Book excerpt: Une analyse rapide du contenu des lois de décentralisation de 1982-1983 pouvait laisser penser que les collectivités territoriales et notamment la région nouvellement reconnue en tant que telle, allaient participer davantage à la politique de formation professionnelle des jeunes. MAis la crise de l'emploi dans la jeunesse a poussé l'Etat de 1984 à 1993 à prendre l'initiative ssentielle et à ne laisser aux pouvoirs locaux que des fonctions de suppléance. De surcroît, les principes régissant le fonctionnement de la décentralisation ont été, à cette époque malmenés. Les moyens tant humains que financiers nécessaires à l'intervention locale n'ont en effet qu'insufisamment transférés par le pouvoir central. Devant la recrudescence, des problèmes reencontrés par les juenes sur le terrain et les moyens limités du budget de l'Etat, la législation depuis le début des années 90 s'infléchit pour reconnaître de plus en plus de "libertés d'action" aux collectivités territoriales. La loi quinquennale pour l'emploi du 20 décembre 1993 constitue à cet égard l'aspect le plus visible du changement de cap. Elle offre de nouvelles prérogatives aux régions et ouvre le partenariat aux collectivités de base ainsi qu'aux partenaires économiques et sociaux. Cependant, si les missions des collectivités territoriales un moment étouffées semblent réapparaître aujourd'hui en pleine lumière, il esst toujours nécessaire de clarifier les compétences. L'apport majeur de la réforme quinquennale est sans conteste d'avoir introduit la légitimité territoriale dans la conduite de formation professionnlle des jeunes, mais elle n'a pas permis à la décentralisation de véritablement s'affirmer. La concurrence entre les différents acteurs, Etat et régions esssentiellement, reste de mise.

La première partie s'attache à démontrer que dans la gestion de cette compétence, la libre administration des collectivités territoriales n'est qu'illusoire. Elles sont désormais seules responsables de la gestion administrative et technique attachée à cette compétence, et surtout, nous constatons que leur objectif en la matière est de plus en plus renforcé. Un si grand nombre de responsabilités leur ont été transférées, que l'on peut parler aujourd'hui de décentralisation éducative. Il s'agit dans cette première partie d'examiner également les tenants et aboutissants de la gestion financière attachée à cette compétence, en particulier dans le contexte difficile de baisse des dotations allouées par l'état aux collectivités locales. La seconde partie de l'analyse démontre que les collectivités sont étouffées dans leur gestion locale entre autres par les activités annexes à l'enseignement, activités qui leurs sont imposées. C'est ainsi le cas des transports ou de la cantine scolaire, sans parler des nouvelles réformes souhaitées par le pouvoir règlementaire telles que le service minimum d'accueil et les activités périscolaires, des mesures véritablement contraignantes pour les communes. Nous constaterons enfin, que l'école d'antan évolue. Cette évolution se caractérise principalement par le transfert de la compétence enseignement de la commune vers l'intercommunalité

In this book, the question of the responsibility under international law of former colonial States is addressed. Such a legal responsibility would presuppose the violation of the international law that was applicable at the time of colonization. In the ‘Scramble for Africa’ during the Age of New Imperialism (1870-1914), European States and non-State actors mainly used cession and protectorate treaties to acquire territorial sovereignty (imperium) and property rights over land (dominium). The question is raised whether Europeans did or did not on a systematic scale breach these treaties in the context of the acquisition of territory and the expansion of empire, mainly through extending sovereignty rights and, subsequently, intervening in the internal affairs of African political entities.

The recommendations to introduce such a scheme would create a new legal tool, enabling landowners to protect land in order to conserve and restore our natural and built environment. Conservation covenants would allow landowners voluntarily to create binding obligations on their own land to meet a conservation objective, such as preserving woodland, cultivating a particular species of plant or protecting a habitat for an animal, or farming land in a certain way. The proposed statutory scheme would give individual landowners the opportunity, using private agreements, to contribute to conservation efforts being made across England and Wales. The scheme will create a versatile, simple and cost-effective legal tool capable of: unlocking currently missed conservation opportunities by overcoming the legal difficulties faced when creating binding obligations; facilitating better ways to deliver existing conservation objectives; and providing assurance of long-term conservation benefits. The report includes a draft Conservation Covenants Bill, which would introduce the conservation covenant scheme into the law of England and Wales.
