Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

Available in PDF, EPUB and Kindle. Book excerpt: "At the turn of the twentieth century, many observers considered suicide to be a worldwide social problem that had reached epidemic proportions. This idea was especially powerful in Mexico City, where tragic and violent deaths in public urban spaces seemed commonplace in a city undergoing rapid modernization. Crime rates mounted, corpses piled up in the morgue, and the media reported on sensational cases of murder and suicide. More troublesome still, a compelling death wish appeared to grip women and youth. Drawing on an extensive range of sources, from judicial records to the popular press, Death in the City examines the cultural meanings of death and self-destruction in modern Mexico. The author examines approaches and responses to suicide and death, disproving the long-held belief that Mexicans possessed a cavalier response to death"--Provided by publisher.

Available in PDF, EPUB and Kindle. Book excerpt: In the mid-to-late nineteenth century, as Mexico emerged out of decades of civil war and foreign invasion, a modern notion of honor—of one’s reputation and self-worth—became the keystone in the construction of public culture. Mexicans gave great symbolic, social, and material value to honor. Only honorable men could speak in the name of the public. Honor earned these men, and a few women, support and credit, and gave civilian politicians a claim to authority after an era dominated by military heroism. Tracing how notions of honor changed in nineteenth-century Mexico, Pablo Piccato examines legislation, journalism, parliamentary debates, criminal defamation cases, personal stories, urban protests, and the rise and decline of dueling in the 1890s. He highlights the centrality of notions of honor to debates over the nature of Mexican liberalism, describing how honor helped to define the boundaries between public and private life; balance competing claims of free speech, public opinion, and the protection of individual reputations; and motivate politicians, writers, and other men to enter public life. As Piccato explains, under the authoritarian rule of Porfirio Díaz, the state became more active in the protection of individual reputations. It implemented new restrictions on the press. This did not prevent people from all walks of life from defending their honor and reputations, whether in court or through violence. The Tyranny of Opinion is a major contribution to a new understanding of Mexican political history and the evolution of Mexican civil society.

Available in PDF, EPUB and Kindle. Book excerpt: This book puts forward proposals for solutions to the current gaps between the Mexican legal order and the norms and principles of international criminal law. Adequate legislative measures are suggested for compliance with international obligations. The author approaches the book's subject matter by tracing all norms related to the prosecution of core crimes and contextualizing each of the findings with a brief historical and political account. Additionally, state practice is analyzed, identifying patterns and inconsistencies. This approach is new in offering a wide perspective on international criminal law in Mexico. Relevant legal documents are analyzed and annexed in the book, providing the reader with a useful guide to the topics analyzed. Issues including the following are examined: the incorporation of core crimes in the Mexican legal order, military jurisdiction, the war crimes definition under Mexican law, unaddressed atrocities, state practice and future challenges to combat impunity. The book will be of relevance to legal scholars, students, practitioners of law and human rights advocates. It also offers interesting insights to political scientists, historians and journalists. Tania Ixchel Atilano has a Dr. Iur. from the Humboldt Universität Berlin, an LLM in German Law from the Ludwig Maximilian Universität, Munich, and attained her law degree at the ITAM in Mexico City.

Available in PDF, EPUB and Kindle. Book excerpt: Sex has no history, but sexual science does. Starting in the late nineteenth century, scholars and activists all over the world suddenly began to insist that understandings of sex be based on science. As Japanese and Indian sexologists influenced their German, British and American counterparts, and vice versa, sexuality, modernity, and imaginings of exotified “Others” became intimately linked. The first anthology to provide a worldwide perspective on the birth and development of the field, A Global History of Sexual Science contends that actors outside of Europe—in Asia, Latin America, and Africa—became important interlocutors in debates on prostitution, birth control or transvestitism. Ideas circulated through intellectual exchange, travel, and internationally produced and disseminated publications. Twenty scholars tackle specific issues, including the female orgasm and the criminalization of male homosexuality, to demonstrate how concepts and ideas introduced by sexual scientists gained currency throughout the modern world.
