Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of competition law and its interpretation in Hungary covers every aspect of the subject - the various forms of restrictive agreements and abuse of dominance prohibited by law and the rules on merger control; tests of illegality; filing obligations; administrative investigation and enforcement procedures; civil remedies and criminal penalties; and raising challenges to administrative decisions. Lawyers who handle transnational commercial transactions will appreciate the explanation of fundamental differences in procedure from one legal system to another, as well as the international aspects of competition law. Throughout the book, the treatment emphasizes enforcement, with relevant cases analysed where appropriate. An informative introductory chapter provides detailed information on the economic, legal, and historical background, including national and international sources, scope of application, an overview of substantive provisions and main notions, and a comprehensive description of the enforcement system including private enforcement. The book proceeds to a detailed analysis of substantive prohibitions, including cartels and other horizontal agreements, vertical restraints, the various types of abusive conduct by the dominant firms and the appraisal of concentrations, and then goes on to the administrative enforcement of competition law, with a focus on the antitrust authorities' powers of investigation and the right of defence of suspected companies. This part also covers voluntary merger notifications and clearance decisions, as well as a description of the judicial review of administrative decisions. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Hungary will welcome this very useful guide, and academics and researchers will appreciate its value in the study of international and comparative competition law.

Available in PDF, EPUB and Kindle. Book excerpt: In this article I evaluate the available case law (16 cases) on the private enforcement of Hungarian and EU competition rules in stand-alone actions. Before 1st of November 2005 it was not clear whether it was possible to initiate stand-alone actions based on Articles 11 (anticompetitive agreements) and 21 (abuse of a dominant position) of the Hungarian Competition Act (HCA). The courts interpreted the law in a way which in their opinion prevented the direct application of competition rules by the courts. The law was therefore amended in November 2005 and the HCA directly allows for private actions. In recent years the number of reported cases grew, but basically all of them were either unfounded or frivolous. In most of the cases the parties were just trying to invoke every legal norm which might aid them and somehow they found that the wording of the HCA might be useful. In most of the cases it turned out that relying on the HCA had no merits at all. Most of the judgements are either not discussing the competition issues at all, or only reflect to the arguments of the parties briefly. Only some cases go into the details and have a meaningful discussion of the provisions of the HCA and whether they are applicable or not. The article depicts a very unsatisfactory situation and provides a thorough overview of the recent case law.

Available in PDF, EPUB and Kindle. Book excerpt: Hungarian competition law substantially changed in the last 10 years. After a blooming period before the Second World War the Soviet influence as a matter of course prevented any idea of free and undistorted competition. After the regime change in 1989/1990, the former Price Regulator was transformed to the Hungarian competition authority (Gazdasági Versenyhivatal, GVH). The first six years between 1990 and 1996 were used to develop and lay down the foundations of modern competition law. The new competition act in 1996 was than designed with an eye on the future accession of Hungary to the European Union. The enforcement of Hungarian competition law is recognised as flexible and usually both textual amendments of the competition act and changes in the decisional practice quickly respond to new developments on European level. Nevertheless, many interesting issues might be of interest to everybody. Just to name a few: in recent decisions dynamic competition is recognised as a driving force for competition, leading to long-term increase in consumer welfare; bid-rigging of public procurements is criminalised; private enforcement is directly recognised in the competition act; etc.

Book excerpt: The paper gives an overview about the development of modern Hungarian competition law. It presents how the Europe Agreements' harmonization clause and Article 62 mirroring the competition rules of the E.C. Treaty had an impact on legislation and the evolving practice of the Hungarian Competition Authority. The Hungarian Constitutional Court challenged the applicability of the Implementing Rules of Article 62 EEA leading to the adoption of a new set of competition rules broadly in line with the approach European Economic Area.

Available in PDF, EPUB and Kindle. Book excerpt: I will present how Hungarian competition rules and the practice of the Hungarian Competition Authority were influenced by the EU acquis. The Constitutional Court's decision will be presented that paved the way for a decision of the Association Council adopting new Implementing Rules of the Europe Agreement, mirroring the approach of the European Economic Area's competition rules. The legally binding obligation to bring domestic competition rules in line with Community standards turned later into a process of drawing inspiration not only from EU hard law but also from soft law instruments in cases where Hungarian competition rules were applied. The paper recalls how the authority GVH prepared both itself and the business sphere during the pre-accession period for the EU membership era. The most important changes in legislation following EU accession and also the most important features of law enforcement are analyzed to show how autonomous the legislative and enforcement activity of a new Member State can be. The functioning and the leading role of the European Competition Network (ECN) in promoting a soft form of harmonization, known as 'convergence', will be presented. The paper discusses how the Hungarian Competition Authority applied and sometimes disregarded EU competition law provisions. Finally, a couple of actual competition law issues are discussed, like the harmonization of fining and leniency policies, recent development in private enforcement legislation and the problems with parallel investigations by several European competition authorities.

Book excerpt: Increasingly more focus is placed on the human rights aspects of competition enforcement in the past years also in Hungary. By now, the Hungarian courts clarified the human rights aspects of Hungarian competition law from various perspectives. The goal of this study is to give practical insight as to how the Hungarian courts interpret the human rights aspects of Hungarian competition law in particular regarding the application of criminal law procedural guarantees in the context of competition enforcement, the confidential treatment of the data of the protected witness, the statement of objections, the standards of proof, notices issued by the competition authority, dawn raids and fines.

Available in PDF, EPUB and Kindle. Book excerpt: This book comprises a set of papers that were prepared for and delivered at the Global Competition Law Centre's Annual Conference "Modernisation and Enlargement: Two Major Challenges for EC Competition Law". The book presents an analysis of the new Regulation 1/2003 on the implementation of the competition rules laid down in Article 81 and 82 of the Treaty. This new Regulation represents a cultural revolution for EC competition lawyers, who were accustomed to notifying agreements in order to obtain some legal certainty for their clients. Modernisation opens up a brand new world where corporations and their lawyers will be asked to self-assess the validity of their agreements under EC competition law. The direct effect given to Article 81(3) will also stimulate implementation at the national level, including actions in national courts, although several procedural issues may impede private actions in courts. Amongc its other features, Regulation 1/2003 also creates a European Competition Network (ECN), which provides an institutional focus for cooperation between the NCAs and the Commission, as well as among the NCAs themselves. Enlargement of the European Union was one of the factors, which contributed to the adoption of Regulation 1/2003. Enlargement will expand the geographical scope of application of EC competition rules, but it will also create many important challenges. The NCAs of the new Member States are relatively new organisations, which in some cases lack the expertise and resources to pursue a credible enforcement agenda. These Member States are, however, willing to take on those challenges and, though a period of adaptation will be needed, there are no reasons why they should be unable to progressively develop a successful competition policy. Already, some agencies (e.g., in Hungary or Poland) have developed a credible enforcement record. This book is invaluable for all EU competition lawyers.
