This book undertakes an innovative approach that overcomes these problems by enhancing our understanding of how sanctions work and by explaining what we can expect from their imposition. Through the analysis of the sanctioning experience of the United Nations and the European Union after the Cold War, the investigation tests a comprehensive theoretical model and concludes that the context in which sanctions are imposed is a crucial element in deciding the type of sanctions adopted. Giumelli shakes the pre-constituted conceptions that we have on sanctions and sets the terms for more constructive debates in the future.

Book excerpt: In the last decades, violent non-state actors (VNSAs) such as rebel and terrorist organizations have proved their capacity to break international law. The international community, particularly the United Nations (UN), has reacted to this development by redirecting its conflict resolution efforts to these non-state entities. This has turned targeted sanctions into one of the most vital and indispensable foreign policy tools available to the UN Security Council in combating terrorism and contributing to the peaceful resolution of (intra-state) conflicts. Despite the UN Security Council’s growing tendency to sanction VNSAs, there has been little research analyzing the effects of UN targeted sanctions on these non-government actors. This book seeks to fill this gap and shifts the focus on non-state actors by ascertaining the general mechanisms through and conditions under which UN targeted sanctions imposed on VNSAs tend to be effective. The tripartite empirical analysis combining quantitative and qualitative research methods demonstrates that the state-centric understanding of how sanctions work is not simply applicable to the effective sanctioning of violent non-state actors such as rebel and terrorist movements.

Punishment in International Society examines the penal philosophies and practices in international society. The contributions to this book show the added value of a punitive lens to international politics in two major ways: First, punitive practices reveal the contours of the international normative order, its structures, and hierarchies. Such a perspective highlights the prominent position of individuals in the current normative order, but it also reveals a major divergence in the international normative order between a global North that emphasizes individualized, retributive punishment for atrocity crimes and a global South that puts reparations for past colonial wrongs on the agenda. Second, in contrast to a nation-state, the authority to sanction and act in defense of the normative order is far more dispersed and contested in international society. Although there is a demand to embed punitive practices in procedures and institutions, the most legitimate site of such authority remains contested as regional organizations such as the African Union compete with the United Nations for the authority to defend the normative order. This book brings together an international roster of scholars from the social sciences, law, and humanities. The contributions demonstrate that punitive practices have been more prevalent than commonly acknowledged as they have often been masked as (self-)defence, reparations, or coercive diplomacy. By approaching international punishment from various disciplines, this volume sheds new light on different dimensions of the punitive practices across the globe.
