Book excerpt: Challenging the view that England had no peasantry or that it had disappeared before industrialization, this text shows that common right and petty landholding shaped social relations in English villages. Their loss at enclosure sharpened social antagonisms and imprinted a pervasive sense of loss.

Available in PDF, EPUB and Kindle. Book excerpt: In this book, Gopal Sreenivasan provides a comprehensive interpretation of Locke's theory of property, and offers a critical assessment of that theory. Locke argued that the appropriation of things as private property does not violate the rights of others, provided that everyone still has access to the materials needed to produce their subsistence. Given that, the actual appropriation of particular things is legitimated by one's labor. Holding Locke's theory to the logic of its own argument, Sreenivasan examines the extent to which it is really serviceable as a defense of private property. He contends that a purified version of this theory - one that adheres consistently to the logic of Locke's argument while excluding considerations extraneous to it - does in fact legitimate a form of private property. This purified theory is defensible in contemporary, secular terms, since nothing to which Locke gives an ineliminable theological foundation belongs to the logical structure of his argument. The resulting regime of private property is both substantially egalitarian and significantly different from the traditional liberal institution of private property.

Available in PDF, EPUB and Kindle. Book excerpt: Current regulatory approaches have not prevented the loss of biodiversity across the world. This book explores the scope to strengthen conservation by using different legal mechanisms such as biodiversity offsetting, payment for ecosystem services and conservation covenants, as well as tradable development rights and taxation. The authors discuss how such mechanisms introduce elemhents of a market approach as well as private sector initiative and resources. They show how examples already in operation serve to highlight the design challenges, legal, technical and ethical, that must be overcome if these mechanisms are to be effective and widely accepted.

Book excerpt: A human rights-based agenda has received significant attention in writings on general development policy, but less so in forestry. Forests and People presents a comprehensive analysis of the rights-based agenda in forestry, connecting it with existing work on tenure reform, governance rights and cultural rights. As the editors note in their introduction, the attention to rights in forestry differs from 'rights-based approaches' in international development and other natural resource fields in three critical ways. First, redistribution is a central demand of activists in forestry but not in other fields. Many forest rights activists call for not only the redirection of forest benefits but also the redistribution of forest tenure to redress historical inequalities. Second, the rights agenda in forestry emerges from numerous grassroots initiatives, setting forest-related human rights apart from approaches that derive legitimacy from transnational human rights norms and are driven by international and national organizations. Third, forest rights activists attend to individual as well as peoples' collective rights whereas approaches in other fields tend to emphasize one or the other set of rights. Forests and People is a timely response to the challenges that remain for advocates as new trends and initiatives, such as market-based governance, REDD, and a rush to biofuels, can sometimes seem at odds with the gains from what has been a two decade expansion of forest peoples' rights. It explores the implications of these forces, and generates new insights on forest governance for scholars and provides strategic guidance for activists.
