Available in PDF, EPUB and Kindle. Book excerpt: Despite Porfirio Díaz's authoritarian rule (1877-1911) and the fifteen years of violent conflict typifying much of Mexican politics after 1917, law and judicial decision-making were important for the country's political and economic organization. Influenced by French theories of jurisprudence in addition to domestic events, progressive Mexican legal thinkers concluded that the liberal view of law—as existing primarily to guarantee the rights of individuals and of private property—was inadequate for solving the "social question"; the aim of the legal regime should instead be one of harmoniously regulating relations between interdependent groups of social actors. This book argues that the federal judiciary's adjudication of labor disputes and its elaboration of new legal principles played a significant part in the evolution of Mexican labor law and the nation's political and social compact. Indeed, this conclusion might seem paradoxical in a country with a civil law tradition, weak judiciary, authoritarian government, and endemic corruption. Suarez-Potts shows how and why judge-made law mattered, and why contemporaries paid close attention to the rulings of Supreme Court justices in labor cases as the nation's system of industrial relations was established.

Book excerpt: Abortion in Latin America and the Caribbean is the first major book to analyze the abortion laws of the Latin American and Caribbean nations that are parties to the American Convention on Human Rights. Making use of a broad range of materials relating to human rights and abortion law not yet available in English, the first part of this book analyzes how Inter-American human rights bodies have interpreted the American Convention’s prenatal right to life. The second part examines Article 4(1) of the American Convention, comparing and analyzing the laws regarding prenatal rights and abortion in all twenty-three nations that are parties to this treaty. Castaldi questions how Inter-American human rights bodies currently interpret Article 4(1). Against the predominant view, she argues that the purpose of this treaty is to grant legal protection of the unborn child from elective abortion that is broad and general, not merely exceptional. Abortion in Latin America and the Caribbean offers an objective analysis of national and international laws on abortion, proposing a new interpretation of the American Convention’s right-to-life provision that is nonrestrictive and provides general protection for the unborn. The book will appeal not only to students and scholars in the field of international human rights but also to human rights advocates more generally.

Available in PDF, EPUB and Kindle. Book excerpt: Crime exists in every society, revealing not only the way in which societies function but also exposing the standards that society holds about what is harmful and punishable. Criminalizing individuals and actions is not the exclusive domain of the state; it emerges from the collective consciousness—the judgments of individuals and groups who represent societal thinking and values. Studying how these individuals and groups construct, represent, perpetrate, and contest crime reveals how their message reinforces and also challenges historical and culturally specific notions of race, class, and gender. Voices of Crime examines these official and unofficial perceptions of deviancy, justice, and social control in modern Latin America. As a collection of essays exploring histories of crime and justice, the book focuses on both cultural and social history and the interactions among state institutions, the press, and a variety of elite and non-elite social groups. Arguing that crime in Latin America is best understood as a product of ongoing negotiation between “top-down” and “bottom up” ideas (not just as the exercise of power from the state), the authors seek to document and illustrate the everyday experiences of crime in particular settings, emphasizing underresearched historical actors such as criminals, victims, and police officers. The book examines how these social groups constructed, contested, navigated, and negotiated notions of crime, criminality, and justice. This reorientation—in contrast to much of the existing historical literature that focuses on elite and state actors—prompts the authors to critically examine the very definition of crime and its perpetrators, suggesting that “not only the actions of the poor and racial others but also the state can be termed as criminal.”

Book excerpt: Family policy holds a particular status in the quest for a more equitable world as it intersects the rights of women, children, and workers. But despite local and global efforts and initiatives, the state of family policy in different areas of the world varies widely. Through a cross-section of countries on six continents, Family Policies Across the Globe offers the current state of the laws concerning family life, structure, and services, providing historical, cultural, and socioeconomic context. Lucidly written chapters analyze key aspects of family definition, marriage, child well-being, work/family balance, and family assistance, reviewing underlying social issues and controversies as they exist in each country. Details of challenges to implementation and methods of evaluating policy outcomes bring practical realities into sharp focus, and each chapter concludes with recommendations for improvement at the research, service, and governmental levels. The result is an important comparative look at how governments support families, and how societies perceive themselves as they evolve. Among the issues covered: Sierra Leone: toward sustainable family policies. Russia: folkways versus state-ways. Japan: policy responses to a declining population. Australia: reform, revolutions, and lingering effects. Canada: a patchwork policy. Colombia: a focus on policies for vulnerable families. Researchers , professors and graduate students in the fields of social policy, child and family studies, psychology, sociology, and social work will find in Family Policies Across the Globe a reference that will grow in importance as world events continue to develop.
