This book was released on 1999-03-31 with total page 314 pages. Available in PDF, EPUB and Kindle. Book excerpt: Do the antitrust laws have a place in the digital economy or are they obsolete? That is the question raised by the government's legal action against Microsoft, and it is the question this volume is designed to answer. America's antitrust laws were born out of the Industrial Revolution. Opponents of the antitrust laws argue that whatever merit the antitrust laws may have had in the past they have no place in a digital economy. Rapid innovation makes the accumulation of market power practically impossible. Markets change too quickly for antitrust actions to keep up. And antitrust remedies are inevitably regulatory and hence threaten to `regulate business'. A different view - and, generally, the view presented in this volume - is that antitrust law can and does have an important and constructive role to play in the digital economy. The software business is new, it is complex, and it is rapidly moving. Analysis of market definition, contestibility and potential competition, the role of innovation, network externalities, cost structures and marketing channels present challenges for academics, policymakers and judges alike. Evaluating consumer harm is problematic. Distinguishing between illegal conduct and brutal - but legitimate - competition is often difficult. Is antitrust analysis up to the challenge? This volume suggests that antitrust analysis `still works'. In stark contrast to the political rhetoric that has surrounded much of the debate over the Microsoft case, the articles presented here suggest neither that Microsoft is inherently bad, nor that it deserves a de facto exemption from the antitrust laws. Instead, they offer insights - for policymakers, courts, practitioners, professors and students of antitrust policy everywhere - on how antitrust analysis can be applied to the business of making and marketing computer software.

Available in PDF, EPUB and Kindle. Book excerpt: In addition to being the principal medium for communication, education and entertainment the new economy is now a leading provider of goods and services through electronic channels. The new economy rides on the crest of new technological developments in computers, telecommunications and satellites creating new interactive mediums and from the deregulation and privatization of state owned enterprises in the telecommunications and broadcasting sectors. Whilst the economic viability of the dotcoms is questioned, the existence of a new economy with novel methods of production, distribution and exchange is here to stay. Evidence of this is the fact that there are 300 million active computers in the world, with 350 million people who use the world wide web (expected to grow to one billion in four years), and the speed of microprocessors continuously increases, facilitating the use of IT. The question which is pursued in the series of essays in this book is whether the conceptual underpinnings of competition law and international regulatory mechanisms are adequate or appropriate to deal with the developments raised by the new economy.

Book excerpt: Global competitiveness has always been a hotly debated issue, promoting differing opinions among economists, management strategists, business leaders, and policy analysts and consultants. Global Economic Competition provides a broad framework to compare the United States economy with 23 other global economies. This is done by presenting empirical evidence in a series of comparative analyses of economic competition using data pertaining to specific countries, industries and companies. In this volume, the electronics industries are used to illustrate an ongoing economic warfare among competing regions, nations, and cluster companies across the electronic technology chain. Employing the latest empirical data to evaluate the competitiveness of the US economy and its electronic industries and companies in the 1980s and early 1990s, Global Economic Competition will be of interest not only to those who study economics, management science and international trade, but also to policy makers and business leaders.

Exploring the substantive differences between competition law and sector-specific regulation after the methodological integration, it presents the first detailed analysis of the many hundreds of notifications and Commission letters generated under the Article 7 procedure, identifying the most relevant cases dealing with market definition, market power, and remedies. It compares these decisions with relevant competition law cases and highlights elements with a bearing on sector-specific regulation. It also offers hugely valuable guidance through the vast amount of documents in the Commission’s CIRCA database. Topics and issues raised include the following: definition of product markets; delineation of geographic markets (including sub-national); different practices in relation to assessing single market power and collective market power; and competition problems such as refusal to deal, margin squeeze, non-price discrimination, and excessive pricing. There can be little doubt that this is the new reference point for researchers and practitioners in this domain. By systematically categorizing the concepts and legal criteria and building a solid theoretical framework on the intersection of competition law and sector-specific regulation, the author has created a resource that is sure to be welcomed by all those involved in regulation of electronic communications markets and network industries in general: academic scholars, telecommunications regulators at the EU and Member State levels, competition authorities, law firms specializing in IT/communications law, practitioners in IT and telecommunications companies, and consultants in the sector. The book will also prove very useful for scholars and practitioners in other parts of the world interested in comparing the EU system with their own.

This trend is expected to continue in the future given the region’s large population base, rising middle-class and improvements in connectivity. This edited volume examines the current state of e-commerce in ASEAN countries. It highlights some of the key domestic and cross-border challenges faced by ASEAN member states in developing e-commerce. These challenges include the regulatory and legal environment in which e-commerce firms operate across ASEAN, and the supporting infrastructure in ASEAN member states. “A comprehensive snapshot of the latest emerging regulatory, policy and consumer issues. It’s essential reading for anyone working in this field. E-commerce is fundamentally altering the way in which businesses are being conducted, both within and between ASEAN countries. More than just an alternate distribution channel, online trading offers new opportunities and challenges for consumers, businesses, regulators and policymakers. How do markets operate in the new paradigm? How should regulators and governments ensure that dynamic competitive economies evolve, instead of descending into anti-competitive structures? And how are markets evolving in different parts of Southeast Asia? All of these issues—and much more—are discussed in here. The editors are to be congratulated for assembling a range of insightful perspectives from across ASEAN. These are issues that will affect the region for many years to come. The lessons here are timely and timeless.” —Michael Schaper Ph.D., Deputy Chairman, Australian Competition and Consumer Commission, 2008–18

Book excerpt: In digital markets, data protection and competition law affect each other in diverse and intricate ways. Their entanglement has triggered a global debate on how these two areas of law should interact to effectively address new harms and ensure that the digital economy flourishes. Coherence between Data Protection and Competition Law in Digital Markets offers a blueprint for bridging the disconnect between data protection and competition law and ensuring a coherent approach towards their enforcement in digital markets. Specifically, this book focuses on the evolution of data protection and competition law, their underlying rationale, their key features and common objectives, and provides a series of examples to demonstrate how the same empirical phenomena in digital markets pose a common challenge to protecting personal data and promoting market competitiveness. A panoply of theoretical and empirical commonalities between these two fields of law, as this volume shows, are barely mirrored in the legal, enforcement, policy, and institutional approaches in the EU and beyond, where the silo approach continues to prevail. The ideas that Majcher puts forward for a more synergetic integration of data protection and competition law are anchored in the concept of 'sectional coherence'. This new coherence-centred paradigm reimagines the interpretation and enforcement of data protection and competition law as mutually cognizant and reciprocal, allowing readers to explore, in an innovative way, the interface between these legal fields and identify positive interactions, instead of merely addressing inconsistencies and tensions. This book reflects on the conceptual, practical, institutional, and constitutional implications of the transition towards coherence and the relevance of its findings for other jurisdictions.

Book excerpt: The phenomena of Japan emerging as one of the most competitive industrial nations in the twentieth century and the general shift of competitiveness to East Asia since the 1980s have been widely studied by many scholars from different fields of the social sciences. Drawing on sources from Japanese, Swiss, and American archives, the historical analysis of this book tackles a wide range of actors and sheds light on the various processes that enabled Japanese watch companies to transfer technology and expand commercially starting in the second half of the nineteenth century. By exploring the case of the watch industry, this book serves to establish a better understanding of the origins of the competitiveness of Japanese manufacturing and its evolution until its decline in the post‐bubble economy (in the 1990s and 2000s).
