Available in PDF, EPUB and Kindle. Book excerpt: Corporate Criminal Investigations and Prosecutions provides readers a comprehensive understanding of the process behind the investigation, prosecution, and resolution of criminal charges against organizations. Over the past two decades, corporate criminal liability has developed into one of the fastest-growing and most dynamic areas of legal practice. The growth of corporate criminal enforcement has correlated with a broad shift in how the government investigates and resolves corporate criminal violations. As a result of these developments, the practice of investigating, prosecuting, and resolving corporate criminal cases has many significant differences from other areas of criminal or civil law. Notably, one of the most significant aspects that distinguishes corporate criminal practice is that much of it occurs outside of the formal judicial system; nearly all DOJ corporate criminal matters are resolved through negotiated settlements, and very few cases involve court proceedings or go to trial. As a result, many parts of this practice remain relatively unknown to students and practitioners. Until now. With the publication of this book, authors Leo Tsao, Daniel Kahn, and Eugene Soltes, whose resumes collectively reflect the highest levels of practice and expertise in this field, open a window into all aspects of corporate criminal investigations and prosecutions. Professors and students will benefit from: The authors bring a unique perspective and unparalleled qualifications to the subject of corporate criminal liability. Daniel Kahn is the former acting Deputy Assistant Attorney General of the Criminal Division and former Chief of the Fraud Section and FCPA Unit. Leo Tsao is the former Principal Deputy Chief of the Money Laundering and Asset Recovery Section and has held supervisory positions in the Bank Integrity Unit and FCPA Unit within the DOJ’s Criminal Division. Eugene Soltes is a professor at Harvard Business School, and regularly teaches and advises companies on corporate integrity, organizational cultures, and compliance systems. Comprehensive coverage: Part One addresses topics that are generally applicable to all corporate criminal cases, such as the legal principles underlying corporate criminal liability; the individual liability of corporate officers for corporate crimes; and the constitutional rights of criminal corporate defendants—to name a few. Part Two addresses specific categories of federal crimes commonly used to charge corporate defendants, such as conspiracy, the FCPA, the Bank Secrecy Act, antitrust laws, and RICO. Part Two also provides insights into criminal activity and law enforcement within the technology sector as it pertains to virtual currency (e.g., Bitcoin). Extensive online resources include discussion questions, and relevant case material for key chapters

Available in PDF, EPUB and Kindle. Book excerpt: A solution to the problem of climate change requires close international cooperation and difficult reforms involving all states. Law has a clear role to play in that solution. What is not so clear is the role that law has played to date as a constraining factor on state conduct. International Climate Change Law and State Compliance is an unprecedented treatment of the nature of climate change law and the compliance of states with that law. The book argues that the international climate change regime, in the twenty or so years it has been in existence, has developed certain normative rules of law, binding on states. State conduct under these rules is characterized by generally high compliance in areas where equity is not a major concern. There is, by contrast, low compliance in matters requiring a burden-sharing agreement among states to reduce global greenhouse gas emissions to a ‘safe’ level. The book argues that the substantive climate law presently in place must be further developed, through normative rules that bind states individually to top-down mitigation commitments. While a solution to the problem of climate change must take this form, the law’s development in this direction is likely to be hesitant and slow. The book is aimed at scholars and graduate students in environmental law, international law, and international relations.

Available in PDF, EPUB and Kindle. Book excerpt: Nationally, teachers, administrators, school board members and other stakeholders are increasingly concerned about the status of student achievement. Lawmakers have often sought "silver bullet" and "quick fix" solutions to the complex problem of improving school performance with little or no impact. Performance is Key "opens the door" to Connecting the Links to Leadership and Excellence by providing the essential elements necessary to reach higher performance levels but is also diagnostic and prescriptive in identifying the disconnections that impede higher performance and provides practical solutions through a framework for improvement along with associated success strategies. Practitioners and aspiring leaders will appreciate not only the rationale for immediate action but the systemic approach to excellence. Dr. Vince Cotter and Dr. Bob Hassler recognize that it is often the subtle nuances of how and what we do that can make a difference between success and failure. Too often reflection is overlooked in its potential to assess the status of an organization and its ability to provide direction to leaders in moving an organization toward higher performance. Poignant and thought provoking questions assist to position a leader's thinking, overview and focus on performance. Performance is Key also recognizes that real sustainable solutions are internally developed in a collaborative manner and that all schools and districts have the capacity to improve performance outcomes. To further assist educational leaders, a framework and an assessment instrument "crosscheck" the operational nature of key elements for success among school and district stakeholders. While common "pitfalls" to higher performance are noted, leaders are provided with a host of practical tools, strategies and recommendations to overcome obstacles, build internal support and to reach higher levels of performance. Performance is Key will demonstrate the importance of utilizing the four essential elements in a coordinated and collaborative manner and how leaders can execute implementation plans which incorporate those elements in a synergistic way that will lead to high performance. In an effort to make improved performance a reality, professional development activities are provided in the form of worksheets and leadership exercises to build a culture of continuous improvement and a belief that each and every school has the internal capacity to reach excellence.
