Book excerpt: For more than 160 years, this book has been the authoritative ethics guide on medical professionalism. The Code speaks to the enduring values of medicine as a profession. As a statement of the values to which physicians commit themselves individually and collectively, the Code is the standard for medicine as a professional community. Addressing the professional challenges faced by physicians today, the Code of Medical Ethics presents guidance through more than 200 ethical opinions on topics ranging from physician obligation in disaster preparedness and response, to physician participation in interrogations, to genetic testing and counseling, to use of electronic mail and health-related online sites. In addition to containing the nine Principles of Medical Ethics, this resource incorporates new and updated opinions, such as quality and access to care, decision making for minor patients, breach of security in electronic health records, respecting civil rights in intra-professional relationships, and more. An essential companion for physicians and other medical professionals, attorneys, and patients who contend with the challenging issues and choices inherent in modern medicine, this resource has been increasingly looked to for legal advocacy, decision making in matters of health care law and litigation, and development of health care policy.

Book excerpt: Behind the scenes of the many artists and innovators flourishing beyond the bounds of intellectual property laws Intellectual property law, or IP law, is based on certain assumptions about creative behavior. The case for regulation assumes that creators have a fundamental legal right to prevent copying, and without this right they will under-invest in new work. But this premise fails to fully capture the reality of creative production. It ignores the range of powerful non-economic motivations that compel creativity, and it overlooks the capacity of creative industries for self-governance and innovative social and market responses to appropriation. This book reveals the on-the-ground practices of a range of creators and innovators. In doing so, it challenges intellectual property orthodoxy by showing that incentives for creative production often exist in the absence of, or in disregard for, formal legal protections. Instead, these communities rely on evolving social norms and market responses—sensitive to their particular cultural, competitive, and technological circumstances—to ensure creative incentives. From tattoo artists to medical researchers, Nigerian filmmakers to roller derby players, the communities illustrated in this book demonstrate that creativity can thrive without legal incentives, and perhaps more strikingly, that some creative communities prefer, and thrive, in environments defined by self-regulation rather than legal rules. Beyond their value as descriptions of specific industries and communities, the accounts collected here help to ground debates over IP policy in the empirical realities of the creative process. Their parallels and divergences also highlight the value of rules that are sensitive to the unique mix of conditions and motivations of particular industries and communities, rather than the monoculture of uniform regulation of the current IP system.

This book was released on 2000-06-15 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a lucid, readable discussion of ethical questions in health care as they arise on the business or organizational level: an effort to spell out an ethical perspective for healthcare organizations. It will be of use to students in health services management programs, health care professionals, healthcare administrators, and members of healthcare ethics committees. Hall begins with the ethical analysis of decision-making in the management of healthcare organizations and then addresses some of the questions of organizational ethics through an analysis of corporate social responsibility in for-profit and not-for-profit organizations and of the problem of uncompensated care. Later chapters take up patient development, community relations, diversity, employee relations, governmental relations, regulatory compliance and medical records. The author's analysis focuses on healthcare institutions as business organizations with many of the problems faced by corporate management in other fields but with the difference that health care holds a special place among human needs and has traditionally been viewed from an altruistic perspective. He gives special attention to the new standards on organizational ethics promulgated by the Joint Commission on Accreditation of Healthcare Organizations and includes many case studies not only to illustrate the main points but also to direct the reader's attention to peripheral aspects that can complicate theses issues.

Book excerpt: Intellectual Property at the Edge addresses both newly formed intellectual property rights and those which have lurked on the fringes, unadmitted to the established IP canon. It provides a basis for studying and discussing the history of these emerging rights as well as their relationship to new technological opportunities and to the changing importance of innovation and creative production in the global economy. In addition to addressing the scope of new rights, it also focuses on new limitations to patent, copyright and trademark rights that spring from similar changes. All of these developments are examined comparatively: for each new development, scholars in two jurisdictions analyse the evolving legal norm. In several instances, the first of the paired authors writes from the perspective of the legal system in which the doctrine emerged, and the second addresses its reception in her jurisdiction.

Book excerpt: of UB’s medical school, that UB developed its School of Arts and Sciences, and thus, assumed its place among the other institutions of higher education. Had Fillmore lived throughout UB’s first seventy years, he would probably have been elated by the success of his university, and he should have been satisfied and pleased that UB remained intrinsically bonded to its community while at the same time engrafting the values and standards important to higher education’s mission in the region. UB and its medical school have undergone many challenging transitions since 1846. Included among them were: (1) the completion of an academic campus in the far northeast comer of the City of Buffalo while leaving its medical, dental and law schools firmly situated in the core of downtown Buffalo; (2) the eventual relocation, after the second world war, of the law school to the newer campus in Amherst, and the medical and dental school to the original academic campus: and (3) the merger with the State University of New York System in 1962. Despite these significant transitions, any one of which could have changed the intrinsic integrity of UB and disrupted the bonding between community and university, that did not happen. To this day, the ties between community and academe persist. Fillmore and White should celebrate their success and important contribution to Buffalo and Western New York.
