total page 241 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Toxic City examines the politics of environmental repair and urban redevelopment in a historically segregated neighborhood of San Francisco. The book argues that environmental racism is part of a broad history of harm linked to slavery and its afterlives, and that environmental justice can be considered within a larger project of reparations. The book also details how, over many decades, residents have argued that toxic cleanup and urban redevelopment ought to be a socially, economically, and ecologically reparative process that supports the self-determination of Black residents"--

Download or read book Sustainability and the Rights of Nature written by Cameron La Follette and published by CRC Press. This book was released on 2017-06-01 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sustainability and the Rights of Nature: An Introduction is a much-needed guide that addresses the exciting and significant paradigm shift to the Rights of Nature, as it is occurring both in the United States and internationally in the fields of environmental law and environmental sustainability. This shift advocates building a relationship of integrity and reciprocity with the planet by placing Nature in the forefront of our rights-based legal systems. The authors discuss means of achieving this by laying out Nature’s Laws of Reciprocity and providing a roadmap of the strategies and directions needed to create a Rights of Nature-oriented legal system that will shape and maintain human activities in an environmentally sustainable manner. This work is enriched with an array of unique and relevant points of reference such as the feudal notions of obligation, principles of traditional indigenous cultivation, the Pope Francis Encyclical on the environment, and the new Rights of Nature-based legal systems of Ecuador and Bolivia that can serve as prototypes for the United States and other countries around the world to help ensure a future of environmental sustainability for all living systems.
