Book excerpt: This thesis deals with the individual criminal liability under international law of NATO commanders for crimes committed by their subordinates in the context of complex, multilateral command and control structures. After analysing the applicable law, the elements that must be fulfilled in order to be able to prosecute commanders and other superiors under the doctrine of Command Responsibility are comprehensively described and the Command, Control & Communication structures within NATO and in NATO-led operations explained. Subsequently, the doctrine of Command Responsibility is applied to the identified structures taking into account the role of a commander acting in a multilateral NATO operation, the role of the Troop Contributing Nation, the methods of conferral of powers as well as the de iure and de facto effective control of such a commander leading a multilateral force. Die vorliegende Arbeit befasst sich mit der individuellen strafrechtlichen Verantwortlichkeit von NATO-Befehlshabern nach dem Völkerrecht für Straftaten ihrer Untergebenen im Rahmen komplexer, multilateraler Befehls- und Kommandostrukturen. Nach einer Darstellung des anwendbaren Rechts, werden die Voraussetzungen für eine Vorgesetztenverantwortlichkeit von Befehlshabern und anderen Vorgesetzten umfassend beschrieben und die Führungs-, Befehls- und Kommunikationsstrukturen innerhalb der NATO und bei NATO-geführten Einsätzen erläutert. Anschließend wird der Tatbestand der Vorgesetztenverantwortlichkeit unter Berücksichtigung der Stellung eines Befehlshabers in einem multilateralen NATO-Einsatz, der Rolle des truppenstellenden Staates, der Methoden der Befugnisübertragung sowie der de iure und de facto wirksame Kontrolle eines solchen Befehlshabers auf die ermittelten Strukturen angewandt.

The WBCSD has 200 member companies with combined annual revenues of US$7 _trillion_; the UN Global Compact has almost 8,000 corporate members, over two-thirds of them from developing countries. It is estimated that there are more than 110 national and international generalist business-led CR coalitions. But there is now urgent need for informed and balanced analysis of their achievements, their progress and their potential. Why did these coalitions start and grow? What have been their impacts? Where are they heading now? Where should they be going? What is the future? In a period of austerity, the business and public sector must decide whether funding these coalitions is a priority. To meet current crises, there will have to be a great deal more business involvement; but efforts of individual corporations will not be sufficient. There is also a need for far more collective action among companies and more collaborative action between different sectors of society. Business-led CR coalitions with their decades of convening experience could play an important role in this process - if they are fit for purpose going forward. Authors David Grayson and Jane Nelson have been actively involved in such coalitions for decades. However, while the historical rural-urban divide is eroding, rural landscapes are becoming more important to people for leisure, recreation and personal orientation. The complex processes affecting rural areas are proving difficult for the current institutions to manage. The challenge is to find ways to create new capacity to act and get sustainable initiatives off the ground; initiatives that are now often smothered or constrained by the institutional context. This book bridges the gap between theory and practice to explore the conditions required to enable a transition towards sustainable regional development. It analyses experiences in eight regions in the Netherlands where different regional strategies have been pursued: the development of new markets, rural services and linkages between producers and consumers, spatial designs, regional branding and new alliances between agricultural sectors and other sectors. The authors argue that specific forms of networks, called vital coalitions, have the ability to foster better regional co-operation, and identify the crucial requirements for vital co-operation. Book excerpt: Since the advent of the Second Republic in Italy in the mid-1990s, a new generation of politicians has announced a shift in the system toward greater governmental leadership, policy innovation, government accountability and responsiveness to the citizens. Yet in recent years government has experienced frequent crises and deadlocks, policy blockades and undisciplined parliamentary majorities. Has the attempt to change the nature of the Italian government totally failed? This book addresses this question by empirically assessing and theoretically evaluating the outcomes of the new system. It asks whether there has really been a shift toward a more majoritarian democracy and examines why alternation in power has failed to produce a more efficient and responsive government. It evaluates the connections between cabinet, parliament, parties and citizens, and in doing so, brings together diverse areas of inquiry such as government, legislative, party and public opinion studies.
