Available in PDF, EPUB and Kindle. Book excerpt: The Trans-Pacific Partnership, with its twelve participating countries on three continents, is the largest regional trade and investment agreement that Canada has ever negotiated. It is also one of the most controversial— for good reason. Negotiations ended exactly a year ago, in October 2015, and the TPP was signed in New Zealand in February 2016. But there is no guarantee it will ever come into effect. Opposition to the TPP is strongest in the United States, where both 2016 presidential nominees vowed to kill or significantly renegotiate the deal. Outgoing President Barack Obama characterized the TPP as a Made-in-America deal in the hope of getting it passed into law shortly after the November presidential election. But is what is good for corporate America good for Canada? In this book, experts in a dozen policy areas explain what the impact of the TPP agreement would be on Canada. Many of the key issues they explore have received little media coverage, notably the effect of the TPP on environmental protection, health care and other public services, Canada's cultural industries, the labour market, human rights and the democratic decision-making process generally. Perhaps most controversially, the TPP would expand the rights of multinational corporations to sue governments for policies and decisions that interfere with their profits. Most public commentary on the TPP in Canada has come from CEOs and business lobbyists with a vested interest in furthering a free-trade model that impoverishes democracy and weakens our ability to shape public-interest regulation. The expert contributors to this book, drawn from academia, the labour movement and NGO world, offer an independent and nuanced account of the real but underreported costs of the TPP.

Book excerpt: The problems related to the process of industrialisation such as biodiversity depletion, climate change and a worsening of health and living conditions, especially but not only in developing countries, intensify. Therefore, there is an increasing need to search for integrated solutions to make development more sustainable. The United Nations has acknowledged the problem and approved the “2030 Agenda for Sustainable Development”. On 1st January 2016, the 17 Sustainable Development Goals (SDGs) of the Agenda officially came into force. These goals cover the three dimensions of sustainable development: economic growth, social inclusion and environmental protection. The Encyclopedia of the UN Sustainable Development Goals comprehensively addresses the SDGs in an integrated way. The Encyclopedia encompasses 17 volumes, each one devoted to one of the 17 SDGs. This volume addresses SDG 8, namely "Promote sustained, inclusive and sustainable economic growth, full and productive employment and decent work for all" and contains the description of a range of terms, to allow a better understanding and foster knowledge. The predominant economic model is promoting a lopsided economic growth that is further increasing the gap between the have and the have-nots. This SDG is not just proposing the attainment of more just and empowering economic models, but it also puts at the forefront the well-being of workers by striving to provide employment and better working conditions that respect the dignity of workers. Concretely, the defined targets are: Sustain per capita economic growth in accordance with national circumstances and, in particular, at least 7 per cent gross domestic product growth per annum in the least developed countries Achieve higher levels of economic productivity through diversification, technological upgrading and innovation, including through a focus on high-value added and labour-intensive sectors Promote development-oriented policies that support productive activities, decent job creation, entrepreneurship, creativity and innovation, and encourage the formalization and growth of micro-, small- and medium-sized enterprises, including through access to financial services Improve progressively, through 2030, global resource efficiency in consumption and production and endeavour to decouple economic growth from environmental degradation, in accordance with the 10-Year Framework of Programmes on Sustainable Consumption and Production, with developed countries taking the lead Achieve full and productive employment and decent work for all women and men, including for young people and persons with disabilities, and equal pay for work of equal value Substantially reduce the proportion of youth not in employment, education or training Take immediate and effective measures to eradicate forced labour, end modern slavery and human trafficking and secure the prohibition and elimination of the worst forms of child labour, including recruitment and use of child soldiers, and end child labour in all its forms Protect labour rights and promote safe and secure working environments for all workers, including migrant workers, in particular women migrants, and those in precarious employment Devise and implement policies to promote sustainable tourism that creates jobs and promotes local culture and products Strengthen the capacity of domestic financial institutions to encourage and expand access to banking, insurance and financial services for all Increase Aid for Trade support for developing countries, in particular least developed countries, including through the Enhanced Integrated Framework for Trade-related Technical Assistance to Least Developed Countries Develop and operationalize a global strategy for youth employment and implement the Global Jobs Pact of the International Labour Organization Editorial Board Rimjhim M Aggarwal, Rosa Maria Fernandez, Edurne A. Book excerpt: "The multilateral trading system based on the General Agreement on Tariffs and Trade (GATT) is being eroded by a shift to bilateralism, surging protectionism, and flouting of its rules by the major trading countries. The inclusion of the complex issues of services, intellectual property, and investment in the Uruguay Round has only increased the strain on the GATT's structure. Reform and strengthening of the GATT system can no longer be delayed. Jackson argues that part of the problem lies in the defective constitutional nature of the GATT itself. He examines the institutional and constitutional changes the GATT would need in order to contain protectionist pressure and respond to the new issues in the evolving international economy. Jackson outlines the provisions of a new charter that would strengthen the foundations of the system. His proposed reform challenges policymakers and practitioners to think beyond the modest objectives of the Uruguay Round"--Unedited summary from book cover.

Available in PDF, EPUB and Kindle. Book excerpt: One of the most striking developments in American history has been the steady growth in the administrative process, to the point that the regulatory agencies of the federal government now affect the lives of more citizens more pervasively than the courts and possibly the Congress. In virtually every relevant respect, the administrative process has become a fourth branch of government, comparable in the scope of its authority and the impact of its decision making to the three more familiar constitutional branches. This book identifies and examines the causes of the enduring sense of crisis associated with the administrative process. This book argues a theory of legitimacy for the administrative process must be created. The author seeks to develop such a theory from the quality of administrative justice, taking as a premise the conviction that the capacity of government to devise fair procedures for the discharge of its decision-making responsibilities is the essence of democratic practice.

Book excerpt: Bruce Ackerman and David Golove tell the story of how the Treaty Clause was displaced in the twentieth century by a modern procedure in which the House of Representatives joins the Senate in the process of consideration, and simple majorities in both Houses suffice to commit the nation. This is called the Congressional-Executive Agreement, and is a response to a seachange in public opinion during and after World War II. As American troops swept through Europe, Americans at home were anxiously remembering the Senate's rejection of the Treaty of Versailles at the end of World War I. Would America once again win the war only to lose the peace? Rather than formally amending the Treaty Clause to strip a Senate minority of its veto power, political leaders of the 1940s developed the Congressional-Executive Agreement as an alternative to the classical treaty. But is such a fundamental change valid without a formal constitutional amendment? Challenging readers to rethink their understanding of the nature of constitutional change, this book vindicates the Congressional-Executive Agreement. In doing so, it not only establishes the validity of NAFTA and other recent initiatives like the World Trade Organization, but also establishes the constitutional framework for the democratic control of American diplomacy in the years ahead.
