La Ley eléctrica adoptada recientemente es consecuencia, en gran medida, de la obligación de transposición del Reino de España de la Directiva 2003/54, del Parlamento Europeo y del Consejo, sobre normas comunes para el establecimiento del mercado interior de la electricidad, que deroga la anterior Directiva 96/92 de la Comunidad Europea. Asimismo, y junto con las exigencias de adaptación de la norma comunitaria, la nueva Ley incorpora otras reformas en distintos apartados de las actividades eléctricas, del funcionamiento del mercado mayorista y minorista, y sobre la configuración institucional de los actores que intervienen en el sector eléctrico. El libro analiza los capítulos principales de la reforma: a) Las modificaciones introducidas en el marco de distribución de competencias entre el Estado y las Comunidades Autónomas; b) El nuevo régimen económico del sector eléctrico, orientado al fortalecimiento de la figura de los peajes de acceso y a la progresiva desaparición de la tarifa, si bien estableciendo una tarifa refugio, o de “último recurso”, para los clientes más vulnerables; c) El funcionamiento del mercado mayorista o “pool” y las distintas adaptaciones normativas que se han operado en los últimos tiempos, así como el encaje de la reforma en el ámbito de aplicación del Mercado Ibérico; d) Las competencias y funciones del organismo regulador independiente, así como la forma en que el legislador español ha procedido a designar a la autoridad regulatoria en el sector, de conformidad con las posibilidades ofrecidas por la Directiva comunitaria; e) El nuevo cuadro de sujetos del sector eléctrico, del que se suprimen, en razón del proceso de liberalización, distintas figuras, y se configura una nueva ordenación del suministro en favor de la figura del comercializador, quedando el distribuidor concentrado en el papel de gestor de las redes; así como otros aspectos que se entienden de especial interés para al estudio de esta reforma. Los autores, Santiago González-Varas Ibáñez, Joaquín Nebreda Pérez, Luis Pastor Ridruejo, Eduardo Salinas La Casta, Antonio Sánchez Rodríguez y Carlos Vázquez Cobos, que participan en esta obra, y el coordinador de la misma, Vicente López-Ibor Mayor, que realiza asimismo el estudio introductorio, son todos especialistas acreditados en el conocimiento de este Derecho, y efectúan una primera interpretación, con notable calidad e interés, sobre los puntos más importantes de este nuevo cambio normativo. Consideramos que este trabajo será de especial valor para todos aquellos juristas o técnicos profesionales de otras disciplinas, pero que tienen relación directa con el ordenamiento jurídico eléctrico, ya sea en el ámbito de la Administración Pública; del ejercicio libre de la profesión; de las actividades vinculadas a la regulación económica sectorial; de la conexión de este Derecho con la evolución de las normas comunitarias; o con cualquiera de las actividades o fases del suministro eléctrico, sea desde el sector público o desde el ámbito de los operadores privados.
